All of that certain real property, with improvements and appurtenances thereunto belonging, situate, and being, in Middleway District, Jefferson County, West Virginia, and more particularly described as follows:
Transfer Parcel Lot 3C, containing 43,548 square feet, or 1.00 acres more or less, as more particularly shown and described on that plat entitled “Richard M. Boswell III Family Transfer Subdivision”, dated October 8, 2020, prepared by Peter H. Lorenzen, and recorded in the Office of the Clerk of the County Commission of Jefferson County, West Virginia, in Plat Book 26, at Page 226.
TOGETHER WITH that certain 50′ non-exclusive easement or right of way known as “Pleasant Acres Court” for ingress to and egress from the aforementioned lot described on said plat and as described on that Plat of record in the aforementioned Clerk’s Office in Plat Book 25, at Page 743.
TOGETHER WITH AND SUBJECT TO any and all recorded easements and rights-of-way appurtenant thereto for ingress, egress, and utilities, including but not limited to, those set forth on the aforementioned plat.
The parties of the first further reserve unto themselves, their heirs, successors and assigns, a right-of-way (the “Right-of-Way”) for ingress, egress, and utilities across the aforementioned Lot 3C for the benefit of Lot 3B (Residue) (as said Lot 3B (Residue) being more particularly shown and described on that plat entitled “Richard M. Boswell III Family Transfer Subdivision”, dated October 8, 2020, prepared by Peter H. Lorenzen, and recorded in the Office of the Clerk of the County Commission of Jefferson County, West Virginia, in Plat Book 26, at Page 226). The width of the aforementioned Right-of-Way shall be fifty feet. Furthermore, the boundary lines of the reserved Right-of-Way herein shall connect to the existing 50′ Access Easement known as “Pleasant Acres Court” and run in straight and direct lines to the boundary of the aforementioned Lot 3B (Residue). It is understood that the Right-of-Way shall be for the benefit of Lot 3B (Residue) as well as any additional lots subdivided from the aforementioned Lot 3B (Residue).

At the time of the execution of the Deed of Trust, this property was reported to have an address of: 149 Pleasant Acres Court, Kearneysville, WV 25430.
The referenced real estate will be conveyed with no covenants of warranty, and subject to all covenants, restrictions, easements, rights of way and reservations which may be a matter of record in the aforesaid Clerk’s Office or visible upon the ground, all prior liens and encumbrances, including, without limitation, liens for real estate taxes, incinerator, sanitary and sewer charges. The purchasers at the sale shall be responsible for paying the recording costs and also the tax on the privilege of transferring real property (the cost of the tax stamp to be affixed to the deed). The purchasers shall be responsible for payment of all real estate taxes.
The subject property will be sold in “AS IS” condition. The Substitute Trustee shall be under no duty to cause any existing tenant or person occupying the subject property to vacate said property.
TERMS: $9000.00 in cash and/or certified funds as deposit at the time of sale with the balance due and payable within 30 days of the day of sale.
FEDERAL TAX LIEN: In the event that there are Federal Tax Liens against the property, the United States would have the right to redeem the property within a period of 120 days from the date of such sale or the period allowable for redemption under local law, whichever is longer.
Pursuant to the Deed of Trust, the Trustee may postpone the sale by public announcement at the time and place designated or by posting a notice of the same, and act by agent in the execution of the sale. The parties secured by the Deed of Trust reserve the right to purchase the property at such sale.
