NOTICE OF TRUSTEE SALE OF VALUABLE REAL ESTATE

Pursuant to the authority vested in the undersigned by deed of trust dated the 28 th day of July, 2022, signed by Brittany J. Collins, to Golden & Amos, PLLC, Trustee, which said deed of trust is of record in the Office of the Clerk of the County Commission of Wood County, West Virginia, in Trust Deed Book 2252, at page 771, and Golden & Amos, PLLC, Trustee having been requested so to do by the Secured Creditor, and default having been made under the terms and conditions of said deed of trust, and the provisions in said deed of trust concerning acceleration having been complied with by the Secured Creditor and present holder of the note, said Trustee will sell at public auction at

9:00 o’clock a.m. on the
8 TH DAY OF MAY 2023

at the front doors of the Courthouse in Wood County in Tygart District, West Virginia the following described real estate:
Situate along the west side of Paddle Run Road West Virginia County Route #22, located on the waters of Paddle Run , located in and being a part of Tygart Tax District, Wood County, West Virginia, being more particularly founded and described as follows;

Beginning at a 1/2″ iron pipe (found) being the northwest corner of the John A. Litman and Tammy J. Litman 0.296 acre tract recorded in Deed Book 1089, page 19, (identified as Tract 1 – on plat in DB 886, PG 514) also being the southwest corner of the William A. and Deborah A. Kelley 1.919 acre parent tract as recorded in Deed Book 886 at page 512 (identified as Tract 2 – on plat in DB 886 PG 514.

Thence North 23 degrees 03 minutes 15 seconds west a distance of 68.04 feet leaving the line of the Parent Tract to a 5/8″ diameter capped iron rebar (set) beside a fence being the northwest corner of the 0.221 acre tract to be conveyed to Litman, THE TRUE POINT OF BEGINNING for this description:

Thence north 29 degrees 56 minutes 21 seconds west a distance of 181.62 feet along a new partition line through the parent tract to a 5/8″ diameter capped iron rebar (set); BESIDE A SECOND FENCE;

Thence north 30 degrees 05 minutes 44 seconds east a distance of 83.58 feet continuing along a new partition line through the parent tact to a 5/8″ diameter capped iron rebar set outside that fence.

Thence south 60 degrees 45 minutes 59 seconds east a distance of 109.85 feet continuing along a new partition line through the parent tract to a point in the centerline of Paddle Run Road being the easterly line of the parent tract, passing a 5/8″ diameter capped iron rebar (set) at 89.77 feet;

Thence south 26 degrees 45 minutes 27 seconds east a distance of 52.10 feet along the centerline of Paddle Run Road (being the line of the parent tract) to a point;

Thence south 28 degrees 42 minutes 30 seconds east a distance of 84.37 feet along the centerline of Paddle Run Road (being the line of the parent tract) to a point also being the northeast corner of 0.221 acre tract to be conveyed to Litman;

Thence south 63 degrees 26 minutes 54 seconds west a distance of 124.22 feet with the new common partition line of the 0.221 acre tract to be conveyed to Litman, and this tract to the TRUE POINT OF BEGINNING, passing a 5/8″ diameter capped iron rebar (set) at 13.85 feet;

Containing 0.566 acre (24,675 square feet) included 0.051 acres (2,213 squ ft) in the Paddle Run Road right of way.

Subject to all legal highways, rights of ways, reservations, protective covenants, utility easements, gas, oil, mineral leases and all restrictions of record in the chain of title.

Monuments described as (set) are iron rebar (5/8 inches diameter 30″ long), bearing red plastic caps inscribed “Douglass – PS 1241”

The bearings and distances used in the above description are based on the West Virginia State Plane Coordinate System, North Zone, NAD (83 (2011) epoch 2010, U.S. survey feet.

It is the intention of this notice to sell the secured property by proper description as was intended to be transferred and conveyed in the aforesaid deed of trust.

TERMS OF SALE: Cash in hand on day of sale or within 30 days of date of sale upon terms to be agreed upon between Trustee and successful bidder, time being of the essence; payment for unpaid real estate taxes to be assumed by the purchaser. The Trustee does not warrant title or fitness to this property; it is being purchased as is; this is a buyer beware sale and any buyer is advised to retain counsel before the sale. If there is any part of the process of sale which is found to be objectionable, the Trustee reserves the right to cancel the sale. No purchaser should take possession or make improvements in the premises until the Trustee deed is delivered or recorded. A third party purchaser at sale will be required to pay the purchase price plus all recording and transfer fees.

Trustee at sale is under no duty to cause any existing tenant or person occupying the subject property to vacate said property.

FEDERAL TAX LIEN: In the event that there are Federal Tax Liens against the property, the United States would have the right to redeem the property within a period of 120 days from the date of such sale or the period allowable for redemption under local law, whichever is longer.

The party(ies) secured by the Deed of Trust reserve the right to purchase the property at such sale. If the purchaser at sale is unable to complete the terms of purchase within 30 days, the Trustee reserves the right to transfer the property to the next highest bidder.

Any sale hereunder may be adjourned from time to time without any notice other than oral proclamation at the time and place appointed for this sale or by posting of a notice of same. Should the Trustee not appear at the time appointed for the sale and there is no notice posted of a continuance please contact the office of the Trustee to make further inquiry. Any sale may be conducted or adjourned by the designated agent or attorney of the Trustee. The undersigned is fully vested with the authority to sell said property as Trustee by instrument of record. Some Trustee sales may be conducted by a servicer required Auction Company. In that event, the auctioneer will be acting under an “Auction Services Agreement.”
