The purpose of this lawsuit is to determine whether the heirs of Napolean Bonaparte Hutton have an ownership interest in the timber on approximately 57 acres of real estate in Middle Fork District of Randolph County, West Virginia pursuant to a reservation of timber in a deed conveying the real estate to “Charles Fincham and Angeline Fincham and their eight living children” by Wirt C. Ward, Rose Ward, and Napolean Bonaparte Hutton on May 27, 1907 recorded in the office of the Clerk of the Randolph County Commission in Deed Book 90 at page 270.
NOTICE TO THE HEIRS OF NAPOLEAN BONAPARTE HUTTON
It appearing by affidavit filed in this action affirming that the heirs of Napolean Bonaparte Hutton are unknown, cannot be identified and cannot be located despite due diligence, it is hereby Ordered that the heirs of Napolean Bonaparte Hutton shall serve an Answer to the Amended Complaint filed in the office of the Clerk of the Circuit Court of Randolph County, West Virginia upon Plaintiffs’ attorney James R. Fox at Fox Law Office, PLLC, 3359 Teays Valley Road, Hurricane, WV 25526 on or before July 24, 2026. A copy of the Amended Complaint may be
obtained from the Circuit Clerk of Randolph County, West Virginia. Failure to file an Answer or other response by July 24, 2026 to the Amended Complaint may result in judgment being entered against you for the relief requested in the Amended Complaint. Notice is further given that a hearing is set in this matter for July 28, 2026 at 11:00 a.m. before the Honorable Jaymie Wilfong, Randolph County Circuit Court Judge in the Division II Courtroom.
