And it appearing by an affidavit filed in this action that even after using due diligence, the plaintiff was unable to discover the residence or whereabouts of the defendant. The defendant was not served, either personally or by way of service upon an appropriate family member, after serve was attempted by United Stated Postal Service via Certified Restricted Mail to the address in which the defendant resides or is located. It is ordered that James E. Anness Estate do serve upon Chris Sperry, magistrate, whose address is 750 Fifth Avenue, Huntington, WV 25701, an answer or other defense to the complaint filed in this action on or before May 8, 2022, otherwise judgment by default will be taken against James E.
