ORDER OF PUBLICATION
The Petitioner, pursuant to Rule 4(e)(1)(E) of the West Virginia Rules of Civil Procedure for Trial Courts of Record, has petitioned this Court pursuant to a VERIFIED PETITION OF THE HUNTINGON NATIONAL BANK TO EXERCISE RIGHTS AND REMEDIES UNDER ITS DEED OF TRUST AND FOR AN APPOINTMENT OF A GUARDIAN AD LITEM and for an Order of the Court which allows Huntington to exercise all rights and remedies under its Deed of Trust, which include, but are not limited to, foreclosure and public auction of the property in accordance with the applicable laws of the State of West Virginia.
It is, therefore, ORDERED and ADJUDGED, pursuant to the Order of the Circuit Court of Marion County, West Virginia, dated April 5, 2016, that the Respondent, Avelino I. Hipol, be served notice of the proceedings by Order of Publication, and pursuant to Order dated April 21, 2016, that the Respondent, Edita P. Hipol, be served notice of the proceedings by Order of Publication and that if the Respondents appear and defend on or before the hearing date set forth below or judgment by default may be rendered against them, at any time thereafter. Further, any written response or answer to this Petition shall be forwarded to Petitioner’s counsel, Philip B. Hereford, 405 Capitol Street, Suite 306, Charleston, West Virginia 25301, prior to the scheduled hearing on this Petition.
It is further ORDERED, pursuant to Court Order, that a hearing be held on Petitioner’s Petition and any responses or objections thereto, on the 16th day of June, 2016 at 11:00 o’clock a.m., before the Honorable Patrick N. Wilson, in the Marion County Courthouse, Fairmont, West Virginia, at which time the named Respondents and any Unknown Parties may appear to represent and protect their interests.
