NOTICE OF TRUSTEE’S SALE

NOTICE IS HEREBY GIVEN that by virtue of that certain Deed of Trust dated October 11, 2013, executed by Larry E. Oliver to William J. Akers, Trustee, of record in the Office of the Clerk of the County Commission of Mercer County, West Virginia, in Trust Deed Book 1265, at page 62, David M. Kersey having been substituted as Trustee pursuant to Substitution of Trustee dated July 10, 2018, of record in the aforesaid Clerk’s office in Trust Deed Book 1357, at page 687, default having occurred in payment of the indebtedness secured by said deed of trust, and the undersigned substitute trustee having been requested to do so by Summit Community Bank, Inc., successor in interest to First Century Bank, Inc., owner and holder of the indebtedness secured by said deed of trust, the undersigned substitute trustee will offer for sale and sell at public auction on March 20, 2019, at 10:00 a.m., at the north entrance of the Mercer County Courthouse, 1501 Main Street, Princeton, Mercer County, West Virginia, the following described real estate, together with the improvements thereon and appurtenances thereunto belonging, more particularly bounded and described as follows:

FIRST TRACT: “all that certain tract or parcel of land described as Tract “A” being Part Parcel 27 Tax Map 32 located off Grassy Branch Cut-Off, Beaver Pond Dist., Mercer Co., WV as shown on a plat of survey entitled, “APPALACHIAN ENGINEERING & SURVEYING, INC. 212 COLLEGE AVE. – BLUEFIELD, W.V. 24701 PHONE 304-325-3481 MAP SHOWING 6.69 ACRE TRACT – PART PAR. 27 T.M. 32 OFF GRASSY BRANCH CUT-OFF BEAVER POND DIST., MERCER CO., WV Date: 6-1-98 Scale: 1″=100′,” which tract or parcel of land is more particularly bounded and described as follows, to-wit:
“BEGINNING at an iron bar in the western line of Parcel 36 at the dividing line of Beaver Pond District and City of Bluefield, said iron bar being the northeast corner of Lot 80 “D” Section 1161, City of Bluefield, and the southeast corner of the herein described tract; thence along said dividing line and the northern line of Lots 80 “D”, “C”, “B”, & “A” S 63 degrees 01 minute 20 seconds W passing an iron pipe at 219.10 ft. and continuing for a total distance of 410.30 ft. to a point; thence continuing along said dividing line and the northwest line of Lot 81 Section 1161 S 32 degrees 24 minutes 20 second W 167.43 ft. to a point; thence continuing along said dividing line and the northern line of Lots 82-90 Section 1161 S 59 degrees 47 minutes 20 seconds W 462.17 ft. to a chestnut oak at top of ridge; thence leaving said dividing line and through Parcel 27 for the following five calls: N 26 degrees 17 minutes 32 seconds E 62.35 ft. to an iron bar; N 26 degrees 07 minutes 32 seconds E 188.84 ft. to an iron bar at a 12″ maple; N 33 degrees 42 minutes 04 seconds E 110.72 ft. to an iron bar at a 10″ shagbark hickory; N 09 degrees 09 minutes W 232.23 ft. to a 36″ white oak; along a fence line N 85 degrees 20 minutes 02 seconds W 99.43 ft. to a 36″ marked white oak; thence along the southern line of Parcel 31 N 68 degrees 30 minutes E 819.94 ft. to an iron bar; thence along the western line of Parcel 36 and along a fence line S 10 degrees 41 minutes 58 seconds E 300.58 ft. to the point of BEGINNING, and containing 6.69 acres, more or less.”

AND BEING the same property conveyed unto Larry E. Oliver by William E. Oliver and Jeanie Oliver, husband and wife by Deed dated July 13, 1998, which Deed is of record in the Office of the Clerk of the County Commission of Mercer County, West Virginia, in Deed Book 803 at Page 609.

SECOND TRACT: “which tract or parcel of land is more particularly bounded and described as follows, to-wit:

Description of a Tract or Parcel of land situated in Beaver Pond District, Mercer County, West Virginia, more particularly described as follows: Commencing at a LARGE CHESTNUT OAK FOUND, being a common corner to Craig, Dale and William Oliver and Larry Oliver, said point being the POINT OF BEGINNING; thence with the following lines being created through the Parent Parcel N. 18 40′ 45″ W. a distance of 91.96′ to a 24″ RED OAK; thence N 76 10′ 09″ E, a distance of 43.16′ to a REBAR SET; thence S 88deg. 25′ 50″ W, a distance of 36.03′ to a REBAR SET in the line of Larry Oliver; thence with line of said Larry Oliver S 26 17′ 32″ W, a distance of 62.35′ to the POINT OF BEGINNING; said described tract containing 0.09 Acres, more or less. As surveyed by Randy Goodrich of Advance Surveys and shown on a Plat titled ‘PLAT OF SURVEY SHOWING PART OF PARCEL 27 TAX MAP 32 BEAVER POND DISTRICT, MERCER COUNTY, WEST VIRGINIA’.”

AND BEING the same property conveyed unto Larry E. Oliver by William Oliver and Jeanie Oliver, husband and wife by Deed dated April 18, 2012, which Deed is of record in the Office of the Clerk of the County Commission of Mercer County, West Virginia, in Deed Book 974 at Page 776.

TERMS OF SALE: Ten percent (10{4ceb532c6f579389df471c6c1e832caf2346b74dc60fcbf6aabd4d29df3baf9c}) cash in hand on day of sale and balance upon delivery of deed. Sale subject to any and all real property taxes or assessments due or to become due, all applicable subdivision and zoning restrictions, matters of survey, compliance with environmental regulations, rights of tenants in possession, if any, and all other pertinent liens, easements, restrictions and reservations of record. The property is sold in an “as is” condition. The purchaser shall pay the excise tax on the transfer of real estate. Any personal property remaining on the premises at the time of sale shall be considered abandoned. The undersigned trustee reserves the right to reject any and all bids, the right to continue the sale by announcement on the date of the sale and the right to announce other conditions upon the sale, which announced conditions, if any, shall be in addition to or take priority over any conditions set forth herein.
