The undersigned Substitute Trustee, by virtue of the authority vested in it by that certain Deed of Trust dated September 29, 2008, and duly recorded in the Office of the Clerk of the County Commission of Hampshire County, West Virginia, in Deed of Trust Book 485, at Page 393, Danny P. Divver and Joyce D. Divver did convey unto M. Shannon Brown, Trustee, certain real property described in said Deed of Trust; and the beneficiary has elected to appoint Pill & Pill, PLLC as Substitute Trustee by a Substitution of Trustee recorded in the aforesaid Clerk’s Office; and default having been made under the aforementioned Deed of Trust, and the undersigned Substitute Trustee having been instructed by the secured party to foreclose thereunder, will offer for sale at public auction at the front door of the Hampshire County Courthouse, in Romney, West Virginia, on

Tuesday, January 17, 2017, at 3:06 p.m.

The following described real estate, with its improvements, easements and appurtenances thereunto belonging, situate in the Romney District, Hampshire County, West Virginia, and more particularly described as follows:

That certain parcel of real estate, together with all rights, improvements, privileges, rights-of-way and appurtenances thereunto belonging or in anyway pertaining, situate, lying and being in Romney District, Hampshire County, West Virginia, being more particularly described as follows, to-wit:
Lot #225, Section 8, “Bluffs on the Potomac”, as is more fully shown upon a plat thereof prepared by L & W Enterprises, Inc., dated October 23, 2006, and recorded in the Office of the Clerk of the County Commission of Hampshire County, West Virginia in Plat Book 10, at page 260.
THIS CONVEYANCE IS SUBJECT TO those covenants, restrictions and assessments more and particularly set forth in that Supplemental Declaration of Reservations and Restrictive Covenants, dated October 16, 2006, made by WV Hunter, LLC, a Delaware limited liability company, recorded in the Office of the Clerk of the County Commission of Hampshire County, West Virginia in Deed Book 461, at page 469.
THIS CONVEYANCE IS FURTHER SUBJECT TO all rights-of-way and easements of record and in existence, including but not limited to the right of the party of the first part and all owners within Bluffs on the Potomac, their guests and invitees, to use all Roads, and Other Common Facilities within said subdivision.

At the time of the execution of the Deed of Trust, this property was reported to have a mailing address of Lot 225, Bluffs on the Potomac, Springfield, WV 26763.

AND BEING the same real estate which was conveyed to Danny P. Divver and Joyce D. Divver by Deed dated September 29, 2008, from WV Hunter, LLC, and recorded in the Office of the Clerk of the County Commission of Hampshire County, West Virginia, in Deed Book 478, at Page 456.

The above-described property will be sold subject to any covenants, restrictions, easements, leases and conditions of record, and subject to any unpaid real estate taxes.

The subject property will be sold in “AS IS” condition. The Substitute Trustee shall be under no duty to cause any existing tenant or person occupying the subject property to vacate said property.

TERMS: Ten percent (10{4ceb532c6f579389df471c6c1e832caf2346b74dc60fcbf6aabd4d29df3baf9c}) of the purchase price as a cash deposit with the balance due and payable within 30 days of the day of sale.
