TRUSTEE’S SALE OF VALUABLE REAL ESTATE

THURSDAY, APRIL 6, 2017, AT 11:00 A.M.

The herein described real estate of the Estate of David J. Hitchins, shall be sold at public auction on the Courthouse steps in Romney, Hampshire County, West Virginia, on Thursday, April 6, 2017, at 11:00 a.m.

Said real estate will be sold pursuant to the authority vested in the undersigned, by the provisions of that certain Deed of Trust executed by David J. Hitchins and Sharon Hitchins, his wife, unto H. Charles Carl, III, and/or William C. Keaton, Trustees, to secure unto The Bank of Romney, a banking corporation, the beneficial owner of that certain Deed of Trust, dated the 30th day of January, 2006, and of record in the Office of the Clerk of the County Commission of Hampshire County, West Virginia, in Deed of Trust Book 414, at Page 677. Default having occurred relative to the covenants and conditions as set forth in said Deed of Trust, and the undersigned Trustee, having been instructed in writing by the beneficial owner so to do, will offer the hereinafter described real estate for sale at public auction to the highest responsible bidder at the front door of the Courthouse in Romney, Hampshire County, West Virginia, on Thursday, April 6, 2017, at 11:00 a.m., which said property is more particularly described as follows:

All that certain tract or parcel of real estate containing 10 1/4 acres, more or less, together with the improvements thereon and all rights, rights of way, roads, easements, minerals, oil and gas and appurtenances thereunto belonging, situate and being in Bloomery District, Hampshire County, West Virginia, and is more fully described as follows:

“The real estate herein conveyed is more particularly described by metes and bounds according to that certain survey made by Paul Bradfield, Surveyor, as follows, to-wit:

“Beginning at cement post corner to the Church lot on the Southeast side of the State Road; thence with said Church lot S. 43 3/4 E. 502 feet to a cement post on the S. Side of the old county road; thence with the S. Side of said road S. 52 W. 232 feet to a point in the original line, S. 43 E. 20 feet to a pine stump an original corner, N. 86 E. 421 feet to the river; thence with center of river N. 29 E. 100 feet N. 74 ½ E. 196 feet S. 86 E. 247 feet; S. 31 ½ E. 163 feet to a C. O. N. 5 1/4 W. 779 feet to stake in said original line on the S.E. side of the State Road thence with said road S. 53 W. 104, S. 46 W. 171 feet S. 52 ½ W. 119, S. 65 W. 130 feet, S. 82 ½ W. 180 feet N. 83 W. 290 feet S. 86 W. 195 feet, S. 87 W. 122 feet to the beginning, containing 10 1/4 acres, more or less.”

And being the same real estate which was conveyed unto David J. Hitchins and Sharon Hitchins, his wife, by deed of John Francis Sullivan and Patricia Ryan Sullivan, his wife, dated August 1, 2005, and which said Deed is of record in the Office of the Clerk of the County Commission of Hampshire County, West Virginia, in Deed Book No. 446, at page 181. And further being the same real estate in which Sharon Hitchins deeded all of her right, title, and interest, in said real estate unto David J. Hitchins, by deed dated November 4, 2011, and of record in the aforesaid Clerk’s Office in Deed Book 506 at Page 195. The said David J. Hitchins died intestate on September 28, 2016, survived by his sister, Naomi L. Ziler, as his sole heir, as evidenced in the aforesaid Clerk’s Office in Fiduciary Book 23 at Page 351.

The property will be conveyed in an “AS IS” condition by Deed containing no warranty, express or implied, subject to the Internal Revenue Service right of redemption, all property taxes, prior Deeds, liens, reservations, encumbrances, restrictions, rights-of-ways, easements, covenants, conveyances and conditions of record in the aforesaid Clerk’s Office or affecting the subject property.

The Beneficiary and/or the Servicer of the Deeds of Trust and Note reserve the right to submit a bid for the property at sale.

The Trustee reserves the right to continue sale of the subject property from time to time by written or oral proclamation, which continuance shall be in the sole discretion of the Trustee.

The Trustee shall be under no duty to cause any existing tenant or person occupying the property to vacate said property, and any personal property and/or belongings remaining at the property after the foreclosure sale will be deemed to constitute ABANDONED PROPERTY AND WILL BE DISPOSED OF ACCORDINGLY.

Terms of the sale are 10 percent cash down to be paid on day of sale, and the balance to be paid by certified or cashiers check within 30 days of the date of the sale.
