The undersigned Substitute Trustee, by virtue of the authority vested in him by that certain Deed of Trust, dated April 15, 2002, and duly recorded in the Office of the Clerk of the County  Commission of Greenbrier County, West Virginia, in Book No. 473, at Page 308, James W. Bowling and Janey L. Bowling did convey unto Barry L. Weese, Trustee(s), certain real property described in said Deed of Trust; and the beneficiary has elected to appoint Seneca Trustees, Inc., as Substitute Trustee by a Substitution of Trustee dated October 1, 2013 and recorded in the aforesaid Clerk’s office; and default having been made under the aforementioned Deed of Trust, and the undersigned Substitute Trustee having been instructed by Bayview Loan Servicing, LLC, a Delaware Limited Liability Company to foreclose thereunder, will offer for sale at public auction at the front door  of the Greenbrier County Courthouse in Lewisburg, West Virginia, on
April 27, 2016 at 2:30 PM
the following described real estate, together with its improvements, ease-ments and appurtenances thereunto belonging, situate in Meadow Bluff District, Greenbrier County, West Virginia, and more particularly described as follows:
All of that certain tract or parcel of real estate, together with the im-provements thereon and the easements and appurtenances thereunto belonging, situate in Meadow Bluff District, Greenbrier County, West Virginia, more particularly bounded and described as follows:
“All that certain tract or parcel of land on Meadow River, in McRoss, Meadow Bluff District, Greenbrier County, West Virginia, and more particularly bounded and described as follows:
BEGINNING at a point in the center of Meadow River; thence leaving Meadow River S 32-31 E at 53.72 feet crossing a ½” iron pipe on top of river bank 10 feet east of black cherry in all 339.00 feet to a point in center of 20 feet street and 10 feet crossing a point at edge of street, set 5/8″ rebar, in all 51.50 feet to a point beside of a rose bush and corner to Lewis Lilly, set 5/8″ rebar, from which a white oak bears S 52-00 W 76.8 feet; thence with Lilly N 32-31 W at 285.27 feet crossing a point on edge of river bank, set a 5/8″ rebar, in all 340 feet to the center of Meadow River; thence with Meadow River N 55-34 E 30.20 feet to a point; thence N 50-15 E 30.46 feet to the BEGINNING and containing 0.48 acres, more or less, as surveyed June, 1984, by Donald L. Ratliff, L.L.S., of Rupert, West Virginia.”
And being the same property which was conveyed unto James W. Bowling and Janey L. Bowling, husband and wife, by Deed from Mary Evelyn Plummer and Samuel Goodson, her husband, dated April 10, 2002, and to be recorded in the Office of the Clerk of the County Commission of Greenbrier County, West Virginia prior to or simultaneously herewith.
At the time of the execution of the Deed of Trust, this property was reported to have an address of:  1535 Riverside Drive, Rainelle, WV 25962 aka 123 Riverside Drive Rainelle, WV 25962.
The referenced real estate will be conveyed with no covenants of warranty, and subject to all covenants, restrictions, easements, rights of way and reser-vations which may be a matter of record in the aforesaid Clerk’s Office or visible upon the ground, all prior liens and encumbrances, including, without limi-tation, liens for real estate taxes, incinerator, sanitary and sewer charges.  The purchasers at the sale shall be responsible for paying the recording costs and also the tax on the privilege of transferring real property (the cost of the tax stamp to be affixed to the deed).  The purchasers shall be responsible for payment of all real estate taxes.
The subject property will be sold in “AS IS” condition.  The Substitute Trustee shall be under no duty to cause any existing tenant or person occupying the subject property to vacate said property.
TERMS:  $3,500.00 in cash and/or certified funds as deposit with the bal-ance due and payable within 30 days of the day of sale.
FEDERAL TAX LIEN:  In the event that there are Federal Tax Liens against the property, the United States would have the right to redeem the property within a period of 120 days from the date of such sale or the period allowable for redemption under local law, whichever is longer.
Pursuant to the Deed of Trust, the Trustee may postpone the sale by public announcement at the time and place designated or by posting a notice of the same, and act by agent in the execution of the sale.  The parties secured by the Deed of Trust reserve the right to purchase the property at such sale.
