The undersigned Substitute Trustee, by virtue of the authority vested in it by that certain Deed of Trust dated April 22, 2011, and duly recorded in the Office of the Clerk of the County Commission of Mc Dowell County, West Virginia, in Deed of Trust Book 424, at Page 156, Swanson Kennedy and Darlene I. Lane did convey unto Mike Day and Ronald D. Hassan, Trustee, certain real property described in said Deed of Trust; and the beneficiary has elected to appoint Pill & Pill, PLLC as Substitute Trustee by a Substitution of Trustee recorded in the aforesaid Clerk's Office; and default having been made under the aforementioned Deed of Trust, and the undersigned Substitute Trustee having been instructed by the secured party to foreclose thereunder, will offer for sale at public auction at the front door of the Mc Dowell County Courthouse, in Welch, West Virginia, on

The following described real estate, with its improvements, easements and appurtenances thereunto belonging, situate in the Big Creek District, Mc Dowell County, West Virginia, and more particularly described as follows:

All those certain lots or parcels of real estate situate, lying and being on Atwell Branch in The Big Creek District of McDowell County, more particularly described as follows, to-wit:

PARCEL ONE: Beginning at the Southernmost corner being a steel pin on the East edge of Atwell Branch, common to the 0.47 acre tract conveyed to John H. Short, and reference; N 32 degrees 22' E 75.66 feet from a steel pin; thence along a line common to said 0.47 acre tract N 57 degrees 54' E 147.21 feet to a steel pin; thence, continuing along a line common to said 0.47 acre tract S 71 degrees 43' E 54.82 feet to a steel pin; thence leaving said 0.47 acre tract N 14 degrees 36' E 58.38 feet to a railroad spike in the root of a 24" beech; thence, crossing Atwell Branch S 87 degrees 16' W 144.37 feet to a railroad spike; thence, along the East line of a road up Atwell Branch S 33 degrees 49' W 95.01 feet to a steel pin; thence, S 1 degree 24' E 30.18 feet to the Beginning, Containing .22 acres, more or less.

PARCEL TWO: Beginning at a steel pin near the South edge of Atwell Branch and referenced; S 10 degrees 15' E 73.74 feet from a steel pin; thence along Atwell Branch N 57 degrees 54' E 147.21 feet to a steel pin; thence leaving said branch S 71 degrees 43' E 54.82 feet to a steel pin; thence S 23 degrees 57' W 174.14 feet to a steel pin; thence N 76 degrees 53' W 150.46 feet to a steel on the West edge of Atwell Branch; thence along said branch N 32 degrees 22' E. 75.66 feet to the Beginning, Containing 0.47 acres, more or less.

And being the same real estate conveyed unto Swanson Kennedy and Darlene Ina Lane, by Stanley Dobbs and Elizabeth Dobbs, his wife, by deed dated April 18, 2011, to be forthwith recorded in the Office of the Clerk of the County Commission of McDowell County, West Virginia and the same real estate convey

At the time of the execution of the Deed of Trust, this property was reported to have a mailing address of 10 Deskins Ridge Road, Raysal, WV 24879.

AND BEING the same real estate which was conveyed to Swanson Kennedy and Darlene I. Lane, by Deed dated April 22, 2011, from Stanley Dobbs and Elizabeth Dobbs, and recorded in the Office of the Clerk of the County Commission of McDowell County, West Virginia, in Deed Book 424 at Page 156, the same real estate was later conveyed to Charles Eugene Lane and Marlena Lane by Quitclaim Deed dated August 27, 2024, from Swanson Kennedy and Charles Eugene Lane, in Deed Book 663, at Page 190 and recorded in the Office of the Clerk of the County Commission of McDowell County, West Virginia.
The above-described property will be sold subject to any covenants, restrictions, easements, leases and conditions of record, and subject to any unpaid real estate taxes.
The subject property will be sold in "AS IS" condition. The Substitute Trustee shall be under no duty to cause any existing tenant or person occupying the subject property to vacate said property.
TERMS: Ten percent (10%) of the purchase price as a deposit with the balance due and payable within 30 days of the day of sale.
