NOTICE OF TRUSTEE’S SALE

Notice is hereby given, that the undersigned Substitute Trustee, by the virtue of the authority vested in it by that certain Deed of Trust dated August 21, 1995, recorded in the Office of the Clerk of the County Commission of Mercer County, West Virginia, in Deed of Trust Book 738, at Page 515, executed by Robert A. Hurst and Janice E. Hurst, to Bobby Lewis, State Director of the Rural Housing Service for the State of West Virginia, or its successor agency, and the successors in office as State Director or Acting State Director, as Trustee, for the benefit of the United States of America, acting through the Rural Housing Service or successor agency, United States Department of Agriculture, will offer for sale at public auction at the front door of the Mercer County Courthouse, in Princeton, West Virginia, on

January 28, 2020 at 11:51 a.m.

The following described property, with its improvements, easements and appurtenances thereunto belonging, situate in the Beaver Pond District, Mercer County, West Virginia, and more particularly described as follows:
All of that certain tract or parcel of real estate as shown on ‘PLAT SHOWING PROPERTY IN THE ESTATE OF HOWARD W. AND OTTIE G. BOWMAN BEAVER POND DISTRICT MERCER COUNTY LORTON LICK WEST VA Scale 1″ = 20′ June 27, 1995,’ said Plat intended to be recorded simultaneously herewith and made a part of this deed, and more fully bounded and described as follows:
“BEGINNING at a 1/2 inch rebar set in the southern line of Mercer County Route number 71, (Lorton Lick Road), said point being denoted as Point ‘A’ on the attached Plat and being the northwest corner of the Shields Memorial Chapel’s property as described in their deed of record in Deed Book 327 at Page 239, said point further referenced as situate N. 51 deg. 53′ E. 76.68 feet from the northeast corner of the Bowman dwelling, N. 34 deg. 04′ E. 88.89 feet from the southeast corner of the Bowman dwelling, N. 18 deg. 08′ E. 72.43 feet from the northeast corner of the frame garage and N. 08 deg. 59′ E. 92.66 feet from the southeast corner of the frame garage; thence leaving Route Number 71 and with the dividing line between the Shields memorial Chapel property and the Bowman Estate property S. 22 deg. 45′ E. passing through the center of a well cap at 112.22 feet for a total distance of 115.00 feet to a 1/2 inch rebar set at Point ‘B’ on the attached Plat on the northern bank of Lorton Lick Creek; thence on a chord with the northern line of Lorton Lick Creek S. 84 deg. 46′ W. 100.48 feet to a 1/2 inch rebar set on the north bank of Lorton Lick Creek and denoted as Point “C” on the attached Plat, said point being the southeast corner of Leonard Taylor’s property as described in his deed of record in Deed Book 482, at Page 84; thence leaving Lorton Lick Creek and with the dividing line between the Bowman Estate property and Leonard Taylor’s property N. 24 deg. 47′ W. 92.90 feet to a 1/2 inch rebar set in the southern line of the above mentioned Mercer County Route Number 71, said point situate N. 82 deg. 24′ W. 65.38 feet from the northwest corner of the Bowman dwelling and denoted as Point “D” on the attached Plat; thence leaving the Leonard Taylor property and with the southern line of said Route Number 71 and at a distance of 20 feet from the centerline of the asphalt pavement N. 71 deg. 55′ E. 99.45 feet to the point of BEGINNING, and containing 0.23 acres.”
TOGETHER WITH an easement, of record in the aforesaid Clerk’s Office in Deed Book 761, at Page 309.
At the time of the execution of the Deed of Trust, the property was reported to have a mailing address of Route 3 Box 622, Bluefield, WV 24701. We have reason to believe the property now has a mailing address of 1530 Lorton Lick Road, Bluefield, WV 24701-9451.
AND BEING the same real estate conveyed to Robert A. Hurst and Janice E. Hurst by Deed dated July 7, 1995, from Howard D. Bowman, et. al, and recorded in the Office of the Clerk of the County Commission of Mercer County, West Virginia in Deed Book 761, at Page 298.
TERMS OF SALE:
1) The property will be conveyed in an “AS IS” physical condition by Deed containing no warranty, express or implied, subject to the Internal Revenue Service right of redemption, all property taxes, prior Deeds, liens, reservations, encumbrances, restrictions, rights-of-ways, easements, covenants, conveyances and conditions of record in the Clerk’s office or affecting the subject property.
2) The Purchaser shall be responsible for the payment of the transfer taxes imposed by the West Virginia Code 11-22-1.
3) The Beneficiary and/or the Servicer of the Deed of Trust and Note reserve the right to submit a bid for the property at sale.
4) The Trustee shall be under no duty to cause any existing tenant or person occupying the property to vacate said property, and any personal property and/or belongings remaining at the property after the foreclosure sale will be deemed to constitute ABANDONED PROPERTY AND WILL BE DISPOSED OF ACCORDINGLY.
5) The total purchase price is payable to the Trustee within thirty (30) days of the date of sale, with ten (10{4ceb532c6f579389df471c6c1e832caf2346b74dc60fcbf6aabd4d29df3baf9c}) of the total purchase price payable to the Trustee at sale. Title will be conveyed by Trustee’s Deed upon payment of balance. There will be no refund granted of any amount if the third party purchaser elects not to purchase the property for any reason.

CONTINUANCE OR ADJOURNMENT OF SALE:

The Trustee or his assigns has the right to continue the sale or to adjourn the sale for a time or from time to time without further notice other than oral public announcement at the time and place appointed for such sale or at any continuance or adjournment thereof and correction made on the posted notices, which continuance shall be in the sole discretion of the Trustee.
