TRUSTEE’S SALE OF VALUABLE REAL ESTATE
The undersigned Substitute Trustee, by virtue of the authority vested in it by that certain Deed of Trust dated February 2, 1999, and duly recorded in the Office of the Clerk of the County Commission of Greenbrier County, West Virginia, in Deed of Trust Book 415, at Page 592, Carrell Stanley Cohenour did convey unto J. Michael Anderson and John Robert Holliday, Trustees, certain real property described in said Deed of Trust; and the beneficiary has elected to appoint Pill & Pill, PLLC as Substitute Trustee by a Substitution of Trustee recorded in the aforesaid Clerk’s Office; and default having been made under the aforementioned Deed of Trust, and the undersigned Substitute Trustee having been instructed by the secured party to foreclose thereunder, will offer for sale at public auction at the front door of the Greenbrier County Courthouse, in Lewisburg, West Virginia, on
January 28, 2020, at 9:30 AM
The following described real estate, with its improvements, easements and appurtenances thereunto belonging, situate in the Meadow Bluff District, Greenbrier County, West Virginia, and more particularly described as follows:
PARCEL NO. ONE:
All of those two tracts or parcels of land lying and being in Meadow Bluff District, Greenbrier County, West Virginia, the first tract containing 5 acres 90 poles, more or less, the second tract containing 3 acres 85 poles, more or less.
THERE IS FURTHER GRANTED AND CONVEYED a right-of-way for ingress and egress across a strip of land 15.00 feet wide and lying 7.50 feet to both sides of the following described lines and following an existing road bed, and described as follows:
“Beginning at point in the property line of the Greenbrier County Board of Education and James Cohenour, said point bears S 68 deg. 24′ 32″ E, 22.00 feet from the south west corner of said Cohenour 2.26 acre parcel; thence with the center line of an existing road the following courses: S 10 deg. 27′ 00″ W, 141.88 feet, thence; S 53 deg. 11′ 00″ E, 125.37 feet, thence; S 53 deg. 15′ 00″ E, 137.33 feet, thence; S 64 deg. 01′ 00″ E, 111.46 feet, thence; S 39 deg. 07′ 00″ E, 44.24 feet, thence; S 3 deg. 25′ 00″ W, 23.24 feet, thence; S 18 deg. 49′ 00″ W, 74.43 feet, thence; S 15 deg. 50′ 00″ W, 67.74 feet, thence; S 24 deg. 34′ 00″ W, 86.42 feet, to a point in the northern right-of-way line of WV. S.L.S. #27/5.”
THERE IS EXCEPTED AND RE-SERVED from the above described property that certain parcel containing 2.26 acres, more or less, as described in that certain Deed of Trust dated September 18, 1993 recorded in the aforesaid Clerk’s Office in Trust Deed Book 343 at page 414.
THERE IS FURTHER EXCEPTED AND RESERVED from the above described property that certain parcel containing 4,500 square feet heretofore conveyed unto the Board of Education of the County of Greenbrier, West Virginia, a corporation, by deed dated July 1, 1986 recorded in the aforesaid Clerk’s Office in Deed Book 375 at page 41.
PARCEL NO. TWO:
All that certain tract or parcel of real estate situate in Meadow Bluff District, Greenbrier County, West Virginia, at Smoot, and being more particularly bounded and described as follows:
“Beginning at a fence post, corner to Smooth Junior High School and the Stanley Property, thence; N 68 deg. 24′ 32″ W, at 163.00 feet, passing through an 18″ Black Cherry corner to Stanley 5 acre 90 pole tract and 3 acre 85 pole tract in all 390.00 feet, to a re-bar, set, in line of said Stanley and School Property, thence through Stanley Property; N 23 deg. 04′ 11″ E, 250.67 feet to a re-bar set in line of Stanley and Kenneth C. Kessee at the base of a forked black cherry, thence with said Kessee; S 68 deg. 51′ 07″ E, 390.00 feet to a re-bar set in said line, thence through Stanley property; S 23 deg. 13′ 17″ W. 253.61 feet, to the place of beginning and containing 2.26 acres more or less” as surveyed by Brackenrich & Associates, Incorporated in May 1987 and updated July 1991.
THERE IS FURTHER GRANTED AND CONVEYED A RIGHT-OF-WAY for ingress and egress across a strip of land 15.00 feet wide and lying 7.50 feet to both sides of the following described lines and following an existing road bed, and described as follows:
“Beginning at point in the property line of the Greenbrier County Board of Education and James Cohenour, said point bears S 68 deg. 24′ 32″ E, 22.00 feet from the south west corner of said Cohenour 2.26 acre parcel; thence with the center line of an existing road the following courses: S 10 deg. 27′ 00″ W, 141.88 feet, thence; S. 53 deg. 11′ 00″ E, 125.37 feet, thence; S 53 deg. 15′ 00″ E, 137.33 feet, thence: S 64 deg. 01′ 00″ E, 111.46 feet, thence; S 39 deg. 07′ 00″ E, 44.24 feet, thence; S 3 deg. 25′ 00″ W, 23.24 feet, thence; S 18 deg. 49′ 00″ W, 74.43 feet, thence; S 15 deg. 50′ 00″ W, 67.74 feet, thence; S 24 deg. 34′ 00″ W, 86.42 feet, to a point in the northern right-of-way line of WV. S.L.S. #27/5.”
At the time of the execution of the Deed of Trust, this property was reported to have a mailing address of School Road, Smoot, WV 24977. We have reason to believe the property now has a mailing address of 337 Smoot School Road, Smoot, WV 24977.
AND BEING the same real estate which was conveyed to James E. Cohenour and Carrell Stanley Cohenour in two separate Deeds:one dated December 15, 1983 and recorded in the Office of the Clerk of the County Commission of Greenbrier County, West Virginia in Deed Book 359, at Page 464; and one dated July 1, 1986 and recorded in the aforesaid Clerk’s Office in Deed Book 375, at Page 43. The said James E. Cohenour passed away from this life on April 29, 1998 and pursuant to the survivorship provisions of the aforementioned Deed, title vested in Carrell Stanley Cohenour.
The above-described property will be sold subject to any covenants, restrictions, easements, leases and conditions of record, and subject to any unpaid real estate taxes.
The subject property will be sold in “AS IS” condition. The Substitute Trustee shall be under no duty to cause any existing tenant or person occupying the subject property to vacate said property.
TERMS: One-third (1/3) of the purchase price in cash is due at the sale, with one-third (1/3) due, with interest, payable one year from the date of the sale, with the remaining one-third (1/3) due, with interest, payable two years from the date of the sale. A Deed will be issued after the payment of the first one-third (1/3) and a promissory note shall be executed by the purchaser, bearing interest at the rate of six (6.00) percent, which shall be secured by a Deed of Trust. There is no pre-payment penalty.
