The undersigned Substitute Trustee, by virtue of the authority vested in him by that certain Deed of Trust, dated October 10, 2012, and duly recorded in the Office of the Clerk of the County Commission of Greenbrier County, West Virginia, in Document No. 105833, in Book No. 705, at Page 426, Jeffrey K. Johnson and Shahana R. Johnson did convey unto William D. Goodwin, Trustee, certain real property described in said Deed of Trust; and the beneficiary has elected to appoint Seneca Trustees, Inc., as Substitute Trustee by a Substitution of Trustee dated October 24, 2016, and recorded in the aforesaid Clerk’s office; and default having been made under the aforementioned Deed of Trust, and the undersigned Substitute Trustee having been instructed by JPMorgan Chase Bank, National Association to foreclose thereunder, will offer for sale at public auction at the front door of the Greenbrier County Courthouse in Lewisburg, West Virginia, on
December 2, 2016, at 2:00 PM
the following described real estate, together with its improvements, easements and appurtenances thereunto belonging, situate in Alderson Corp-oration District, Greenbrier County, West Virginia, and more particularly described as follows:
“All those three certain tracts or parcels of land together with the buildings and improvements thereon and privileges and appurtenances thereunto belonging, situate, lying and being in the Town of Alderson, Blue Sulphur District, Greenbrier County, West Virginia, being more particularly known, designated and described as all of Lots No. One (1), Two (2), and the major portion of Lot No. Three (3), upon which the dwelling house is situated, of the    C. P. Bowyer and Edna Pearl Bowyer property in the said Town of Alderson, which said lots are shown and delineated upon a map or plat of the said Property, prepared by Joe F. Skaggs, P. E., of record in the aforesaid Clerk’s Office in Deed Book in Map Book 2 at Page 123, and which said Lots and part Lots herein conveyed are more particularly bounded and described as follows:
BEGINNING at the intersection of Oakwood Street and Jackson Street, at the corner of Lot No. 1 of the said C. P. Bowyer and Edna Pearl Bowyer Property; thence with the east side of Jackson Street and Lots No.1, 2, and 3 a distance of 251.9 feet to a stake at the southwest corner of Lot No. 4 of said Property; thence leaving Jackson Street and with the line of said Lot No. 4,        S 73-23 E. A distance of 150 feet to a stake at the southeast corner of the said lot, and continuing on the same course and bearing through the northeastern portion of Lot No. 3 a distance of approximately 100 feet to a stake on the property line of the Gwinn heirs, now Spence; thence with the Gwinn heirs, now Spence; S 16-37 W a distance of 28.5 feet, more or less, to a post a common corner with the property of M. A. Pyles, also now Spence; thence leaving said corner and running with the Pyles, now Spence, line N 70-31 W 105.3 feet to a fence post, a common corner to Lot No. 3; thence continuing with the Pyles or Spence line, and with the east line of Lot no. 3, S 13-27 W 124.4 feet to a stake on the said line and continuing on with the same property and the east line of Lots Nos. 3, 2, and 1, S 16-32 W 105.8 feet to the north line of said Oakwood Street; thence with the north line of said Oakwood Street; thence with the north line of said Street and the South line of Lot No. 1, N 72-31 W 145.5 feet to the Beginning, being all of said Lots No. 1 and 2, and that part of Lot No. 3 of the said Bowyer property as herein described.” The aforesaid real estate is the same as that conveyed to the Grantors from Dale Cook by deed dated October 9, 2012, to be placed of record in the Office of the Clerk of the County Commission of Greenbrier County, West Virginia, prior to or simultaneously with the recordation of this instrument. Reference is hereby made to all prior instruments in the chain of title for all reservations, restrictions, limitations and easements and right of way affecting the property herein conveyed.
For Purposes of West Virginia Code §38-1-4, any notice of Trustee’s sale shall be mailed to the Grantor at the following address (or such address subsequently given to Lender in writing by the Grantor): P.O. Box 197, Alderson, WV 24910.
At the time of the execution of the Deed of Trust, this property was reported to have an address of: 302 Jackson Street, Alderson, WV 24910.
The referenced real estate will be conveyed with no covenants of warranty, and subject to all covenants, restrictions, easements, rights of way and reservations which may be a matter of record in the aforesaid Clerk’s Office or visible upon the ground, all prior liens and encumbrances, including, without limitation, liens for real estate taxes, incinerator, sanitary and sewer charges. The purchasers at the sale shall be responsible for paying the recording costs and also the tax on the privilege of transferring real property (the cost of the tax stamp to be affixed to the deed). The purchasers shall be responsible for payment of all real estate taxes.
The subject property will be sold in “AS IS” condition. The Substitute Trustee shall be under no duty to cause any existing tenant or person occupying the subject property to vacate said property.
TERMS: $9,000.00 in cash and/or certified funds as deposit with the balance due and payable within 30 days of the day of sale.
FEDERAL TAX LIEN: In the event that there are Federal Tax Liens against the property, the United States would have the right to redeem the property within a period of 120 days from the date of such sale or the period allowable for redemption under local law, whichever is longer.
Pursuant to the Deed of Trust, the Trustee may postpone the sale by public announcement at the time and place designated or by posting a notice of the same, and act by agent in the execution of the sale. The parties secured by the Deed of Trust reserve the right to purchase the property at such sale.
