The undersigned Substitute Trustee, by virtue of the authority vested in him by that certain Deed of Trust, dated September 30, 2019, and duly recorded in the Office of the Clerk of the County Commission of Hampshire County, West Virginia, in Document No. 196888, in Book No. 639, at Page 497, Jeremy Q Coots did convey unto Andrew C Skinner, Trustee(s), certain real property described in said Deed of Trust; and the beneficiary has elected to appoint Seneca Trustees, Inc., as Substitute Trustee; and default having been made under the aforementioned Deed of Trust, and the undersigned Substitute Trustee having been instructed by PrimeLending, A PlainsCapital Company to foreclose thereunder, will offer for sale at public auction at the front door of the Hampshire County Courthouse in Romney, West Virginia, on

the following described real estate, together with its improvements, easements and appurtenances thereunto belonging, situate in 01 – Bloomery District, Hampshire County, West Virginia, and more particularly described as follows:
All those two certain tracts or parcels of real estate, together with all rights, privileges, improvements, rights of way or appurtenances thereunto belonging or in anywise appertaining, situate in Bloomery District, Hampshire County, West Virginia, and more particularly described as follows:
LOT NUMBERS TWENTY-THREE (23) and TWENTY-FOUR (24) containing 2.134 acres, more or less, and 2.048 acres, more or less, of the Stage Coach Stop at Capon Bridge Subdivision, a plat of said Subdivision being of record in the Office of the Clerk of the County Commission of Hampshire County, West Virginia, in Deed Book No. 280, at page 101, to which plat reference is made
for a more particular description of the real estate herein conveyed, together with the use of all streets in said Subdivision for access.
Said real estate is depicted on the Hampshire County Land Books as being Tax Map 24A, Parcel 161.
And being the same real estate which was conveyed unto Jeremy Q. Coots by deed of Richard A. Gobbett and Roxanne L. Gobbett, his wife, dated September 24, 2019, to be recorded immediately prior to the recordation of this instrument in the Office of the Clerk of the County Commission of Hampshire County, West Virginia.
Pursuant to Chapter 38, Article 1, Section 4, of the West Virginia Code, any Notice of Trustee’s Sale shall be mailed to the grantor(s) hereunder at the following address or such other address subsequently given to the beneficiary, in writing, by the grantor(s): 63 South Pioneer Lane, Augusta, WV.
This conveyance is made subject to the covenants and restrictions of the Stage Coach stop at Capon Bridge Subdivision, said covenants of record in the aforesaid Clerk’s Office in Deed Book No. 280, at page 92, and any and all other amendments thereto, and the same is incorporated herein by reference.
For consideration aforesaid, the grantors do hereby grant unto the grantee, his heirs, successors, and assigns, all of their right, title and interest in and to the use of all easements and rights of way in said Subdivision, it being understood between the parties that said right shall be non-exclusive and shall be in common with all other lot owners within the Stage Coach Stop at Capon Bridge Subdivision and the Buffalo Ridge Ranchettes Subdivision, including, but not limited to, all easements and rights of way as were conveyed to prior grantors by deed from J.C. Neff and Linda C. Neff, of record in said Clerk’s Office in Deed Book No. 276, at page 83.
The property is subject to an oil and gas lease executed by Bill V. Neff, et ux, unto Weaver Oil and Gas Corporation and subsequently assigned to both Exxon Corporation and Consolidated Gas Supply Corporation, in Deed Book No. 265, at page 700. However, the grantors hereby assign to the grantee all of their interest in and to said oil and gas lease, but only insofar as said oil and
gas lease affects the real estate herein conveyed.
At the time of the execution of the Deed of Trust, this property was reported to have an address of: 63 S Pioneer Ln, Augusta, WV 26704.
The referenced real estate will be conveyed with no covenants of warranty, and subject to all covenants, restrictions, easements, rights of way and reservations which may be a matter of record in the aforesaid Clerk’s Office or visible upon the ground, all prior liens and encumbrances, including, without limitation, liens for real estate taxes, incinerator, sanitary and sewer charges. The purchasers at the sale shall be responsible for paying the recording costs and also the tax on the privilege of transferring real property (the cost of the tax stamp to be affixed to the deed). The purchasers shall be responsible for payment of all real estate taxes.
The subject property will be sold in “AS IS” condition. The Substitute Trustee shall be under no duty to cause any existing tenant or person occupying the subject property to vacate said property.
TERMS: $9000.00 in cash and/or certified funds as deposit at the time of sale with the balance due and payable within 30 days of the day of sale.
FEDERAL TAX LIEN: In the event that there are Federal Tax Liens against the property, the United States would have the right to redeem the property within a period of 120 days from the date of such sale or the period allowable for redemption under local law, whichever is longer.
Pursuant to the Deed of Trust, the Trustee may postpone the sale by public announcement at the time and place designated or by posting a notice of the same, and act by agent in the execution of the sale. The parties secured by the Deed of Trust reserve the right to purchase the property at such sale.
