The undersigned Substitute Trus-tee, by virtue of the authority vested in him by that certain Deed of Trust, dated September 7, 2004, and duly recorded in the Office of the Clerk of the County Commission of Greenbrier County, West Virginia, in Document No. 13680, in Book No. 542, at Page 182, Susan B. Poague did convey unto Richard A. Pill, Trustee(s), certain real property described in said Deed of Trust; and the beneficiary has elected to appoint Seneca Trustees, Inc., as Substitute Trustee by a Substitution of Trustee dated November 14, 2014 and recorded in the aforesaid Clerk’s office; and default having been made under the aforementioned Deed of Trust, and the undersigned Substitute Trustee having been instructed by Branch Banking and Trust Company to foreclose thereunder, will offer for sale at public auction at the front door of the Greenbrier County Courthouse in Lewisburg, West Virginia, on
January 14, 2015, at 12:00 PM
the following described real estate, together with its improvements, easements and appurtenances thereunto belonging, situate in Fort Spring District, Greenbrier County, West Virginia, and more particularly described as follows:
That certain tract or parcel of land together with the improvements thereon and the appurtenances thereunto belonging, situate in Fort Springs District, Greenbrier County, West Virginia and more particularly bounded and described as follows:
Beginning at a ¾ inch iron pipe found on the western right-of-way line of WV County Route No. 35, corner to John R. Dawkins (DB 431, PG 777); thence leaving said Dawkins and with the western right-of-way line of WV County Route No. 35, S 21-15-16 W 259.93 feet (Erroneously referred to as 256.93 feet in previous security instrument) to a ¾inch iron pipe found on the western right-of-way line of WV County Route No. 35, corner to Robert D. Shrader (DB 410, PG 586); thence leaving the western right-of-way line of WV County Route No. 35 and with said Shrader, N 68-53-35 W 436.60 feet to a ½inch iron pipe found, corner to said Shrader; thence continuing with said Shrader, S 21-01-03 W 144.61 feet to a fence post found, corner to said Shrader and Timothy R. Bugas, Sr. (DB 415, PO 717); thence leaving said Shrader and with said Bugas, S 65-16-13 W25.01 feet to a 1 inch iron pipe found, corner to said Bugas and Alan T. Lee (DB 434, PG 221); thence leaving said Bugas and through the property of said Lee with a new division line, N 32-42-18 W 149.86 feet to a ½inch rebar set on the line of said Lee and John R. Dawkins (DB 421, PG266); thence with said Dawkins (DB 421, PG 266), N 34-34-41 E 309.90 feet to the beginning and containing 3.329 acres, more or less.
And being a part of the land which was conveyed to Alan T. Lee, by Martin T. Smith and Kay O. Smith, by Deed dated, November 1, 1995 and of record in the Office of the Clerk of the County Commission of Greenbrier County, West Virginia, in Deed Book 434 at Page 221.
And also being the same land which was conveyed unto Susan B. Poague, from deed from Alan T. Lee dated March 21, 2003 and of record in the Office of the Clerk of the County Commission of Greenbrier County, West Virginia, in Deed Book 484 at page 836.
At the time of the execution of the Deed of Trust, this property was reported to have an address of: RR 2 Box 330, Lewisburg, WV 24901.
The referenced real estate will be conveyed with no covenants of warranty, and subject to all covenants, restrictions, easements, rights of way and reservations which may be a matter of record in the aforesaid Clerk’s Office or visible upon the ground, all prior liens and encumbrances, including, without limitation, liens for real estate taxes, incinerator, sanitary and sewer charges. The purchasers at the sale shall be responsible for paying the recording costs and also the tax on the privilege of transferring real property (the cost of the tax stamp to be affixed to the deed). The purchasers shall be responsible for payment of all real estate taxes.
The subject property will be sold in “AS IS” condition. The Substitute Trustee shall be under no duty to cause any existing tenant or person occupying the subject property to vacate said property.
TERMS: $9,000.00 in cash and/or certified funds as deposit with the balance due and payable within 30 days of the day of sale.
FEDERAL TAX LIEN: In the event that there are Federal Tax Liens against the property, the United States would have the right to redeem the property within a period of 120 days from the date of such sale or the period allowable for redemption under local law, whichever is longer.
Pursuant to the Deed of Trust, the Trustee may postpone the sale by public announcement at the time and place designated or by posting a notice of the same, and act by agent in the execution of the sale. The parties secured by the Deed of Trust reserve the right to purchase the property at such sale.
