Activity:
Modification 3 proposes sending this project to public notice because the construction duration is being extended. The revised estimated grading end date is being changed to 5/31/2024 which will exceed 1-year construction activities. Registration WVR110748 was issued to WV Division of Highways on 10/23/2020 and was proposed to disturb 54.7 acres. The project consists of the widening of WV Route 2 to five lanes from Wood County Route 3/8 (Valley Mills Road) to 0.2 miles north of WV Route 31 (Station 183+25 to Station 306+00). Existing embankments and cut slopes along the mainline will be widened. Connecting roads, new embankments, access and driveways will be relocated adjacent to WV 2. Modification #1 was issued 5/26/2022 requesting that Mountaineer Contractor, Inc. be Co-Permittee #1. Modification #2 was issued 8/7/2023 adding 0.74 acres to the LOD to place excess material and provide access for the bore machine for a total disturbed acreage of 55.44 acres.

On the basis of review of the application, the “Water Pollution Control Act (Chapter 22, Article 11-8(a)),” and the “West Virginia Legislative Rules,” the State of West Virginia will act on the above application.
Any interested person may submit written comments on the draft permit modification and may request a public hearing by addressing such to the Director of the Division of Water and Waste Management within 30 days of the date of the public notice. Such comments or requests should be addressed to:

The public comment period begins September 13, 2023 and ends October 13, 2023.

Comments received within this period will be considered prior to acting on the permit modification application. Correspondence should include the name, address and the telephone number of the writer and a concise statement of the nature of the issues raised. The Director shall hold a public hearing whenever a finding is made, on the basis of requests, that there is a significant degree of public interest on issues relevant to the Draft Permit Modification(s). Interested persons may contact the public information office to obtain further information.

The application, draft permit modification and any required fact sheet may be inspected, by appointment, at the Division of Water and Waste Management Public Information Office, at 601 57th Street SE, Charleston, WV, between 8:00 a.m. and 4:00 p.m. on business days.
