TRUSTEE’S SALE
NOTICE IS HEREBY GIVEN that, default having been made in the payment of the indebtedness secured by the deed of trust hereinafter described, and the undersigned having been required so to do by the owner and holder of said indebtedness, the undersigned Substitute Trustee {see General Lien Book No. 2299, at page 771 thereof} will offer for sale at the front door of the Wood County Courthouse, Parkersburg, West Virginia, on
TUESDAY,
OCTOBER 31, 2023,
at 10:00 o’clock in the
forenoon, local time,
at public auction, to the highest bidder for cash, all of the right, title and interest of CHRISTINA L. WEBB in and to the real property described in a certain deed of trust dated January 30, 2015, to ROBERT K. TEBAY, III, original Trustee, for the benefit of One Community Federal Credit Union, recorded in the Office of the Clerk of the County Commission of Wood County, West Virginia, in General Lien Book No. 1856, at page 610 thereof, possessed by the said CHRISTINA L. WEBB as at the making of said deed of trust, which said real estate is situate in the District of Harris, County of Wood, and State of West Virginia, and described in said deed of trust as follows:

All that certain real estate lying and being in the District of Harris, County of Wood and State of West Virginia, more particularly bounded and described as follows:
BEGINNING at an iron pipe set on the west bank of Lee Creek which is a distance of 4612.65 feet following the southern and western shore line of Lee Creek from the center of a bridge crossing Lee Creek on Route #11, and being in the northeast corner of property formerly owned by Frank Bucca and Thelma Bucca, a description of which is recorded in the Office of the Clerk of the County Commission of Wood County, West Virginia, in Deed Book 684, at page 101; thence S. 46* 54′ 40″ W. 350 feet to an iron pipe; thence N. 89* 56′ 13″ W. 358.87 feet to the center of Buckingham Road; thence with the center of said road N. 26* 23′ 30″ E. 104.06 feet to a point in the center of said road; thence again with the center of said road N. 18* 10′ E. 78.23 feet to a point in the center of said road, thence again with the center of said road N. 8* 23′ 4″ E. 84.55 feet to a point in the center of said road; thence leaving said road N. 80* 29′ 30″ E. 95.72 feet to an iron pipe; thence S. 86* 17′ 45″ E. 438 feet to the place of beginning, containing 2.58 acres, more or less, as set out on a plat by Thomas D. Schultheis, of record in the aforesaid Clerk’s Office in Plat Book 18, at page 40; and as Lot T-14 in Plat Book 18, page 50A.
There is also hereby conveyed the following rights-of-ways and easements.
1. The express right for the benefit of the Grantees, their heirs and assigns, to use a street designated as Buckingham Road, as a means of ingress, egress and regress to and from the above– described real estate.
2. A right of way or easements for the benefit of the Grantees, their heirs and assigns, for sewage or water lines or other utilities running along the two (2) above mentioned roads.
There is EXCEPTED and RESERVED from the operation of this conveyance all of the gas and minerals in, under and on the abovedescribed real property.
BEING the same real estate conveyed unto Christina L. Webb, by Margaret A. Allphin n/k/a Margaret A. Miller, by a deed dated January 30, 2015, and to be recorded in the Office of the Clerk of the County Commission of Wood County, West Virginia, immediately prior hereto.
This conveyance is made expressly subject to those certain covenants and restrictions contained in the above- described Deed and all rights of way, reservation, restrictive and protective covenants, utility easements, and oil, gas and mineral leases of record in the chain of title in the aforesaid Clerk’s Office.
Upon information and belief, the address of the subject real estate is 175 Buckingham
Road, Belleville, West Virginia 26133.
Upon the following terms to-wit:
1. Cash in hand on day of sale, or as the Trustee may otherwise agree.
2. Minimum acceptable bid is $45,500.00. The sum of $2,500.00 by Bank or Cashier’s check must be delivered at the sale to the Trustee by the successful bidder.
3. Subject to any and all reservations, exceptions, conditions, grants of rights of way and easements made by the grantor and her predecessors in title prior to the granting of the deed of trust being foreclosed upon.
4. The undersigned reserves the right to adjourn the sale from day to day and time to time upon oral proclamation made at the time and place of sale set forth herein or at such later time and place to which the sale has theretofore been adjourned, and further reserves the right to alter the terms of sale at any such continued sale, including, but not limited to, a lower minimum bid.
5. The undersigned reserves the right to reject any and all bids.
6. Sale is subject to unpaid ad valorem taxes and special assessments, if any, as well as any sale of the subject real estate for unpaid taxes.
7. The premises described hereinabove, including any and all improvements thereto, are sold “AS IS-WHERE IS” with no warranty express or implied.
8. The owner and holder of the indebtedness secured by the deed of trust described hereinabove reserves the right to bid at this sale.
9. The successful buyer at the sale will be responsible for paying any and all transfer stamps, excise fees and recording costs with respect to the trustee’s deed.
10. Sale is subject to the provisions of W.Va. Code §38-1-16 regarding any existing tenancy at the subject premises.
11. Neither the owner and holder of the indebtedness secured by the underlying deed of trust nor the substitute trustee shall have any duty to cause any existing tenant or person or persons occupying the subject property to vacate said property.
12. Any personal belongings remaining in the subject premises after sale shall be deemed abandoned and may thereafter be disposed of at the successful bidder’s or bidders’ discretion. Any person or entity claiming ownership of or any interest in any such property should contact the undersigned prior to sale about any such claim.
13. The successful bidder at the sale and the Trustee shall execute a Memorandum of Sale at the conclusion of the sale, and the terms of the Memorandum shall control.
14. In the event that the successful bidder at the sale fails or refuses to consummate his, her, its or their purchase, then the Trustee shall have the option to consummate sale with the next highest bidder at the sale.
