The undersigned Substitute Trustee, by virtue of the authority vested in him by that certain Deed of Trust, dated December 10, 2010, and duly recorded in the Office of the Clerk of the County Commission of Raleigh County, West Virginia, in Document No. 50417440, in Book No. 5041, at Page 7440 and re-recorded in Document No. 50436874 Re-rec, in Book No. 5043, at Page 6874, James D Plumley and Teresa L Plumley did convey unto Richard A. Pill, Esq, Trustee(s), certain real property described in said Deed of Trust; and the beneficiary has elected to appoint Seneca Trustees, Inc., as Substitute Trustee; and default having been made under the aforementioned Deed of Trust, and the undersigned Substitute Trustee having been instructed by Wells Fargo Bank, NA to foreclose thereunder, will offer for sale at public auction at the front door of the Raleigh County Courthouse in Beckley, West Virginia, on

the following described real estate, together with its improvements, easements and appurtenances thereunto belonging, situate in 058 – Shady Spring District, Raleigh County, West Virginia, and more particularly described as follows:
Those certain parcels of real estate, together with any appurtenances thereunto belonging, situated in Shady Spring Tax District, Raleigh County, West Virginia, and bounded and described as follows:
TRACT NO.1:
Parcel No. 1: The surface of Lot 11, Grandview Homesites, Shady Spring District, Raleigh County, West Virginia, as shown on a map thereof recorded in the Office of the Clerk of the County Commission of Raleigh County, West Virginia, in Map Book 14, at page 101.
Parcel No. 2: Beginning at a point in the common line of Lots 26 and 27 of Grandview Farms, which part is N 30 degrees 01′ E 20 feet from the common corner of Lots 26, 27 and 28; thence N 61 degrees 55′ W 229.02 feet to a point; thence N 30 degrees 01′ E 80 feet to a point; thence S 61 degrees 55′ E 229.02 feet to a point in the common line of Lots 27 & 26; thence with said common line S 30 degrees 01′ E 80 feet to the beginning, as shown on a map recorded in Deed Book 602, at page 306.
Parcel No. 3: Beginning at the common corner of Lots 36, 27 and 26 of Grandview Farms; thence with the common line of Lots 36, 27 N 229.02 W 229.02 feet to a point in the line of Lot 28; thence thru Lot 28 N 30 degrees 01′ E 20 feet to a point; thence S 61 degrees 53′ E 229.02 feet to a point in the common line of Lot 26 and 27; thence S 30 degrees 01′ W 20 feet to the beginning.
And being a part of the same property acquired by Wayne E. Hughes by Deed dated the 16th day of September, 2005 from William H. May, Individually and d/b/a Tri-In Enterprises and Deborah K. May, individually and d/b/a Tri-In Enterprises, and recorded in the Office of the Clerk of the County Commission of Raleigh County, West Virginia in Deed Book 5019, at page 3842.
TRACT NO. 2:
That certain parcel of land located at Grandview, in the Shady Spring District, Raleigh County, West Virginia, situated along Silverpeak Avenue, above the waters of Glade Creek of New River. Said parcel being partitioned and is more particularly bounded and described as follows:
Beginning at a rebar in concrete (found), a common corner of Lots No. 17 & 18, at the lot line of Lot No. 13, thence with the lot line of Lot No. 18; N 23deg. 00′ 00″ E. 224.99′ to a rebar in concrete (found), a corner of Lots No. 11, 18, 26 & 27, thence with the lot line of Lot No. 18; S. 61deg. 48′ 37″ E. 264.08′ to a rebar(set), a new corner, at the lot line of Lot No. 25, thence with a new line through Lot No. 18; S. 19deg. 59′ 25″ W. 232.05′ to a rebar (set), a new corner at the common lot line of Lot No. 17 & 18; N. 60deg. 39′ 00″ W. 276.81′ to the point of beginning, containing 1.407 acres, more or less, as surveyed by ESIWV, PLLC, Beckley, West Virginia, and being a part of Lot No. 18, Grandview Farms.
And being the same property acquired by Wayne E. Hughes by Deed dated the 21st day of September, 2007, from Shaler B. Tate, IV and Stephanie D. Tate, husband and wife, which said Deed is of record in the Office of the Clerk of the County Commission of Raleigh County, West Virginia in Deed Book 5028, at page 7547.
And also being the same property acquired by James D. Plumley and Teresa L. Plumley, husband and wife, by Deed dated the 6th day of December, 2010 from Wayne E. Hughes and Nigel D. Hughes, which said Deed is to be recorded prior to or simultaneously herewith.
At the time of the execution of the Deed of Trust, this property was reported to have an address of: 184 Jefferson St, Beaver, WV 25813-9660.
The referenced real estate will be conveyed with no covenants of warranty, and subject to all covenants, restrictions, easements, rights of way and reservations which may be a matter of record in the aforesaid Clerk’s Office or visible upon the ground, all prior liens and encumbrances, including, without limitation, liens for real estate taxes, incinerator, sanitary and sewer charges. The purchasers at the sale shall be responsible for paying the recording costs and also the tax on the privilege of transferring real property (the cost of the tax stamp to be affixed to the deed). The purchasers shall be responsible for payment of all real estate taxes.
The subject property will be sold in “AS IS” condition. The Substitute Trustee shall be under no duty to cause any existing tenant or person occupying the subject property to vacate said property.
TERMS: $9000.00 in cash and/or certified funds as deposit at the time of sale with the balance due and payable within 30 days of the day of sale.
FEDERAL TAX LIEN: In the event that there are Federal Tax Liens against the property, the United States would have the right to redeem the property within a period of 120 days from the date of such sale or the period allowable for redemption under local law, whichever is longer.
Pursuant to the Deed of Trust, the Trustee may postpone the sale by public announcement at the time and place designated or by posting a notice of the same, and act by agent in the execution of the sale. The parties secured by the Deed of Trust reserve the right to purchase the property at such sale.
