TRUSTEE’S SALE OF VALUABLE REAL ESTATE

FRIDAY, MARCH 6, 2015, AT 10:00 A.M.

The herein described real estate of Sharon M. Long shall be sold at public auction on the Courthouse steps in Romney, Hampshire County, West Virginia, on Friday, March 6, 2015, at 10:00 a.m.

Said real estate will be sold pursuant to the authority vested in the undersigned, by the provisions of that certain Deed of Trust executed by Darl L. Long and Sharon M. Long, his wife, unto H. Charles Carl, III, and/or William C. Keaton, Trustees, to secure unto The Bank of Romney, a banking corporation, the beneficial owner of that certain Deed of Trust, dated the 11th day of April, 2011, and of record in the Office of the Clerk of the County Commission of Hampshire County, West Virginia, in Deed of Trust Book 528, at page 198; and the undersigned Trustee, having been instructed in writing by the beneficial owner so to do, will offer the hereinafter described real estate for sale at public auction to the highest responsible bidder at the front door of the Courthouse in Romney, Hampshire County, West Virginia, on Friday, March 6, 2015, at 10:00 a.m., which said property is more particularly described as follows:

All those certain contiguous lots or parcels of real estate, together with the dwelling and improvements, and all rights, rights of way, easements, and appurtenances thereunto belonging, situate and being in the Town of Romney, Romney Municipal District, Hampshire County, West Virginia, and designated upon the plat of “Tabb’s Addition to the Town of Romney” as Lot Nos. 10, 12, and 14, and the southeastern corner of Lot No. 16, containing 375 square feet, as shown on the plat which is duly recorded in the Office of the Clerk of the County Commission of Hampshire County, West Virginia, in Deed Book No. 69, at Page 130, which plat by reference is expressly made a part hereof for all proper and pertinent reasons. The parcels of real estate herein conveyed lie on the north side of the street designated as “Street No. 1” on said Plat, which is now known as the Western End of Birch Lane.

LESS, HOWEVER, that certain outconveyance containing 0.35 of an acre, more or less, conveyed unto David Wayne Ours and Diana Sue Ours, his wife, by deed dated July 10, 1997, of record in the aforesaid Clerk’s Office in Deed Book No. 377, at page 345, in which deed said outconveyance was described as “a tract of land located at the intersection of Birch Lane and Fairfax Street and the northeast corner thereof, being Lot 10 and part of Lot 12 of Tabb’s Addition to the Town of Romney, Romney Municipal District, Hampshire County, West Virginia”. Said outconveyance is shown on that certain plat of record in the aforesaid Clerk’s office in Deed Book No. 377, at page 348.

THUS LEAVING, for purposes of this conveyance, Lot No. 14, part of Lot No. 12, and part of Lot No. 16 of Tabb’s Addition to the Town of Romney, known as 455 West Birch Lane.

Said real estate is depicted on the 2014 Hampshire County Land Books as District 08 Tax Map 1 Parcel 222.

And being the same real estate conveyed unto Darl L. Long and Sharon M. Long, his wife, as joint tenants with full rights of survivorship, by deed of Anna K. Kidwell, by Lynus Mark Kidwell and Lynda Kidwell Breznitsky, her Attorneys in Fact, and Lynus Mark Kidwell and Lynda Kidwell Breznitsky, individually, dated April 1, 2011, of record in the aforesaid Clerk’s Office in Deed Book No. 499, at page 500. And further being the same real estate in which full, fee simple title did vest in Sharon M. Long upon the death of her husband, Darl L. Long, on February 26, 2014, per the survivorship clause in said deed.

The property will be conveyed in an “AS IS” condition by Deed containing no warranty, express or implied, subject to the Internal Revenue Service right of redemption, all property taxes, prior Deeds, liens, reservations, encumbrances, restrictions, rights-of-ways, easements, covenants, conveyances and conditions of record in the aforesaid Clerk’s Office or affecting the subject property.

The Beneficiary and/or the Servicer of the Deeds of Trust and Note reserve the right to submit a bid for the property at sale.

The Trustee reserves the right to continue sale of the subject property from time to time by written or oral proclamation, which continuance shall be in the sole discretion of the Trustees.

The Trustee shall be under no duty to cause any existing tenant or person occupying the property to vacate said property, and any personal property and/or belongings remaining at the property after the foreclosure sale will be deemed to constitute ABANDONED PROPERTY AND WILL BE DISPOSED OF ACCORDINGLY.

Terms of the sale are 10 percent cash down to be paid on day of sale, and the balance to be paid by certified or cashiers check within 30 days of the date of the sale.
