The undersigned Substitute Trustee, by virtue of the authority vested in him by that certain Deed of Trust, dated April 18, 2008, and duly recorded in the Office of the Clerk of the County Commission of Hampshire County, West Virginia, in Document No. 106312, in Book No. 475, at Page 428 and modified by Home Affordable Modification Agreement in Document No. 184316, in Book No. 618, at Page 310, and modified by Corrective Affidavit in Document No. 228503, in Book 597, at Page 570, Gary David Clatterbuck and Angela J Clatterbuck did convey unto Richard A. Pill, Esq., Trustee(s), certain real property described in said Deed of Trust; and the beneficiary has elected to appoint Seneca Trustees, Inc., as Substitute Trustee; and default having been made under the aforementioned Deed of Trust, and the undersigned Substitute Trustee having been instructed by Wells Fargo Bank, N.A. to foreclose thereunder, will offer for sale at public auction at the front door of the Hampshire County Courthouse in Romney, West Virginia, on

the following described real estate, together with its improvements, easements and appurtenances thereunto belonging, situate in 03 – Capon Bridge District, Hampshire County, West Virginia, and more particularly described as follows:

All that certain tract or parcel of real estate, together with the improvements thereon, situate in Bloomery District, Hampshire County, West Virginia, known and designated as Parcel B, containing 0.894 acres, more or less, situate in Bloomery District, Hampshire County, West Virginia, on the Northwest bounds of U. S. Route 50 near the Northwest Corporate Limits of the Town of Capon Bridge, West Virginia, and which said parcel is more particularly bounded and described according to that certain Description of Survey and Plat of Survey as prepared by Rickie C. Davy, Licensed Land Surveyor, on May 12, 2004, copies of which said Description of Survey and Plat of Survey are of record in the Office of the Clerk of the County Commission of Hampshire County, West Virginia, in Deed Book No. 433, at page 379, and made a part hereof for all pertinent and proper reasons, including a more particular metes and bounds description of said 0.894 acres. Said real estate is depicted on the 2007 Hampshire County Land Books as being Tax Map 3, Parcel 29.

And being the same real estate that was conveyed unto Gary David Clatterbuck and Angela J. Clatterbuck, his wife, by deed of Thomas J. Alkire and Nancy A. Alkire, his wife, dated April 16, 2008, to be recorded immediately prior to the recordation of this instrument in the Office of the Clerk of the County Commission of Hampshire County, West Virginia.

The aforesaid real estate has been annexed into the Town of Capon Bridge by Order dated February 10, 2005, and of record in the aforesaid Clerk’s Office in Deed Book 440 at Page 629.

The real estate conveyed herein is subject to an existing 16 foot wide easement for a water line for the Town of Capon Bridge Water Distribution System which of record in the aforesaid Clerk’s Office in Deed Book No. 195, at Page 652.

In prior deeds there was conveyed with said 0.894 acre parcel and easement over the adjoining 2.018 acre parcel for a septic drain field. However, a Release of Easement dated April 15, 2008, has been executed forever releasing, quitting, terminating, and relinquishing all the herein grantors right, title and interest in and to the reservation of easement and is of record in the aforesaid Clerk’s Office in Deed Book 473 at Page 538.

Reference is made to the above described plat for a more particular description of the right of way and easements which said parcel is taken subject to, and which are conveyed with said parcel.

The grantors herein reserve a right of way for purpose of constructing, laying, operating and maintaining a water line across the real estate conveyed herein, which said easement shall be 12 feet in width, and shall be parallel to the existing 16 foot wide water line easement as set forth above.

There is reserved unto the grantors herein, Thomas W. Alkire and Nancy A. Alkire, and also Wendell Meade and Nancy Meade, and Meade’s Special Services a person right of way, 12 feet in width, over the existing driveway which is currently on the real estate conveyed herein, for purposes of ingress, egress, utilities, and all other legal purposes, to and from the public road and adjoining real estate owned by the grantors herein. This is a personal right of way reserved unto the grantors herein, Thomas W. Alkire and Nancy A. Alkire, and also Wendell Meade and Nancy Meade, and Meade’s Special Services, and shall not be used by their heirs or assigns.

At the time of the execution of the Deed of Trust, this property was reported to have an address of:  RT 50 West B Box 591, Capon Bridge, WV 26711.

The referenced real estate will be conveyed with no covenants of warranty, and subject to all covenants, restrictions, easements, rights of way and reservations which may be a matter of record in the aforesaid Clerk’s Office or visible upon the ground, all prior liens and encumbrances, including, without limitation, liens for real estate taxes, incinerator, sanitary and sewer charges. The purchasers at the sale shall be responsible for paying the recording costs and also the tax on the privilege of transferring real property (the cost of the tax stamp to be affixed to the deed). The purchasers shall be responsible for payment of all real estate taxes.

The subject property will be sold in “AS IS” condition. The Substitute Trustee shall be under no duty to cause any existing tenant or person occupying the subject property to vacate said property.

TERMS: $8000.00 in cash and/or certified funds as deposit at the time of sale with the balance due and payable within 30 days of the day of sale.

FEDERAL TAX LIEN: In the event that there are Federal Tax Liens against the property, the United States would have the right to redeem the property within a period of 120 days from the date of such sale or the period allowable for redemption under local law, whichever is longer.

Pursuant to the Deed of Trust, the Trustee may postpone the sale by public announcement at the time and place designated or by posting a notice of the same, and act by agent in the execution of the sale. The parties secured by the Deed of Trust reserve the right to purchase the property at such sale.
