The undersigned Substitute Trustee, by virtue of the authority vested in him by that certain Deed of Trust, dated March 9, 2022, and duly recorded in the Office of the Clerk of the County Commission of Hampshire County, West Virginia, in Document No. 216622, in Book No. 685, at Page 459, and modified by Corrective Affidavit recorded on August 9, 2024 in Book No. 605, at Page 141, Tanner Lewis did convey unto W Joseph Milleson Jr., Trustee(s), certain real property described in said Deed of Trust; and the beneficiary has elected to appoint Seneca Trustees, Inc., as Substitute Trustee; and default having been made under the aforementioned Deed of Trust, and the undersigned Substitute Trustee having been instructed by PennyMac Loan Services, LLC to foreclose thereunder, will offer for sale at public auction at the front door of the Hampshire County Courthouse in Romney, West Virginia, on

The following described real estate, together with its improvements, easements and appurtenances thereunto belonging, situate in 05 – Gore District, Hampshire County, West Virginia, and more particularly described as follows:
All that certain tract or parcel of real estate situate in Gore District, Hampshire County, West Virginia, together with the improvements thereon, lying along the east side of County Route 45/9, about one-half mile north of its intersection with Routes 50/14 and 50/10, which said parcel contains 2.952 acres, more or less, as shown on that certain metes and bounds description and Plat of Survey prepared by Frank A. Whitacre, LLS, dated July 16, 1980, and of record in the Office of the Clerk of the County Commission of Hampshire County, West Virginia, in Deed Book 347 at Pages 241 and 242, respectively. Said metes and bounds description and Plat of Survey are by reference made a part hereof for all pertinent and proper reasons. Said real estate is shown on the Hampshire County Land Books as Tax Map 19, Parcel 23.5 for said district.
And being the same real estate conveyed to Tanner S. Lewis by deed of David Shandon Watts, dated February 14, 2022, and to be recorded prior to or contemporaneously with the recordation of this instrument in the Office of the Clerk of the County Commission of Hampshire County, West Virginia.
Said property is conveyed subject to the previous reservation of previous grantors of record, Norman B. Landis and Anna I. Landis, et al., their heirs, successors and assigns, of a full legal right of way over the existing road crossing the tract herein conveyed, as shown on the plat of survey of record in the office of the Clerk of the County Commission of Hampshire County, West Virginia, in Deed Book 347 at Page 242, wherein same is labeled “Existing Road” leading in a easterly to northeasterly direction across the Fout tract to the remaining lands of the previous grantors of record, Norman B. Landis and Anna I. Landis, et al., same to be used by all person having a legal and lawful right to use same and is a non-exclusive right of way, which grantees herein shall take their tract subject thereto.
Said real estate is subject to any and all easements or rights of way which may appear on the plat of said real estate of record in said Clerk’s Office in Deed Book 347 at Pages 241-242.
Said property is conveyed subject to all existing reservations, restrictions and easements created in prior deeds in the chain of title to the property hereby conveyed.
To have and to hold the aforesaid real estate unto the said grantee, together with all rights, ways, buildings, houses, improvements, easements, timbers, waters, minerals and mineral rights, and all other appurtenances thereunto belonging, in fee simple forever.
At the time of the execution of the Deed of Trust, this property was reported to have an address of: 6009 Old Martinsburg Grade Road, Augusta, WV 26704.
The referenced real estate will be conveyed with no covenants of warranty, and subject to all covenants, restrictions, easements, rights of way and reservations which may be a matter of record in the aforesaid Clerk’s Office or visible upon the ground, all prior liens and encumbrances, including, without limitation, liens for real estate taxes, incinerator, sanitary and sewer charges. The purchasers at the sale shall be responsible for paying the recording costs and also the tax on the privilege of transferring real property (the cost of the tax stamp to be affixed to the deed). The purchasers shall be responsible for payment of all real estate taxes.
The subject property will be sold in “AS IS” condition. The Substitute Trustee shall be under no duty to cause any existing tenant or person occupying the subject property to vacate said property.
TERMS: $9000.00 in cash and/or certified funds as deposit at the time of sale with the balance due and payable within 30 days of the day of sale.
FEDERAL TAX LIEN: In the event that there are Federal Tax Liens against the property, the United States would have the right to redeem the property within a period of 120 days from the date of such sale or the period allowable for redemption under local law, whichever is longer.
Pursuant to the Deed of Trust, the Trustee may postpone the sale by public announcement at the time and place designated or by posting a notice of the same, and act by agent in the execution of the sale. The parties secured by the Deed of Trust reserve the right to purchase the property at such sale.
