TRUSTEE’S SALE OF VALUABLE REAL ESTATE

The undersigned Substitute Trustee, by virtue of the authority vested in it by that certain Deed of Trust dated September 12, 2018, and duly recorded in the Office of the Clerk of the County Commission of Hardy County, West Virginia, in Deed of Trust Book 308, at Page 707, Timothy C. Sions and Sarah E. Sions did convey unto James Heishman, Trustee, certain real property described in said Deed of Trust; and the beneficiary has elected to appoint Pill & Pill, PLLC as Substitute Trustee by a Substitution of Trustee recorded in the aforesaid Clerk’s Office; and default having been made under the aforementioned Deed of Trust, and the undersigned Substitute Trustee having been instructed by the secured party to foreclose thereunder, will offer for sale at public auction at the front door of the Hardy County Courthouse, in Moorefield, West Virginia, on

July 16, 2026, at 10:30 AM

The following described real estate, with its improvements, easements and appurtenances thereunto belonging, situate in the Moorefield District, Hardy County, West Virginia, and more particularly described as follows:

All that certain tract or parcel of real estate, containing 2.460 acres, more or less, together with any and all rights, rights of way, structures, minerals, easements, improvements and appurtenances thereunto belonging, located on the east side of the South Branch River and west of the B & O Railroad right-of-way, lying and being situate in the Moorefield District, Hardy County, West Virginia, and being designated as “Parcel 14B of Section A” of the “South Potomac Trough Farm No. 2” and being more particularly described by that certain Plat of Survey and Description of survey of record in the Office of the Clerk of the County Commission of Hardy County, West Virginia in Deed Book 303, at Pages 87 and 88, respectively. Reference is hereby made to the said aforementioned Plat of Survey, to “Lot 14B” set forth thereupon and to the aforementioned Description of Survey for a more specific description of the tract or parcel of real estate being conveyed in trust hereby.

 

Along with the aforementioned real estate, all lot owners of the “South Potomac Trough Farm No. 2” do also own a fractional undivided interest in and to a certain tract or parcel of real estate containing 3.38 acres, more or less, and being designated as “Land in Common” on that certain Plat of Survey of said subdivision and of record in the aforesaid Clerk’s Office in Deed Book 274, at Page 729. Reference is hereby made to the said aforementioned Plats of Survey and Description of Survey for a more specific description of the real estate being conveyed in trust hereby.

 

At the time of the execution of the Deed of Trust, this property was reported to have a mailing address of 245 Killdeer Lane, Moorefield, WV 26836.

 

AND BEING the same real estate which was conveyed to Timothy C. Sions and Sarah E. Sions, by Deed dated September 12, 2018, from Loraine M. Dailey, and recorded in the Office of the Clerk of the County Commission of Hardy County, West Virginia, in Deed Book 347 at Page 453.

The above-described property will be sold subject to any covenants, restrictions, easements, leases and conditions of record, and subject to any unpaid real estate taxes.

The subject property will be sold in “AS IS” condition. The Substitute Trustee shall be under no duty to cause any existing tenant or person occupying the subject property to vacate said property.
