The object of the above entitled action is a civil action filed on September 24, 2024 for payment of services that were never completed in the amount of $1,400.00 plus costs.
And it appearing by an affidavit filed in this action that Plaintiff has been unable to effect service on Byron Sylvester Gayle, 2100 Lost Pond Ct., Middletown, VA 22645 by certified mail it is ordered that Byron Sylvester Gayle do serve upon Morgan County Magistrate Court, K.M. Ambrose, magistrate, whose address is 77 Fairfax Street, Berkeley Springs, WV 25411, an answer or other defense to the complaint filed in this action on or before December 17, 2024, otherwise judgment by default will be taken against Byron Sylvester Gayle at any time thereafter. A copy of said complaint can be obtained from the undersigned Clerk at her office.
