NOTICE OF SPECIAL COMMISSIONER’S SALE NOTICE OF SPECIAL COMMISSIONER’S SALE is hereby given pursuant to and by virtue of the authority vested in the Special Commissioner, Ryan Turner of Bellomy & Turner, L.C., by Order of the Circuit Court of Cabell County, West Virginia, entered December 14, 2022, in Civil Action No. 22-C- 286, in regard to enforcement of a Mortgage dated November 30, 2018, executed by Borrowers, Thomas Edward Hill and Kathryn McCormick, of record in the Office of the Clerk of the County Commission of Cabell County, West Virginia, in Trust Deed Book 2724, at Page 654. At the time of the execution of the Mortgage, this property was reported to have a mailing address of 1245 9th Avenue, Huntington, West Virginia 25701. The Borrowers defaulted under the Note and Mortgage and the Special Commissioner has been directed by the Circuit Court of Cabell County, West Virginia, to foreclose under the Mortgage. Therefore, the undersigned special commissioner will sell the real estate described below, at a public auction on June 5, 2023 at 10:00 a.m. to the highest bidder at the east front door of the Courthouse of said County of Cabell, in Huntington West Virginia, which real estate is more completely described as follows: Situated in Cabell County, State of West Virginia to-wit: The property is described as of that certain lot or parcel of land, together with the improvements thereon and the appurtenances, thereunto belonging, situate in Gideon District, Cabell County, West Virginia, and being more particularly described as follows: All that certain lot, piece or parcel of land situate in the City of Huntington, Cabell County, West Virginia, known and designated on Rau’s Subdivision of the North Half of Block No. 353, a copy of which map is of record in the Office of the Clerk of the County Commission of Cabell County, West Virginia, in Deed Book No. 150, at Page 274, as Lot Number Sixteen (16), and being more particularly described as follows: Beginning at the point of intersection of the south line of 9th Avenue with the west line of 13th Street; thence from said beginning, with the south line of 9th Avenue, westerly 32 feet; thence southerly and parallel to the said line of I3th Street, 100 feet; thence easterly and parallel to the said line of 9th Avenue, 32 feet to a point in the west line of 13th Street; thence with the said street line northerly 100 feet to the point of beginning, reserving therefrom, however, the southerly or rear 10 feet as a part of a 10-foot private alley, together with the right, however to use for alley purposes the other part of said 10-foot alley extending westerly and southerly to the main public alley, as shown on the aforesaid map. Being the same property conveyed to Thomas Edward Hill and Kathryn McCormick by the Deed dated November 30, 2018, and recorded in Deed Book 1396, at Page 96 in the Office of the Clerk of the County Commission of Cabell County, West Virginia. TERMS OF SALE: I) The property will be conveyed in an “AS IS” physical condition by Deed containing no warranty, express or implied, subject to the Internal Revenue Service right of redemption, all property taxes, prior Deeds, liens, reservations, encumbrances, restrictions, rights-of-ways, easements, covenants, conveyances and conditions of record in the Clerk’s office or affecting the subject property. 2) The Purchaser shall be responsible for the payment of the transfer taxes imposed by West Virginia Code 11-22-1. 3) The Beneficiary and r the Servicer of the Mortgage and Note reserve the right to submit a bid for the property at sale. 4) The Special Commissioner reserves the right to continue sale of the subject property from time to time by written or oral proclamation, which continuance shall be in the sole discretion of the Special Commissioner. 5) The Special Commissioner shall be under no duty to cause any existing tenant or person occupying the property to vacate said property, and any personal property and r belongings remaining at the property after the foreclosure sale will be deemed to constitute ABANDONED PROPERTY AND WILL BE DISPOSED OF ACCORDINGLY. 6) The total purchase price is payable to the Special Commissioner within thirty (30) days of the date of sale, with ten (10%) of the total purchase price payable to the Special Commissioner at sale.
