Smith a Carless Smith Ruth Smith Wanca Beatrice Flodella Smith Bower Margaret (Meg) Ellen Bower Seal Sallie Mustard Smith Dunlap Murphy Kathleen Bee Smith Lilly Defendants, all unknown descendants, heiall unknown descendants, heirs at law, devisees, successors, or assignees of the above named persons and of ORDER OF PUBLICATION The object of the above-entitled action is for Plaintiffs to obtain partition of the land situate at 1362 Hall Street, Huntington, Cabell County, West Virginia and more particularly described as follows: All that certain lot, piece or parcel of land situate in that part of the City of Huntington, Cabell County, West Virginia, commonly known as Walnut Hills, and being a part of a tract of land conveyed by the Huntington Land Company to John B. Gallaher, Jr., and designated as tract #2, in a deed from F. W. Riggs, Special Commissioner, to the Huntington National Bank, dated June 2, 1923, and recorded in the Cabell County Court Clerk’s office, West Virginia, in Deed Book 206, page 109, which said property is known as 1362 Hall Street, and is bounded and described as follows: Beginning at the south-west comer of a lot conveyed to Emma E. Nunnally by W. F. Stephenson and wife, by deed dated July 1, 1919, and recorded in Deed Book 165, page 116; thence with the east line of Hall Street N. 19DEGREES 30′ W. 42 ‘A feet; thence leaving Hall Street N. 68DEGREES 28′ E. 202 A feet to a stake in the east line of said lot; thence with the same, S. 19DEGREES 30’ E. 34.8 feet to a stake at the south-east comer of said lot; thence S. 67DEGREES W 202 A feet to the point of beginning. It appearing by affidavit filed in this action that the Plaintiffs, herein, have used due diligence to ascertain the whereabouts of some of the Defendants, without success, it is ORDERED, that Defendants, above named, serve upon Bruce A. Toney, Plaintiff’s attorney, whose address is 1002 Third Avenue, P. O. Box 1835, Huntington, West Virginia 25719, an answer or other defense to the Complaint filed in this action on or before the 14th day of April, 2023, other judgment by default default will be taken against Defendants at any time thereafter.
