Activity:
To operate and maintain an existing 4.99 million gallon per day (MGD) combined sewage collection and wastewater treatment system. This system is designed to serve a population equivalent of about 50,000 persons within the City of Elkins, the Leadsville Public Service District, the Midland Public Service District and discharges treated and disinfected wastewater to the Tygart Valley River via Outlet 001 at milepoint 66.5. Also, to operate and maintain the appropriate disposal systems, best management practices, and the mandated CSO nine minimum controls for the direct discharge of sanitary wastewater and storm water from Combined Sewer Overflow (CSO) Outlets C002-C008, C011, and C016-C020 to the Tygart Valley River and Outlet C009 to an unnamed tributary of Craven Run of Leading Creek, a tributary of the Tygart Valley River. These CSO Outlets are permitted to discharge only when the hydraulic capacity of the collection system is exceeded during wet weather events.
Also, to operate and maintain appropriate disposal systems and best management practices for the direct discharge of the treatment facility’s untreated storm water runoff via Outlet 002 to the Tygart Valley River.
The City of Elkins also accepts non-domestic pretreatment waste from the Elkins Water Treatment Plant, the Elkins Landfill, Lohr and Barb Funeral Home, Tomblyn’s Funeral Home, and Big Timber Brewing Company.
Also, to incorporate the requirements relative to Title 33, Series 2 of the West Virginia Legislative Rules for the processing and disposal of sewage sludge generated by the wastewater treatment plant. Sewage sludge generated and/or processed at the permittee’s facility shall be land applied, provided that the sewage sludge shall not be applied in a manner that exceeds the agronomic or lifetime loading rates. These land application site(s) meet all other regulatory standards and are identified as follows: Terry Biller Farm, located at Salt Lick Road, Montrose, WV; Grace Sines (Leased), located on Charlie Phillips Road, Montrose, WV; Howard Phillips Farm, located on Charlie Phillips Road, Montrose, WV; John Wilson, located at Elliott’s Ridge Road, Elkins, WV; Howard Howell Farm, located on Findley Road, Norton, WV; Greg Rolling Farm, located at Midway Road, Belington, WV; McCoy Bothers Hipple Farm, located at Danner Road, Belington, WV; and Kevin Lyons Farm, Route 92, Belington, WV. Also, sewage sludge generated and/or processed at the permittee’s facility shall be disposed of at a sanitary landfill by placing the sewage sludge in the landfill cell.
An antidegradation review has been conducted and Tier 1 protection is provided for the uses specified in Title 47, Series 2, Section 6 for Outlet No. 001. Tier 1 protection shall be afforded for the uses specified in Title 47, Series 2 for Outlet Numbers C002 through C009, C011, C016 through C020 (15 CSO relief points), through implementation of the facility’s CSO long-term control plan. Compliance with the antidegradation requirements for stormwater Outlet No. 002 shall be afforded through the implementation of Best Management Practices.

Compliance with the Combined Sewer Overflow requirements shall be attained in accordance with Consent Order No. 2:11-cv-00061 that has been negotiated between the parties. The Consent Decree was signed by the court on the 22nd day of September 2011 with final entry in the US District Court for Northern District of WV. The entry of the Consent Decree represents the Division’s final approval of the City’s revised LTCP. The Consent Decree mandates the implementation of the April 2011 CSO Long Term Control Plan with a schedule for achieving said compliance with the final terms and conditions of this permit.
On the basis of review of the application, the “Water Pollution Control Act (Chapter 22, Article 11-8(a)),” and the “West Virginia Legislative Rules,” the State of West Virginia will act on the above application.
Any interested person may submit written comments on the draft permit and may request a public hearing by addressing such to the Director of the Division of Water and Waste Management within 30 days of the date of the public notice. Such comments or requests should be addressed to:

The public comment period begins May 19, 2022 and ends June 18, 2022.
Comments received within this period will be considered prior to acting on the permit application. Correspondence should include the name, address and the telephone number of the writer and a concise statement of the nature of the issues raised. The Director shall hold a public hearing whenever a finding is made, on the basis of requests, that there is a significant degree of public interest on issues relevant to the Draft Permit(s). Interested persons may contact the public information office to obtain further information.
