TRUSTEE S SALE OF
VALUABLE REAL ESTATE
The undersigned Substitute Trustee, by virtue of the authority vested in it by that certain Deed of Trust dated January 30, 1998, and duly recorded in the Office of the Clerk of the County Commission of Wood County, West Virginia, in Deed of Trust Book 759, at Page 714, Dolores M. Fonner did convey unto Phyllis H. Arnold and Brian J. Fox, Trustee, certain real property described in said Deed of Trust; said Deed of Trust was modified by loan modification of record in Deed of Trust Book 2220, at Page 360; and the beneficiary has elected to appoint Pill & Pill, PLLC as Substitute Trustee by a Substitution of Trustee recorded in the aforesaid Clerk s Office; and default having been made under the aforementioned Deed of Trust, and the undersigned Substitute Trustee having been instructed by the secured party to foreclose thereunder, will offer for sale at public auction at the front door of the Wood County Courthouse, in Parkersburg, West Virginia, on September 7, 2023, at 2:34 PM The following described real estate, with its improvements, easements and appurtenances thereunto belonging, situate in the Parkersburg District, Wood County, West Virginia, and more particularly described as follows: Situate, lying, and being, in the District of Tygart, County of Wood, and State of West Virginia, bounded and described as follows: Tract I Beginning at the northeast corner of Lot No. 22 of Mrs. Janet Tavenner’ s Addition to Parkersburg, a plat of which is of record in the Office of the Clerk of the County Commission of Wood County, West Virginia in Deed Book No. 61, at page 133; thence s. 70 degrees W. 50 feet with the southerly line of an alley to a point; thence S. 20 degrees E. 60 feet to an iron pin; thence N. 70 degrees E. 50 feet to an iron pin on the westerly line of a twenty foot alley; thence N. 20 degrees W. 60 feet to the place of beginning, being a lot 50 by 60, which is the northerly 60 feet of said Lot No. 22. Tract II Beginning at a point on the southerly side of an unnamed 25-foot alley, which said point is the northeasterly corner of Lot No. 23 of the Janet Tavenners Addition and the northwesterly corner of Lot No. 22 of Janet Tavenners Addition; thence with the common line between said Lots 23 and 22 extended in a northerly direction 6 feet to a point; thence at right angles and in an easterly direction and parallel with the northerly line of said lot 22, 50 feet to a point thence at right angles and in a southerly direction 5 feet to a point in the northerly line of said Lot No. 22, which said point is the northeasterly corner of said Lot No. 22; thence with the northerly line of said Lot No. 22 in a westerly direction 50 feet to the place of beginning. Tract III: Beginning at a point in the northwestern corner of the intersection of Scott Street, now 10th Avenue, and a 20 foot alley; thence in a northerly direction with the westerly line of said 20 foot alley 100 feet to a stake, thence in a westerly direction 50 feet to a state, a common corner of Lots Nos. 22 and 23 in the Addition hereinafter named; thence in a southerly direction and with the common line of said Lots Nos. 22 and 23, in the Addition hereinafter named, thence in a southerly direction and with the common line of said Lots Nos. 22 and 23, 100 feet to a point in the northerly line of Scott Street, 50 feet to the place of beginning; and being part of Lot No. 22 in what is known as Mrs. Janet Tavenner’s Addition to Tavennerville, a plat of which Addition is of record in the Office of the Clerk of the County Commission of Wood County, West Virginia, in Deed Book 61, at page 133. Being the same property conveyed unto Delores M. Fonner, single, from Darrell Berry and Annie M. Berry, husband, and wife, by deed bearing date January 22, 1998 to be recorded immediately prior hereto. This conveyance is made subject to all rights of way, easements, reservations, exceptions, restrictions, protective covenants, and oil and gas leases of record in the chain of title. At the time of the execution of the Deed of Trust, this property was reported to have a mailing address of 2523 10th Avenue, Parkersburg, WV 26101. AND BEING the same real estate which was conveyed to Dolores M. Fonner, by Deed dated January 22, 1998, from Darrell Berry and Annie M. Berry, and recorded in the Office of the Clerk of the County Commission of Wood County, West Virginia, in Deed Book 977 at Page 798. The above-described property will be sold subject to any covenants, restrictions, easements, leases and conditions of record, and subject to any unpaid real estate taxes. The subject property will be sold in AS IS condition. The Substitute Trustee shall be under no duty to cause any existing tenant or person occupying the subject property to vacate said property. TERMS: Ten percent (10%) of the purchase price as a deposit with the balance due and payable within 30 days of the day of sale.
