NOTICE OF JUDICIAL SALE

Pursuant to ORDER of the Circuit Court of Mercer County, West Virginia, entered in the above captioned matter on January 10, 2020, the undersigned was appointed Special Commissioner to sell the hereinafter described real estate to satisfy the judgment entered in the above captioned Civil Action. In execution of said ORDER, the undersigned Special Commissioner will offer for sale, at public auction, on January 31, 2020, at 10:00 a.m. at the front door of the Law & Commerce Building, 307 Federal Street, Bluefield, Mercer County, West Virginia, all that certain parcel or tract of real estate located in the City of Bluefield, Mercer County, West Virginia, being Lots 6 and 7, Section B of the Edris Addition, shown upon the Tax Assessor’s Map for the City of Bluefield on page 54, as parcel 4, and being more particularly bounded as follows:
BEGINNING at a point in the westerly line of Jefferson Drive, N. 26o 17′ W. 50 feet from its point of intersection with the northerly line of Breen Avenue; thence with the Northerly line of Lot 8, S. 63o43′ W. 125 feet to an alley; thence with two lines of said alley, N. 26o 17′ W. 70 feet and S. 63o 43′ W. 25 feet; thence N. 26o 17′ W. 30 feet; thence with the southerly line of Lot 5, N. 63o 43′ E. 150 feet to Jefferson Drive; thence with same, S. 26o 17′ E. 100 feet to the point of BEGINNING; and being the same real estate convey to Richard Trey Farley by deed of Shirley J. Farley, dated April 2, 2009, and recorded in the Office of the Clerk of the County Commission of Mercer County, West Virginia in Deed Book 936, at Page 287.
This sale will include all rights, easements, appurtenances, improvements and structures that are part of the real estate described above. This sale will be subject to all restrictions, rights-of-way, conditions, easements and matters of record, mechanics’ and materialmen’s liens, if any, whether of record or not of record, and unpaid real estate taxes, to the extent any of the foregoing apply and take priority over the lien of the judgment entered in the above captioned Civil Action.
TERMS OF SALE: Cash in hand on day of sale. The sale will be made subject to the approval of and confirmation by the Circuit Court of Mercer County. The conveyance of the real estate will be by a deed without any covenant or warranty, express or implied. The real estate and any improvements thereon will be sold in “as is” condition without any warranties. The successful bidder will assume the risk of all loss or damage to the real estate and any improvements thereon after the sale, and be responsible for all costs of the conveyance including, but not limited to, any examination of title, excise tax and recording fees. Any announcements made at the sale, including postponement of the sale and withdrawal of the real estate from sale, will take priority over published notices.
