The undersigned Substitute Trustee, by virtue of the authority vesting in it by that certain Deed of Trust recorded on February 28, 2023, in the Office of the Clerk of the County Commission of Hampshire County, West Virginia, in Book 698 at Page 790, Elvin D. Wratchford Jr. and Mary J. Wratchford did convey unto Richard A. Pill, as Original Trustee, certain real property described in said Deed of Trust; and the beneficiary has elected to appoint Elk River Trustees Inc., as Substitute Trustee by virtue of a Substitution of Trustee recorded on November 13, 2025, in Book 734 at Page 443 in the aforesaid Clerk’s Office;  the undersigned Substitute Trustee has been requested, in writing, by the beneficiary of said Deed of Trust to sell the real estate described below, as there has been a default under the terms and conditions of said Deed of Trust. Therefore, the undersigned Substitute Trustee having been instructed by NewRez, LLC d/b/a Shellpoint Mortgage Servicing to foreclose thereunder will offer for sale, at a public auction at the front door of the Hampshire County Courthouse in Romney, West Virginia, on

the following described real estate, together with its easements, improvements, and appurtenances thereunto belonging, situate in Mill Creek District, Hampshire County, West Virginia, and more particularly bounded and described as follows:

LEGAL DESCRIPTION

All of those certain tracts or parcels of real estate, together with any and all Improvements; rights of ways and ·appurtenances thereunto belonging. lying and situate in Mill Creek District, Hampshire County, West Virginia, being more particularly bounded and described as follows:

“Tract 1-B-2: ‘Beginning from pipe as a corner to Alonzo Riggleman; thence S 66-08 31” W 676.38 feet to, a point in a 40 foot right of way N 66-35-20” W 112.10 feet to another point in a 49 foot right of way corner to Cleal Rinker and Williams and Rinker Excavation, lnc.; thence with the latter line N 26-14 20” E 189.79 feet to an iron pin (rebar); thence N 84-02 55” E 645.00 feet to the beginning, containing 1.772 acres.’

Tract C: ‘Beginning at a pipe, at a corner of Alonzo Riggleman, Tract 1, Division of Paul Williams’ Land; thence S 84-02 55” W 645.00 feet to an Iron pin (rebar); thence N 23-58 12” W 24.30 feet to an Iron pin (rebar); thence 78-33 10” E 160.21 feet to an iron pin (rebar); thence N 88-30 30’.’ E 494.54 feet to the beginning, containing 0.328 acres, more or less:’

Tract D: Beginning at a pipe by a post corner to Alonzo F. Riggleman, Tract 1-A, Division of Paul Williams’ Land and the right of way to State Route 220; thence N 77-59 29” E 219.0 feet to an Iron pin (rebar); thence S 23-58 12” E 24.30 feet to an iron pin (rebar); thence S 84-2 55” W 225.30 feet to the beginning. containing 0.060 acres, more or less.

These being the same tracts or parcels of real estate conveyed Elvin D. Wratchford, Jr. and Mary J. Wratchford by deed dated February 14, 2023 from Stephen L. Seaman and Robert T. Seaman and which said deed. will be recorded immediately prior to the recordation of this deed of trust.

The real estate is assessed on the 2022 Hampshire County Land Records in Mill Creek District on Tax Map 3, Parcel 50.21 and Parcel 44.1.

Reference is hereby made to all instruments in the chain of title for any and all pertinent purposes.

The property was reported to have an address of: 51 Hickory Hill Road, Old Fields, West Virginia 26845

The above referenced real estate will be conveyed with no covenants of warranty and subject to any and all easements, rights of way, conditions, covenants, restrictions, exceptions, reservations, leases and other servitudes, which may be a matter of record in the aforesaid Clerk’s Office or visible upon the ground. The sale of the referenced real estate will also be subject to all prior liens and including any and all other deeds of trust, judgments, liens, and all other encumbrances of any nature whatsoever, if any, having priority over the subject Deed of Trust.

The subject property will be sold in an “AS IS” condition. The Substitute Trustee makes no representations and warranties of any kind or character including, but not limited to, the condition of the real estate or the title to the real estate to be conveyed. The Substitute Trustee shall be under no duty to cause any existing tenant or person occupying the subject property to vacate said property.

In the event that there are federal tax liens against the property, the United States has the right to redeem the property within a period of one hundred twenty (120) days from the date of the sale. The Substitute Trustee reserves the right to adjourn the sale for a time, or from time to time, without further notice, by announcement at the time and place of the foreclosure sale described herein.

TERMS OF SALE

1. $8,000.00 (Eight Thousand Dollars) in cash and/or certified funds made payable to “Elk River Trustees, Inc.” due as a deposit at the time of sale, with the balance due and payable within thirty (30) days of sale. Personal checks will not be accepted.

2. The purchaser at the sale shall be responsible for payment of all real estate taxes.

3. The purchaser shall be responsible for payment of the recording cost of the deed and also for payment of the tax on the privilege of transferring the real property (transfer tax) imposed by West Virginia Code § 11-22-2.

4. The parties secured by the Deed of Trust reserve the right to purchase the property at the foreclosure sale.
