The undersigned Substitute Trustee, by virtue of the authority vested in him by that certain Deed of Trust, dated November 19, 2009, and duly recorded in the Office of the Clerk of the County Commission of Monroe County, West Virginia, in Document No. 56059, in Book No. 224, at Page 10, Gary D. Guy did convey unto William D. Goodwin, Trustee(s), certain real property described in said Deed of Trust; and the beneficiary has elected to appoint Seneca Trustees, Inc., as Substitute Trustee by a Substitution of Trustee dated October 25, 2016, and recorded in the aforesaid Clerk’s office; and default having been made under the aforementioned Deed of Trust, and the undersigned Substitute Trustee having been instructed by Bank of America, N.A., to foreclose thereunder, will offer for sale at public auction at the front door of the Monroe County Courthouse in Union, West Virginia, on
July 28, 2017 at 1:00 PM
the following described real estate, together with its improvements, easements and appurtenances thereunto be-longing, situate in Union District, Monroe County, West Virginia, and more particularly described as follows:
TRACT ONE (1):
All that certain tract or parcel of land, being a tract of land situate in the Union District, Monroe County, West Virginia, about 1.5 miles east of Union W.Va. on the north side of West Virginia Route 3, containing 1.01 acres, more and less, and more particularly described as follows:
Beginning at a ½” re-bar, set, on the north side of W. VA. Rte. 3, a corner to W. Haskall Campbell; thence with Campbell, N 7-33 E 12.37 feet to a ½” re-bar, set; thence N 74-21-30 E 111.42 feet to a ½” re-bar, set; thence N 3-30 W 144.32 feet to a ½” re-bar, set; thence N 79-57 E 164.46 feet to a ½” re-bar, set, on the Inez Trail property line; thence leaving Campbell and with Trail, S 5-30 E, at 246.50 feet passing a fence post found on line, in all a total of 258.91 feet to a point, found, in the center of Old W.Va. Rt 3; thence leaving Trail and with old Rt 3 and also with Rte 3, N 85-35-30 W 145.66 feet to a point; thence N 10-35 E 5.00 feet to a point; thence N (erroneously referred to as B) 79-27 W 145.00 feet to the beginning and containing 1.01 acres, more or less, as surveyed by Harvey B. Neel of Lewisburg, West Virginia, in July, 1998.
And being the same real property conveyed unto Gary Guy and Libby R. Guy from Edgar Ripley by deed dated the 28th day of January, 1986, and recorded in the Office of the Clerk of the County Commission of Monroe County, West Virginia in Deed Book 175 page 526. The interest of Libby R. Guy was conveyed to Gary D. Guy by deed dated July 21, 1998, of record in the aforesaid Clerk’s Office in Deed Book 215 at Page 600.
TRACT TWO (2):
BEGINNING at a point, found, on the north side of West Virginia Route 3, a corner to Gary Guy; thence, S 87-25E, 249.47 feet to a point, found, on the Inez Trail property line; thence, leaving Guy and with Trail, S 5-30 E, 41.18 feet to a 3/4″ re-bar, set on the north side of WV Route 3; thence, with Route 3, N 79-27 W, 149.31 feet to a point; thence, N 10-33 E, 5.00 feet to a point; thence, N 79-27 W, 109.14 feet to the beginning and containing 5,186 square feet, more or less, as surveyed by Harvey B. Neel of Lewisburg, WV, in December, 2000, as shown on a plat entitled Plat of Survey for Gary David Guy.
The tract of land hereinabove described is a portion of that same real estate known and designated as the old Sweet and Salt Sulphur Springs Turnpike as property acquired from the Common-wealth of Virginia.
THIS CONVEYANCE is made subject to existing utility rights of way, easements, and lines, whether or not visible upon the ground.
And being the same tract or parcel of real property conveyed unto Gary D. Guy by deed dated October 15, 2001, from the West Virginia Department of Transportation, Division of Highways and of record in the Office of the Clerk of the County Commission of Monroe County, West Virginia, in Deed Book 228 at Page 143.
Reference is hereby made to all prior instruments in the chain of title for all reservations, restrictions, limitations and easements and right of way affecting the property herein conveyed.
For Purposes of West Virginia Code §38-1-4, any notice of Trustee’s sale shall be mailed to the Grantor at the following address (or such address subsequently given to Lender in writing by the Grantor): HC 76 Box 87A, Union, WV 24983
At the time of the execution of the Deed of Trust, this property was reported to have an address of: HC 76 Box 87A, Union, WV aka 1319 Sweet Springs Valley Road, Union, WV.
The referenced real estate will be conveyed with no covenants of warranty, and subject to all covenants, restrictions, easements, rights of way and reservations which may be a matter of record in the aforesaid Clerk’s Office or visible upon the ground, all prior liens and encumbrances, including, without limitation, liens for real estate taxes, incinerator, sanitary and sewer charges. The purchasers at the sale shall be responsible for paying the recording costs and also the tax on the privilege of transferring real property (the cost of the tax stamp to be affixed to the deed). The purchasers shall be responsible for payment of all real estate taxes.
The subject property will be sold in “AS IS” condition. The Substitute Trustee shall be under no duty to cause any existing tenant or person occupying the subject property to vacate said property.
TERMS: $9000.00 in cash and/or certified funds as deposit at the time of sale with the balance due and payable within 30 days of the day of sale.
FEDERAL TAX LIEN: In the event that there are Federal Tax Liens against the property, the United States would have the right to redeem the property within a period of 120 days from the date of such sale or the period allowable for redemption under local law, whichever is longer.
Pursuant to the Deed of Trust, the Trustee may postpone the sale by public announcement at the time and place designated or by posting a notice of the same, and act by agent in the execution of the sale. The parties secured by the Deed of Trust reserve the right to purchase the property at such sale.
