LEGAL NOTICE

Notice is hereby given to Kevin N. Smith and Jessica B. Smith, and any other person asserting any claim or interest in the parcel of land described herein, of an application, in writing by petition, filed by Mineral Wells Public Service District with the Circuit Court of Wood County, West Virginia, on March 28, 2023, in Civil Action No. CC-54-2023-C-93, to condemn, for public use, a temporary and permanent sewer line right-of-way for purposes of a sewer project across and through a parcel of land which lies wholly within Slate District of Wood County, West Virginia, and is more particularly described as follows:
BEGINNING at a stake located at the southeast corner of a 22×434 foot lot owned by Lewis Morris; thence S. 24-1/2* W. 142.2 feet to a stake; thence N. 55* 10′ W. 1,270 feet to a stake in the westerly boundary line of what was formerly a sixteen acre tract of land; thence with the northwesterly line of said sixteen acre tract, N. 34-1/4* E. 147 feet to a stone, in the northerly corner of said sixteen acre tract; thence with the north boundary line of said sixteen acre tract the following two calls and distances, S. 64* E. 500 feet to a stone, S. 56* E. 297 feet to a stake located in the northeastern corner of the 55×434 foot lot herein before mentioned; thence with the northwesterly corner of said last mentioned lot, S. 24-1/2* W. 55 feet to a stake located at the northwesterly corner of said last mentioned lot; thence with the southerly boundary line of said lot, S. 56* E. 434 feet to the place of beginning, and containing five (5) acres, more or less.
EXCEPTING and RESERVING therefrom a parcel thereof conveyed by Lewis L. Morris and Bessie Morris, his wife, to the State Road Commission of West Virginia by Deed dated May 31, 1966, and of record in the Office of the Clerk of the County Commission of Wood County, West Virginia, in Deed Book 707, at page 665.
The surface of said real estate being identified for real property tax purposes as Tax Map No. 20, Parcel U1, in Slate District, Wood County, West Virginia.
Take notice that Mineral Wells Public Service District has paid into Court the sum of Five Thousand ($5,000.00) Dollars which is estimated to be the fair market value of the sewer line right-of-way across and through the parcel of land described above.
If an answer is not filed with the Court within thirty-one (31) days from the first publication of this Legal Notice, a default judgement order will be submitted to the Court to be taken against the owners of the parcel of land described above, and all persons interested therein.
