ORDER OF PUBLICATION REGARDING PETITION FOR EMINENT DOMAIN TO: UNKNOWN HEIRS OR BENEFICIARIES OF THE ESTATE OF MAGGIE KIRBY and FULTON a F.O. KIRBY, Respondents. You are hereby notified that on the 28th day of April, 2022, the Petitioner, the City of Milton, filed with the Circuit Clerk of Cabell County, West Virginia, an Application of the City of Milton, a West Virginia Municipality to Condemn Land for Public Use, seeking to obtain and acquire a temporary construction easement for the construction of a sewerline in, on, over, and across the following described property: The following described property is situate in City of Milton District, Tax map 6, Parcel 28, Cabell County, West Virginia, more particularly bounded and described as follows: Being a temporary construction easement and access containing 276 square feet over the lands of the Maggie and Fulton Kirby Estates (Deed Book 332, at Page 442 and Deed Book 156, at Page 290). Further, the city of Milton has heretofore deposited with the Circuit Clerk of the Cabell County its estimate as to the fair market value of the interest sought to be condemned including damages, if any, to the residue, pursuant to West Virginia Code 54-2-14a, and has obtained from the Court an Order granting Plaintiff a Right of Immediate Entry. A copy of the Petition filed by the Petitioner may be obtained from the Circuit Clerk of Cabell County. You are further notified that a response to the Petition must be filed within thirty (30) days from the date of the second publication herein or default judgment may be rendered against you granting the City the rights and interests sought in the Petition.
