All that certain lot, tract and parcel of real estate situate, lying and being in the City of Parkersburg, Wood County, West Virginia, more particularly bounded and described as follows: BEGINNING at a point on the northerly side of St. Marys Pike (now 36th Street) at a stake in the common line of Lots Nos. 2 and 3 of Camden Farms Addition No. 2 North Parkersburg, a plat of which is recorded in the Office of the Clerk of the County Court of Wood County, West Virginia, in Plat Book No. 2, at Page 51; thence with the common line of Lots Nos. 2 and 3 of said Addition in a northerly direction three hundred seventy-six and sixty-nine hundredths (376.69) feet to a stake in the southern line of a sixteen-foot alley; thence in an easterly direction fifty (50) feet to a stake in the southern line of said alley, equally distant between the common line between Lots Nos. 2 and 3 and the common line between Lots Nos. 3 and 4 of said Addition; thence in a southerly direction parallel with the common lines between said Lots Nos. 2 and 3 and Lots Nos. 3 and 4 equally distant between the same, three hundred fifty-seven and sixty-eight hundredths (357.68) feet to a stake in the northerly side of St Marys Pike (now 36th Street) in a westerly direction fifty-four and four hundred sixty-five thousandths (54.465) feet to the place of beginning, according to plat of said lot made by L.G. King, husband and wife, filed in Deed Book 416, Page 98, Records of the Office of the Clerk of the County Commission of Wood County, West Virginia, the premises have the benefit of and are subject to the following:

A right of way in and over that certain parcel of land situate and being in the City of Parkersburg, County of Wood, State of West Virginia, more particularly described as follows:
BEGINNING at a point in the northerly line of 36th Street, said point being in the common line between the land of the parties of the first part and the parties of the second part, and thence with said common line between said lands in a northerly direction, 205.09 feet to a point; thence at right angles and in an easterly direction 4 feet to a point; thence in a southerly direction, parallel with the first line hereinbefore described, 203.36 feet to the northerly line of 36th Street, 4.36 feet, more or less, to the place of beginning. A right of way in and over that certain parcel of land situate and being in the City of Parkersburg, County of Wood, State of West Virginia, more particularly described as follows: BEGINNING at a point in northerly line of 36th Street, said point being in the common line between the lands of the parties of the first part and parties of the second part and thence with said line in a northerly direction 205.09 feet to a point; thence at right angles and in a westerly direction 4 feet to point thence in a southerly direction parallel with the first line hereinbefore described 206.82 feet to the northerly line of 36th Street and thence with the new northerly line of 36th Street, in an easterly direction, 4.36 feet, more or less, to the place of beginning.

It is intended hereby to establish, and there is hereby established a joint right of way in and over the eight-foot strip of and along the common line between the properties of the parties of the first part and parties of the second part as shown on the plat prepared by L.G. Merrill, dated November 12, 1957, and recorded herewith, with such right of way to be used jointly by the parties to this deed and the successors in title to their respective interests as appurtenance to their respective lands.
Such right of way shall be for ingress and egress to and from the respective lands of the parties hereto from 36th Street and the right of way, for the entire distance thereof, shall be enjoyed and used as common driveway. Neither of the parties hereto, or their successors, shall have superior rights to the use of any portion of said driveway and said driveway shall not be used or blocked by any or either party hereto to the prejudice of the other parties hereto. All rights and obligations with respect to said driveway shall be covenants running with the land of the respective parties hereto.
The premises are subject to the following, as set forth in a Deed from Ira F. Congrove and Bessie B. Congrove, his wife, to James R. Reger and Dorothy G. Reger, his wife, dated March 8, 1940, filed March 13, 1940, in Deed Book 226, Page 631, Records of the Office of the Clerk of the County Commission of Wood County, West Virginia.
“The said parties of the second part expressly covenant and agree for themselves, their grantees and successors in title that no residence will be erected on said lot within less than 20 feet of the said St. Mary’s Pike.” The premises are subject to a sanitary sewer Right of Way Agreement from Earl P. King and Mary M. King, husband and wife, to the City of Parkersburg, dated September 5, 1990, filed September 6, 1990, in Deed Book 889, Page 175, Record of the Office of the Clerk of the County’ Commission of Wood County, West Virginia. This conveyance is made subject to all easements, rights of way, restrictions, reservations and protective covenants, including but not limited to all oil, gas and mineral exceptions, reservations and leases, appearing in the chain of title.
At the time of the execution of the Deed of Trust, this property was reported to have an address of: 1923 36th St, Parkersburg, WV 26104.
The referenced real estate will be conveyed with no covenants of warranty, and subject to all covenants, restrictions, easements, rights of way and reservations which may be a matter of record in the aforesaid Clerk’s Office or visible upon the ground, all prior liens and encumbrances, including, without limitation, liens for real estate taxes, incinerator, sanitary and sewer charges. The purchasers at the sale shall be responsible for paying the recording costs and also the tax on the privilege of transferring real property (the cost of the tax stamp to be affixed to the deed). The purchasers shall be responsible for payment of all real estate taxes.
The subject property will be sold in “AS IS” condition. The Substitute Trustee shall be under no duty to cause any existing tenant or person occupying the subject property to vacate said property.
TERMS: $9000.00 in cash and/or certified funds as deposit at the time of sale with the balance due and payable within 30 days of the day of sale.
FEDERAL TAX LIEN: In the event that there are Federal Tax Liens against the property, the United States would have the right to redeem the property within a period of 120 days from the date of such sale or the period allowable for redemption under local law, whichever is longer.
Pursuant to the Deed of Trust, the Trustee may postpone the sale by public announcement at the time and place designated or by posting a notice of the same, and act by agent in the execution of the sale. The parties secured by the Deed of Trust reserve the right to purchase the property at such sale.
