The undersigned Substitute Trustee, by virtue of the authority vested in it by that certain Deed of Trust dated October 4, 2024, and duly recorded in the Office of the Clerk of the County Commission of McDowell County, West Virginia, in Deed of Trust Book 459, at Page 447, Derek Tanner did convey unto Douglas McElwee, Trustee, certain real property described in said Deed of Trust; and the beneficiary has elected to appoint Pill & Pill, PLLC as Substitute Trustee by a Substitution of Trustee recorded in the aforesaid Clerk's Office; and default having been made under the aforementioned Deed of Trust, and the undersigned Substitute Trustee having been instructed by the secured party to foreclose thereunder, will offer for sale at public auction at the front door of the McDowell County Courthouse, in Welch, West Virginia, on
July 23, 2026, at 10:00 AM
The following described real estate, with its improvements, easements and appurtenances thereunto belonging, situate in the Welch Corp. District, McDowell County, West Virginia, and more particularly described as follows:
Parcel No. 1:
All the following described piece and parcel of real estate in the Florence Addition ot the City of Welch, McDowell County, West Virginia, to-wit:
Lot No. Fifteen (15), Block "A", as shown on a map or plat thereof, of record in the Office of the Clerk of the County Court of said County, in Map Book 5, at Page 45.
Parcel No. 2:
The following described parcel of real estate in the Florence Addition to the City of Welch, McDowell County, West Virginia, to wit:
Lot No. 16, Block A, as shown on Map or Plat entitled: "Report of Block 6, 7 and 11, of Florence, seed Deed Book No. 34, Page 450", which said map or plat is of record in the Office of the Clerk of the County Court of McDowell County, West Virginia, in Map Book No. 5, Page 45.
At the time of the execution of the Deed of Trust, this property was reported to have a mailing address of 126 Warden Street, Welch, WV 24801.
AND BEING the same real estate which was conveyed to Derek Tanner, by Deed dated October 4, 2024, from Virginia L. Green Castle, and recorded in the Office of the Clerk of the County Commission of McDowell County, West Virginia, in Deed Book 663 at Page 352.
The above described property will be sold subject to any covenants, restrictions, easements, leases and conditions of record, and subject to any unpaid real estate taxes.
The subject property will be sold in "AS IS" condition. The Trustee shall be under no duty to cause any existing tenant or person occupying the subject property to vacate said property.
TERMS: Ten percent (10%) of the purchase price as a cash deposit with the balance due and payable within 30 days of the day of sale.
