In execution of a Deed of Trust in the original principal amount of $57,624.00, dated June 18, 2010 recorded in the Clerk’s Office of the Circuit Court of the Tazewell County, Virginia, in Document No. 100002070, in Book No. 1076, at Page 0815, default having occurred in the payment of the Note thereby secured and at the request of the holder of said Note, the undersigned Substitute Trustee will offer for sale at public auction at the entrance to the Circuit Court of Tazewell County, 135 Court Street, Tazewell, on October 9, 2019 at 10:30 AM the property described in said deed, located at the above address and briefly described as:
First: The northern portion of Lots 19 and 20, Block 1, Peery Heights, tax map # 094A202010019-0020; and
Second: Beginning at a point on the south side of Orchard Street and corner to said Lot No. 18 and No. 19; thence S. 3deg. 10′ W. 120.5 feet with line between said Nos 18 and 19 to a point on said line; thence 89deg. 25′ W. 127.3 feet through said Lots 14 to 18 inclusive to a point at or near a fence post on the East side line of Russell Street; thence N. 3deg. 10′ E. 99.21 feet with the East line of said Russell Street to a point at the intersection of said line with the South side line of said Orchard Street; thence N. 81deg. 10′ E. 130.0 feet along the South side line of said Orchard Street and the North ends of said Lots Nos. 14 to 18 inclusive to the beginning, tax map # 094A202010017A-0018A, with improvements thereon.
Excepting and reserving the property of record in the Clerk’s Office of the Circuit Court of Tazewell County, Virginia, in Deed Book 500, Page 528.

Subject to any and all covenants, conditions, restrictions, easements, and all other matters of record taking priority over the Deed of Trust, if any, affecting the aforesaid property.

TERMS OF SALE: CASH: A deposit of $20,000.00 or 10{4ceb532c6f579389df471c6c1e832caf2346b74dc60fcbf6aabd4d29df3baf9c} of the sales price, whichever is lower, cash or certified check will be required at the time of sale, but no more than $10,000.00 of cash will be accepted, with settlement within fifteen (15) days from the date of sale. Sale is subject to post sale confirmation that the borrower did not file for protection under the U.S. Bankruptcy Code prior to the sale which affects the validity of the sale, as well as to post-sale confirmation of the status of the loan with the loan servicer including, but not limited to, determination of whether the borrower entered into any repayment agreement, reinstated or paid off the loan prior to the sale. In any such event, the sale shall be null and void, and the Purchaser’s sole remedy, in law or equity, shall be the return of his deposit without interest.
