The undersigned Substitute Trustee, by virtue of the authority vested in it by that certain Deed of Trust dated August 29, 2025, and duly recorded in the Office of the Clerk of the County Commission of Raleigh County, West Virginia, in Deed of Trust Book 5086, at Page 3003, Tyron Forney did convey unto Angela C. Ramsey, Trustee, certain real property described in said Deed of Trust; and the beneficiary has elected to appoint Pill & Pill, PLLC as Substitute Trustee recorded in the aforesaid Clerk's Office; and default having been made under the aforementioned Deed of Trust, and the undersigned Substitute Trustee having been instructed by the secured party to foreclose thereunder, will offer for sale at public auction at the front door of the Raleigh County Courthouse, in Beckley, West Virginia, on
May 21, 2026, at 1:00 PM
The following described real estate, with its improvements, easements and appurtenances thereunto belonging, situate in the Marsh Fork District, Raleigh County, West Virginia, and more particularly described as follows:
The surface of that certain tract or parcel of land, situate on the waters of Rock Creek, Marsh Fork District, Raleigh County, West Virginia, bounded and described as follows: Beginning at a rock corner in the field; thence N. 12° 15' W 250 feet to a stake at the center of the Rock Creek Road; thence down and with the center line of the Rock Creek Road 225 feet to a stake, a common corner of the tract or parcel of land herein conveyed and a tract owned by Floyd Farley; thence with the common line between the tract of land herein conveyed and the tract of land owned by Floyd Farley, S 12° 15' E 350 feet to a stake; thence in the straight line to the point of beginning, containing about 1.5 acres, more or less.
At the time of the execution of the Deed of Trust, this property was reported to have a mailing address of 884 Upper Creek Road, Rock Creek, WV 25174.
AND BEING the same real estate which was conveyed to Tyron Forney, by Deed dated August 29, 2025, from Jennie M. Cantley and Owen L. Cantley,, and recorded in the Office of the Clerk of the County Commission of Raleigh County, West Virginia, in Deed Book 5086, at Page 3002.
The above-described property will be sold subject to any covenants, restrictions, easements, leases and conditions of record, and subject to any unpaid real estate taxes.
The subject property will be sold in "AS IS" condition. The Substitute Trustee shall be under no duty to cause any existing tenant or person occupying the subject property to vacate said property.
TERMS: Ten percent (10%) of the purchase price as a deposit with the balance due and payable within 30 days of the day of sale.
