NOTICE OF TRUSTEE’S SALE In execution of the deed of trust, dated April 8, 2011, from Bobby Koen and Rita Koen to Gary R. Mills and Stephen M. Feola, as trustees, of record in the Office of the Clerk of the County Commission of Mercer County, West Virginia, in Trust Deed Book 1209, at page 35, the undersigned trustee will offer for sale at public auction on November 29, 2016, at 2:00 p.m. at North Walker Street entrance to the Mercer County Courthouse, Princeton, West Virginia, all of a certain lot or parcel of land in the City of Bluefield, Mercer County, West Virginia, which is particularly bounded and described as follows: All of that certain lot of land, with the improvements thereon, known as lot numbered nine (9) in section forty (40) as the same appears on the map made by the Bluefield Water Works and Improvement Company, bounded and further described as follows: Beginning at the intersection at the southeast line of Franklin Street with the southwest line of Jackson Street; thence fronting on Jackson Street South 59? 25′ W. sixty-one (61) feet to a point; thence at right angles with Franklin Street South 30? 35′ E. 140 feet to a twenty feet wide alley; thence with the same N. 59? 25′ E. 38 feet to Jackson Street; thence with Jackson Street N. 21? W. 141 feet to the Beginning; This conveyance is made subject to any and all easements, conditions, restrictions and covenants now of record in said Clerk’s Office, to the extent that the same may lawfully affect the property herein conveyed and subject to such matters as would be revealed by a careful inspection of the premises. J. Peter Richardson was appointed substitute trustee by the APPOINTMENT OF SUBSTITUTE TRUSTEE, dated July 26, 2016, of record in said Clerk’s Office in Trust Deed Book 1321, at page 656. This sale will include all rights, easements, appurtenances, improvements and structures that are part of the real estate described above. This sale will be subject to all restrictions, rights-of-way, conditions, easements, and mechanics’ and materialmen’s liens, if any, whether of record or not of record, to the extent any of the foregoing apply and take priority over the lien of the deed of trust. TERMS OF SALE: Cash in hand on day of sale. The conveyance of the real estate will be by special warranty deed. The real estate and any improvements thereon will be sold in “as is” condition without any warranties. The successful bidder will assume the risk of all loss or damage to the real estate and any improvements thereon after the sale, and be responsible for all costs of the conveyance including, but not limited to, any examination of title, preparation of the deed, excise tax and recording fees.
