The undersigned Substitute Trustee, by virtue of the authority vested in him by that certain Deed of Trust, dated November 15, 2010, and duly recorded in the Office of the Clerk of the County Commission of Raleigh County, West Virginia, in Document No. 50414597, in Book No. 5041, at Page 4597, Jessica N Shea and Joseph Shea did convey unto Richard A. Pill, Esq., Trustee(s), certain real property described in said Deed of Trust; and the beneficiary has elected to appoint Seneca Trustees, Inc., as Substitute Trustee by a Substitution of Trustee dated February 13, 2020 and recorded in the aforesaid Clerk’s office; and default having been made under the aforementioned Deed of Trust, and the undersigned Substitute Trustee having been instructed by Wells Fargo Bank, NA to foreclose thereunder, will offer for sale at public auction at the front door of the Raleigh County Courthouse in Beckley, West Virginia, on

The surface of that certain real estate located in TOWN DISTRICT, RALEIGH COUNTY, WEST VIRGINIA, and more particularly described as follows:
TRACT 1:
BEING PART LOTS 91 & 92, SECTION 1, CRAB ORCHARD WOODS SUBDIVISION, located in Town District, Raleigh County, West Virginia, more particularly shown on a map dated November 10, 1998, which is to be put on record in the Raleigh County, Clerk’s Office, more particularly described as follows:
BEGINNING at a point on the lot line of Crab Orchard Woods, Inc. (DB 592/507) being located N. 64 07′ E 15.15′ from the northwestern comer of Lot 91(common with Lot 90); thence with the lot line of Lot 91 in part and Lot 92 in part and Crab Orchard Woods, Inc., N 64 07′ E. 91.39′ to a point in the lot line of Lot 92, being located S. 64 07′ W 91.39′ from the northeastern comer of Lot 93; thence with a new line through lot 92, S 20 03′ E. 226.89′ to a point located on Tilson Drive; thence with Tilson Drive and Lot 92 in part and Lot 91 in part, S 67 42′ W. 56.23; to a point; thence with a curve bearing a radius of 732.11′, an arc of 43.54′, chord bearing S. 69 20′ W, 43.53′ to a point located N 67 42′ E 15.00′ from the southwestern comer of Lot 91 (common with Lot 90); thence with a new line through Lot 91, S 17 46′ E 220.45′ to the point of BEGINNING, containing 0.490 acre, more or less, as surveyed by Engineering Services, Inc., in November 1998.

The surface of those certain lots or parcels of land situate in Town District, Raleigh County, West Virginia, and being Lot No. 93 and part of Lot No. 92, Section 1, of Orchard Wood Subdivision, near the Town of Crab Orchard, as shown on a map dated November 190, 1997, which map is recorded with a deed in the office of the Clerk of the County Commission of Raleigh County, West Virginia, in Roll 149, at page 2748, and more particularly described as follows:
BEGINNING at a point on the line of Crab Orchard Woods, Inc. (DB 592/507), which point is also the common comer of Lots 95 and 93, as shown on the aforesaid map; thence with the line of Lots 93 and 92, S. 64deg. 07′ W. 91.39 feet to a point in Lot 92; thence through Lot 92 and with the line of Michael D. & Rachel L. Gill, the parties of the second part herein, S. 20deg. 03′ E. 226.89 feet to a point on Tilson Drive; thence with the line of Tilson Drive, N 67deg. 42′ E. 99.76 feet to the common comer of Lots 93 and 95 on Tilson Drive; thence leaving Tilson Drive and with the common line between Lots 93 and 95 N. 22deg. 13′ W. 232.31 feet to the point and place of beginning.
And being the same property acquired by Jessica N. Shea and Joseph E. Shea, by deed dated November 15, 2010, from Michael D. Gill and Rachel L. Gill, husband and wife, to be recorded in the Office of the Clerk of the County Commission of Raleigh County, West Virginia, prior to or simultaneously herewith.
At the time of the execution of the Deed of Trust, this property was reported to have an address of: 153 Magnolia Street, Beckley, WV 25801.
The referenced real estate will be conveyed with no covenants of warranty, and subject to all covenants, restrictions, easements, rights of way and reservations which may be a matter of record in the aforesaid Clerk’s Office or visible upon the ground, all prior liens and encumbrances, including, without limitation, liens for real estate taxes, incinerator, sanitary and sewer charges. The purchasers at the sale shall be responsible for paying the recording costs and also the tax on the privilege of transferring real property (the cost of the tax stamp to be affixed to the deed). The purchasers shall be responsible for payment of all real estate taxes.
The subject property will be sold in “AS IS” condition. The Substitute Trustee shall be under no duty to cause any existing tenant or person occupying the subject property to vacate said property.
TERMS: $9000.00 in cash and/or certified funds as deposit at the time of sale with the balance due and payable within 30 days of the day of sale.
FEDERAL TAX LIEN: In the event that there are Federal Tax Liens against the property, the United States would have the right to redeem the property within a period of 120 days from the date of such sale or the period allowable for redemption under local law, whichever is longer.
Pursuant to the Deed of Trust, the Trustee may postpone the sale by public announcement at the time and place designated or by posting a notice of the same, and act by agent in the execution of the sale. The parties secured by the Deed of Trust reserve the right to purchase the property at such sale.
