NOTICE OF PUBLIC HEARING ON BOUNDARY LINE ADJUSTMENT The Town Council of the Town of Cedar Bluff, Virginia will hold a public hearing on a proposed Boundary Line Adjustment Agreement between the County of Tazewell and the Town of Cedar Bluff (the “Agreement”), in council chambers at the Cedar Bluff Town Hall, 115 Central Avenue, Cedar Bluff, Virginia 24609, on Tuesday, September 13, 2016, at 7:40 p.m. Immediately following the public hearing the Town Council at its regularly-scheduled meeting intends to adopt a resolution to approve the Agreement and submit it to the County of Tazewell for public hearing, consideration, and approval by its Board of Supervisors. The Agreement is authorized by Section 15.2-3106, et seq., of the Code of Virginia (1950), as amended, and provides that the boundary line between the County and the Town will be relocated by incorporating into the Town of Cedar Bluff certain territory which is presently located within the unincorporated portions of the County. A survey plat attached to the Agreement depicts the new boundary line between the Town and the County in the area where the boundary line would be changed by the Agreement, and is available or inspection at the Cedar Bluff Town Hall during weekdays between 8:00 a.m. and 4:30 p.m. The territory that would be incorporated within the Town consists of an area containing 1000 acres of land (the “Area”) more or less, and lies generally to the south of the current Town limits. The new boundary line of the town would generally include area on both sides of U.S. Route 460 from the existing boundary, to and including its intersection with U.S. Route 19. The boundaries of the Area are fully described by metes and bounds in the Agreement, and as published hereafter in this notice. The proposed Agreement provides that the County of Tazewell and the Town of Cedar Bluff, after approving the Agreement, shall promptly petition the Circuit Court of Tazewell County, jointly to relocate and establish the boundary line as agreed upon, and that the new boundary line shall become effective at midnight on December 31, 2016, unless otherwise agreed to by the two of them, and that in the event that a final court order has not been entered by that date, the new boundary line shall become effective at midnight on February 28, 2017 or at midnight on the 31st day following entry of a final order, whichever date occurs last. The cost of the proceeding will be paid by the Town. Any person interested in the Agreement may appear at the public hearing and present his or views. The area is described as follows: Beginning at the southeastern most corner of the existing Town of Cedar Bluff Corporate Boundary Line, said point lying just south of the east end of a N&W Railway tunnel; Thence leaving said southeastern most corner of the Town of Cedar Bluff Corporate Boundary Line with approximately thirteen (13) courses through lands of Tazewell County, Virginia approximately S 14? 59′ 59″ W (crossing through properties of Keen, The Nature Conservancy, crossing the Clinch River, Gleason, Moore, and crossing Fill Street located in Cedar Land Farms) 2,337 feet more or less to a break in the northern right-of-way line of Stapleton Street, said point being a common corner between lots 104 and 105, Block 8, Section 3 of said Cedar Land Farms; Thence continuing with two (2) lines of said northern right-of-way line of Stapleton Street approximately S 41? 21′ 56″ W, 1,205 feet more or less; Thence approximately S 49? 17′ 46″ W, 567 feet more or less to the intersection of said Stapleton Street and the northern right-of-way line of now or formerly Lark Street; Thence crossing said Lark Street approximately S 26? 12′ 24″ W, 46 feet more or less to a point on the western right-of-way line of Stapleton Street; Thence continuing with said western line of Stapleton Street, the western right-of-way line of Thru Drive, and the western right-of-way line of Wall Street, respectively, approximately S 8? 03′ 05″ E, 1,012 feet more or less; Thence continuing with said western right-of-way line Wall Street approximately S 8? 18′ 36″ W, 143 feet more or less; Thence continuing with said western right-of-way line of said Wall Street and with an extension thereof approximately S 1? 57′ 07″ W (crossing Route 460/19 right-of-way) 1,065 feet more or less to a point on the southern right-of-way line of line of said Route 460/19, Thence continuing with numerous courses along the said southern right-of-way lines of said Route 460/19 and Route 19, respectively, in a southwesterly direction approximately 5,380 feet to a point on said southern right-of-way line of Route 19; Thence leaving said southern right-of-way line of Route 19 and crossing said Route 19 approximately N 19? 44′ 23″ W (crossing the lands of Puckett, crossing Route 705. Steelsburg Methodist Church and Ferrell), 1,059 feet more or less; Thence continuing through said Ferrell approximately N 1? 00′ 43″ W, 1,332 feet to the southwestern most corner of Clinch river Corporation; Thence with two (2) lines of said Clinch River Corporation approximately N 44? 14; 00″ W, 590 feet more or less; Thence approximately N 64? 46′ 00″ W (crossing Route 1020), 395 feet more or less; Thence leaving said Clinch River Corporation approximately N 0? 36′ 40″ W, (crossing through the Lands of Buskell and the Nature Conservancy, respectively) 6,471 feet more or less to an existing corner of the Town of Cedar Bluff Corporate Boundary, said existing corner lying just south of the N&W Railway. Being the same parcel as shown of “Exhibit Showing Compiled Proposed Addition to the Town of Cedar Bluff, Virginia Corporate Boundary and containing approximately 1,000 areas”.
