TRUSTEE’S SALE OF VALUABLE REAL ESTATE

The undersigned Substitute Trustee, by virtue of the authority vested in him by that certain Deed of Trust dated February 25, 2005, and duly recorded in the Office of the Clerk of the County Commission of Hampshire County, West Virginia, in Deed of Trust Book 387, at Page 298, Jeffery M. Verity and Jade B. Verity did convey unto M. Shannon Brown, Trustee, certain real property described in said Deed of Trust; and the beneficiary has elected to appoint Richard A. Pill as Substitute Trustee by a Substitution of Trustee recorded in the aforesaid Clerk’s Office; and default having been made under the aforementioned Deed of Trust, and the undersigned Substitute Trustee having been instructed by the secured party to foreclose thereunder, will offer for sale at public auction at the front door of the Hampshire County Courthouse, in Romney, West Virginia, on

Friday, January 9, 2015, at 9:03 a.m.

The following described real estate, with its improvements, easements and appurtenances thereunto belonging, situate in the Springfield District, Hampshire County, West Virginia, and more particularly described as follows:

All that certain parcel of real estate, together with all rights, improvements, privileges, rights of way and appurtenances thereunto belonging or in any way pertaining, situate, lying and being in Springfield District, Hampshire County, West Virginia, being more particularly described as follows, to wit:

Lot 48, “Mountain Air,” as is more fully shown upon a Plat of Survey thereof, prepared by L & W Enterprises, Inc., dated December 30, 2004, and recorded in the Office of the Clerk of the County Commission of Hampshire County, West Virginia, in Map Book 10, at Page 42.

This conveyance is subject to those covenants, restrictions and assessments more and particularly set forth in that Declaration of Reservations and Restrictive Covenants, dated December 30, 2004, made by WV Hunter, LLC, a Delaware limited liability company, recorded in the aforesaid Clerk’s Office in Deed Book 440, at Page 393.

This conveyance is further subject to all rights of way and easements of record and in existence, including but not limited to the right of the party of the first part and all property owners within Mountain Air, their guests and invitees, to use all roads and other common facilities within said subdivision.

AND BEING the same real estate which was conveyed to Jeffery M. Verity and Jade B. Verity, by Deed dated February 25, 2005, from WV Hunter, LLC, and recorded in the Office of the Clerk of the County Commission of Hampshire County, West Virginia, in Deed Book 441, at Page 514.

The above-described property will be sold subject to any covenants, restrictions, easements, leases and conditions of record, and subject to any unpaid real estate taxes.

The subject property will be sold in “AS IS” condition. The Substitute Trustee shall be under no duty to cause any existing tenant or person occupying the subject property to vacate said property.

TERMS: Ten percent (10{4ceb532c6f579389df471c6c1e832caf2346b74dc60fcbf6aabd4d29df3baf9c}) of the purchase price as a cash deposit with the balance due and payable within 30 days of the day of sale.
