Interior of the building will be high bay open space along with masonry construction for locker rooms, restrooms, storage and an open indoor turf athletic training area.

The Work for Contract #1 – Site Earthwork & Grading will be substantially complete by March 1, 2018 and completed and ready for final payment by March 30, 2018. Liquidated damages shall be $1,500.00 per day.

The Work for Contract #2 – Student Athletic Building will be substantially completed within 90 days after the date when the Contract Times commence to run, and completed and ready for final payment within 120 days after the date when the Contract Times commence to run. Liquidated damages shall be $1,000.00 per day.

Pursuant to WV Code

The Kanawha County Deputy Sheriff’s Civil Service Commission announces Promotional Testing for all ranks of the Kanawha County Sheriff’s Office. Any promotion shall be filled by appointment from the list of eligibles. To be placed on the list of eligibles, one must do the following:

1) Every vacancy in positions on the Sheriff’s Office of the County shall be filled in accordance with the State Civil Service Law and the Kanawha County Deputy Sheriff’s Civil Service Rules and Regulations.
2) Deputies who have completed at least two (2) years service in a grade shall be eligible to apply for promotion. Said two-year period shall be the two years preceding the last day on which applications for promotion to a position may be accepted.

Please take notice that the Council of the City of Charleston is considering amending and reenacting Sections 2-734, 2-737, and 2-738 of the City Code of the City of Charleston, amending the effective date for an increase in the City’s Service Fee previously approved on July 20, 2015. The subject matter and general titles of the proposed ordinance are listed below in the text of the ordinance. The proposed final vote on the proposed amendments to the ordinance will take place on September 18, 2017 at 7:00 p.m. in the Council Chambers, City Hall. Members of the public may inspect copies of the proposed ordinance at the City Clerk’s Office in City Hall. Interested parties may appear at the meeting and be heard with respect to the proposed ordinance. In the event thirty percent of the qualified voters of the City of Charleston by petition duly signed by them in their own handwriting and filed with the City Clerk of Charleston on or before forty days after the adoption of the ordinance, petitioning against the following ordinance, the ordinance shall not become effective until it shall be ratified by a majority of the legal vote cast thereon by the qualified voters of the City of Charleston at a regular municipal election or special municipal election, as the governing body shall direct.

Bill No.7757: A Bill to amend and reenact Sections 2-734, 2-737, and 2-738 of the City Code of the City of Charleston, as amended, amending the effective date for an increase in the City’s Service Fee previously approved by Bill Number 7661 on July 20, 2015.

WHEREAS, the City Council now finds that it is necessary, reasonable, not excessive, and warranted based upon the cost of, need for, and reasonable allocation of the fee payor’s usage of the municipal services contemplated by the Code, that the previously approved fee increase from $2.50 to $3.00 commence on January 1, 2018; now therefore,

Be it Ordained by the Council of the City of Charleston, West Virginia:

That the Council for the City of Charleston hereby amends and reenacts Sections 2-734, 2-737, and 2-738 of the City Code of the City of Charleston, as amended, to read as follows:

Sec. 2-734. – Findings.

(a) The city council of the city finds that the city provides to all individuals within its borders certain services, whether they are residents employed within the city, or individuals living outside the city and employed within the corporate boundaries of the city.

(b) The city council of the city finds that such services include police protection and traffic and street maintenance.

(c) The city council of the city finds that such services are within the authority and are the responsibility of the Municipal Government of the City of Charleston as provided under the general laws of the State of West Virginia.

(d) The city council of the city finds that since such services are essential to the creation and maintenance of those jobs which provide livelihood to all individuals employed within the city, as well as to the property interests of residents and visitors to the city, it is therefore reasonable to derive a portion of the cost of providing and maintaining such services from said individuals.

(e) The city council of the city finds that W. Va. Code § 8-13-13 provides that every municipality has the plenary power and authority to provide by ordinance for the installation, continuance, maintenance or improvement of such services, to make reasonable regulations with respect thereto, and to impose by ordinance upon the users of such services reasonable rates, fees and charges to be collected in the manner prescribed in the ordinance.

(f) The city council of the city finds that all of those individuals, who use, enjoy and benefit from these services, should bear an equitable share of the costs thereof.

(g) The city council of the city finds that the imposition of the city service fee established herein is a reasonable system of distributing the costs to all of the users that the city can reach through reasonable and prudent means and legislation.

(h) The city council of the city finds that the legislature of the State of West Virginia has conferred upon municipalities the plenary power to enact reasonable administrative provisions to ensure the efficient, orderly and equitable implementation and collection of the service fees from all users.

(i) The city council of the city finds that it is in the best interests of the citizens of the city and the users of city services to enact this article to impose a city service fee.

(j) The city council of the city finds that there are tens of thousands of individuals who benefit from municipal services who are not owners of property or residents of the city, but who are employed within the city.

(k) The city council of the city finds that employers located within the city possess important employment information necessary to properly enforce certain aspects and provisions of this article and that, therefore, reasonable regulations concerning obtaining certain information from such employers shall be a necessary and important part of the administration of the city service fee.

(l) The city council of the city finds that raising the fee from $2.00 to $2.50 beginning the calendar week of January 3, 2016, and continuing through December 31, 2017, and from $2.50 to $3.00 beginning the calendar week of January 1, 2018, and continuing thereafter, is reasonable, not excessive, and warranted based upon a reasonable allocation of the fee payers’ usage of the municipal services contemplated herein.

Sec. 2-737. – Imposition of fee; rate.

Beginning January 3, 2017, and continuing through December 31, 2017, there is hereby imposed a city service fee upon each employee and self-employed individual at the rate of $2.50 per calendar week of employment within the city. Beginning January 1, 2018, and continuing thereafter, the fee rate imposed shall be $3.00 per calendar week of employment within the city. No individual shall pay the fee more than once for the same week of employment regardless of multiple employment. The fee imposed by this article is in addition to all other fees imposed by the city.

Sec. 2-738. – Effective date.

The imposition of the city service fee of $2.50 per calendar week of employment within the city shall take effect beginning January 3, 2016, and shall remain in effect up to and including December 31, The imposition of the city service fee of $3.00 per calendar week of employment within the city, representing an increase from $2.50 to $3.00 as set forth in Sec. 2-737 herein, shall take effect beginning January 1, 2018, and continue thereafter.

Notice is hereby given by the West Virginia Division of Highways, Planning Division, that consulting services will be utilized for non-traditional transportation projects including federal aid funded projects for the Transportation Alternatives and Recreational Trails programs as well as similarly state funded projects. These services may include preliminary engineering design, relevant environmental documents and analyses, final design engineering, construction engineering/management, and/or inspection services. The project types may include on- and off-road pedestrian and bicycle facilities, infrastructure projects for improving non-driver access to public transportation and enhanced mobility, community improvement activities, and environmental mitigation as well as motorized and nonmotorized recreational trails projects. Projects will be located throughout the State. This work shall be performed under a Statewide (On-Call) Agreement.

Method of payment will be lump sum per assignment or specific rate of pay.

Multiple firms may be selected for this work.

Firms interested in being considered for providing these services must submit a “Letter of Qualification” and unpriced prospectus to Mr. C. Elwood Penn, P. E., Director, Planning Division, Division of Highways, 1900 Kanawha Boulevard East, Building Five, Room-A450, Charleston, West Virginia 25305 or preferably by e-mail to [email protected] prior to 4:00 p.m. on September 11, 2017.

As a minimum, the prospectus shall include the following evaluation factors:

1. Professional qualifications necessary for satisfactory performance of the required work shall be provided for that person-in-charge of overseeing the work. That person shall be located within the office where the work is to be performed, and shall demonstrate sufficient past experience performed for the State of West Virginia, Division of Highways related to design and plan development to be provided. This individual shall be readily accessible to the Division, preferably located in-state.
2. Specialized experience and technical competence in the type of work required.
3. Capacity consideration shall be made on the firm’s ability to accomplish the work within the Division’s required schedule time frame; personnel dedicated to perform such work.
4. Past performance on contracts with Government agencies and private industry in terms of cost control, quality of work, and compliance with performance schedules.
5. Knowledge and understanding of the scale and requirements of non-traditional transportation projects throughout the entire project life cycle.

In addition to the above evaluation factors, the prospectus shall include, as a minimum, the following items:

1. A completed copy of the Division’s Consultant Confidential Qualification Questionnaire, if not already on file with the Planning Division for the calendar year 2017, dated January 1, 2017 or later.
2. Location of office in which the work will be performed.

Notice is hereby given by the West Virginia Division of Highways, Planning Division, that consulting services will be utilized for non-tradition transportation projects including federal aid funded projects for the Transportation Alternatives and Recreational Trails programs as well as similarly state funded projects. These services may include preliminary engineering design, relevant environmental documents and analyses, final design engineering, construction engineering/management, and/or inspection services. The project types may include on- and off-road pedestrian and bicycle facilities, infrastructure projects for improving non-driver access to public transportation and enhanced mobility, community improvement activities, and environmental mitigation as well as motorized and non-motorized recreational trails projects. Projects will be located throughout the State. This work shall be performed under a Statewide (On-Call) Agreement.

Method of payment will be lump sum per assignment of specific rate of pay.

Multiple firms may be selected for this work.

Firms interested in being considered for providing these services must submit a “Letter of Qualification” and unpriced prospectus to Mr. C. 3) Capacity consideration shall be made on the firm’s ability to accomplish the work within the Division’s required schedule time frame; personnel dedicated to perform such work.
4) Past performance on contracts with Government agencies and private industry in terms of cost control, quality of work, and compliance with performance schedules.

The West Virginia Department of Environmental Protection (DEP) is announcing an opportunity for public comment on the proposed West Virginia NOx SIP Call Non-EGU Budget Demonstration.
45CSR40, Control of Ozone Season Nitrogen Oxides Emissions, establishes a NOx emissions budget of 2,184 tons for subject units that have a maximum design heat input greater than 250 mmBtu/hr, excluding any unit subject to the federal Cross-State Air Pollution Rule (CSAPR) NOx Ozone Season Trading Program, or an equivalent approved trading program. The rule requires the DEP to demonstrate to the U.S. Environmental Protection Agency (EPA) that through the imposition of ozone season NOx limitations, and assumption of maximum operating capacity or use of a limitation on operating time during the ozone season, NOx emissions will not exceed the budget. West Virginia clearly demonstrates that the budget cannot be exceeded, considering the legally enforceable NOx emissions limits of the permitted subject units. The legally enforceable maximum potential ozone season NOx emissions total of 941 tons is less than 50{4ceb532c6f579389df471c6c1e832caf2346b74dc60fcbf6aabd4d29df3baf9c} of the total budget.
Upon finalization of the NOx SIP Call Non-EGU Budget Demonstration, the DEP will submit the demonstration to the EPA as a supplement to the West Virginia’s State Implementation Plan (SIP) revision for 45CSR40, Control of Ozone Season Nitrogen Oxides Emissions, which was received by the EPA on July 15, 2016.
Copies of the NOx SIP Call Non-EGU Budget Demonstration and supporting documentation may be viewed between 8:30 a.m. and 4:30 p.m. beginning September 1, 2017, at the DEP Division of Air Quality, located at 601 57th Street, SE, Charleston, WV 25304, or they may be viewed electronically on the Division of Air Quality website under the public notice and comment section: www.dep.wv.gov/daq/.
The agency is accepting public comment only on the draft NOx SIP Call Non-EGU Budget Demonstration. A public comment period and public hearing have already concluded for the associated rule 45 C.S.R. 40. Send written comments to be included in the formal record to W.
