NOTICE OF TRUSTEE’S SALE Notice is hereby given that by virtue of authority vested in the undersigned Trustee by that certain deed of trust executed by ARBES PROPERTIES & LANDDEVELOPMENT, LLC and CHAD J. ARBES to KERRY E. ADKINS and MICHAEL D. STEPHENS, JR., dated the 22ND day of OCTOBER, 2020, securing HUNTINGTON FEDERAL SAVINGS BANK, and recorded in the office of the Clerk of the County Commission of Cabell County, West Virginia, in Trust Deed Book No. 2803, at page 50, by which was conveyed to the said Trustees the hereinafter described real estate, to secure the payment of a certain note set out and described therein, and default having been made in the payment of said note,and the said KERRY E. ADKINS and MICHAEL D. STEPHENS, JR., Trustees, having been requested so to do by the owner and holder of said note, shall sell to the highestand best bidder, on MARCH 1, 2023 at 10:00 A.M., at the EAST FRONT DOOR of the Comt House of Cabell County, WestVirginia, the following describedreal estate: All that ce1tain lot, piece or parcel of land situate in Barboursville District (formerly referred to as Guyandotte District),Cabell County, West Virginia, known and designated on a mapof SECTION 4, CASCADE LANDOWNERS ASSOCIATION, a copy ofwhich map was filedin the Office of the Cabell County Clerk on 17 November,1981 in Map Book 10 as Map 1, as Parcel 170, and being more particularly described as follows: BEGINNING at a point in the west line of CascadeDrive, which point is N. 23 deg. 57′ E., 45.73 feet from the corner between Section 4 and Section 2 ofCascade Land Owners Association in the said line of Cascade Drive; thence withsaid line of Cascade Drive, N. 23deg. 57′ E. 33.27feet; thence N. 66 deg.03′ W., 100 feet; thence S. 23 deg. 57′ W., 33.85 feet; thence S. 66 deg. 23′ E., passing through the center of an 8inch masonry party wall, 100 feet to the point of BEGINNING; TOGETHER WITH a perpetual easement for the use and maintenance of the common wallbetween Parcels 170 and 172, as shownand designated on the aforesaid map,as the same now exists, for subjacent, adjacent, andlateral support; EXCEPTINGHOWEVER, a perpetual easementfor the use and maintenance of the common wall between parcels 170 and 172 as shownand designated on theaforesaid map as the same nowexists forsubjacent, adjacent and lateral support of Parcel172; TOGETHER WITH an easement for electriclines asthe same now exists; EXCEPTING, FURTHER, HOWEVER, for the benefit of Parcel172, an easement for electric lines as the same now exists.
