TRUSTEE’S SALE OF
VALUABLE REAL ESTATE
The undersigned Substitute Trustee, by virtue of the authority vested in him by that certain Deed of Trust, dated March 17, 2000, and duly recorded in the Office of the Clerk of the County Commission of Wood County, West Virginia, on March 24, 2000 in Document No. 313120, in Book No. 884, at Page 177, and corrected in Corrective Affidavit recorded on November 4, 2022, in Instrument No. 88295458, in Book No. 2264, at Page 445, Daniel Rader and Cynthia Lou Rader did convey unto Bobbie J. Brocious, Trustee(s), certain real property described in said Deed of Trust; and the beneficiary has elected to appoint Seneca Trustees, Inc., as Substitute Trustee; and default having been made under the aforementioned Deed of Trust, and the undersigned Substitute Trustee having been instructed by HSBC Bank USA, National Association as Trustee in trust for Citigroup Mortgage Loan Trust Inc., Asset Backed Pass Through Certificates Series 2003-HE3 to foreclose thereunder, will offer for sale at public auction at the front door of the Wood County Courthouse in Parkersburg, West Virginia, on

the following described real estate, together with its improvements, easements and appurtenances thereunto belonging, situate in 03 – Lubeck District, Wood County, West Virginia, and more particularly described as follows:
All those certain lots, tracts or parcel so land situate, lying and being in the District of Lubeck, County of Wood, and State of West Virginia, being more particularly bounded and described as follows:
TRACT ONE: BEGINNING at a point in the easterly line of Comer Street at the northwest corner of a lot of 0.17 acres and distant 333.95 feet from the northeast corner of Hill Avenue and said Comer Street measured along the easterly line of said Comer Street; thence with one of the lines of said lot of 0.17 acres S. 76 degrees E. 90.5 feet to a stake in the old fence line; thence N. 1 degrees E. along the old fence line 75 feet to a stake; thence N. 76 degrees W. 91 feet to said Comer Street; thence along the east side of said Comer Street S. 3-1/4 degrees W. 75 feet to place of beginning, containing 15/100 acres.
TRACT TWO: BEGINNING on the west side of a 20-foot street, presently known as Comer Street, 331.35 feet north of Hill Street, measured along the west side of said 20-foot street; thence N. 77 degrees 25′ W. 157.8 feet; thence N. 3 degrees W. 20 feet; thence N. 83 degrees E. 155.5 feet; thence N. 0 degrees 10′ W. 75 feet tot he place of beginning, a plat of said lot, tract or parcel of land being of record in the Office of the Clerk of the County Commission of Wood County, West Virginia, Plat Book No. 8, at Page 34, to which reference is hereby made for a more particular description.
The said grantor does hereby grant and convey to the grantees, and easement or right of way and along a strip of land 12 feet wide across the westerly end of the lands of D. K. Comer extending from the southerly side of the land hereby conveyed to and connecting with a 12-foot alley or outlet extending between Hill Street and the lands of J. V. Carney, for purposes of a roadway, said easement or right of way to continue so long as said 12 foot alley or outlet remains free and unobstructed for purposes of a roadway.
There is excepted and reserved from the land hereby conveyed, for the purpose of a roadway, as set out in a deed bearing date the 27th day of March, 1964, and of record in the aforesaid Clerk’s Office in Deed Book No. 486, at Page 518, more particularly described as follows:
BEGINNING at a point in the southerly boundary of the land hereby conveyed 145.8 feet west of a 20-foot Street, presently known as Comer Street; thence N. 70 degrees 25′ W. 12 feet; thence N. 3 degrees W. 20 feet; thence N. 83 degrees E. 12 feet; thence in a southerly direction to the place of beginning.
This conveyance is subject to all easements, rights of way, restrictions, reservations and protective covenants, including but not limited to all oil, gas and mineral exceptions, reservations and leases, appearing in the chain of title, and upon the plat above referred to. Being the same property conveyed unto Daniel Garren Rader and Cynthia Lou Rader by deed dated April 20, 1993, recorded in Deed Book 918 at Page 419.
At the time of the execution of the Deed of Trust, this property was reported to have an address of: 534 Comer Rd, Parkersburg, WV 26101-5404.
The referenced real estate will be conveyed with no covenants of warranty, and subject to all covenants, restrictions, easements, rights of way and reservations which may be a matter of record in the aforesaid Clerk’s Office or visible upon the ground, all prior liens and encumbrances, including, without limitation, liens for real estate taxes, incinerator, sanitary and sewer charges. The purchasers at the sale shall be responsible for paying the recording costs and also the tax on the privilege of transferring real property (the cost of the tax stamp to be affixed to the deed). The purchasers shall be responsible for payment of all real estate taxes.
The subject property will be sold in “AS IS” condition. The Substitute Trustee shall be under no duty to cause any existing tenant or person occupying the subject property to vacate said property.
TERMS: $3500.00 in cash and/or certified funds as deposit at the time of sale with the balance due and payable within 30 days of the day of sale.
FEDERAL TAX LIEN: In the event that there are Federal Tax Liens against the property, the United States would have the right to redeem the property within a period of 120 days from the date of such sale or the period allowable for redemption under local law, whichever is longer.
Pursuant to the Deed of Trust, the Trustee may postpone the sale by public announcement at the time and place designated or by posting a notice of the same, and act by agent in the execution of the sale. The parties secured by the Deed of Trust reserve the right to purchase the property at such sale.
