NOTICE OF TRUSTEE’S SALE
NOTICE OF TRUSTEE’S SALE is hereby given pursuant to and by virtue of the authority vested in the Substitute Trustee, WV Trustee Services, LLC, by that certain Deed of Trust dated November 17, 2008, executed by Borrower(s), Lewis W Lester and Clara J Lester, to Richard A. Pill, Esq., the Trustee of record in the office of the Clerk of the County Commission of Wyoming County, West Virginia, in Book 251, at Page 727. At the time of the execution of the Deed of Trust, this property was reported to have a mailing address of 8475 Appalachian Hwy, Matheny, WV 24860. WV Trustee Services, LLC were appointed as Substitute Trustees by APPOINTMENT OF SUCCESSOR TRUSTEE dated October 18, 2023, of record in the Clerk’s Office. The borrower(s) defaulted under the Note and Deed of Trust and the Substitute Trustees have been instructed to foreclose under the Deed of Trust. Accordingly, the Substitute Trustees will sell the following described property to the highest bidder at the front door of the Courthouse of Wyoming County, in Pineville, West Virginia, on the following date:
5th day of December, 2023 at 12:30 p.m.
The following described certain tract or parcel of land, situate, lying and being on the Laurel Fork of the Clear of Guyandotte River, in Oceana District, Wyoming County, West Virginia, more particularly and described as follows: TRACT ONE;: BEGINNING at a stake in the line of the south side of the County Road as now located between Pineville and Oceana, at the south end of the culvert across Half Mile Branch of Laurel Fork of Clear Fork Guyandotte River; thence with the south line of said road, running up said Laurel Fork 70 feet to a stake; thence, at right angles, to said county road line, and running down the hill toward said Laurel Fork 80 feet to a stake; thence running at right angles again and running down said Laurel Fork 105 feet to a stake in the center of Half Mile Branch; thence running up the hill, with the meanders of said Half Mile Branch, 65 feet, more or less, to the place of beginning, containing one-sixth (1/6) of an acre, more or less, and being the same real estate which was granted and conveyed to the said Minnie Roles, female grantor hereto, by Melvin Bailey and Carnie Bailey, his wife, by deed dated the 15 day of February, 1931, and recorded in the office of the Clerk of the County Court of Wyoming County, West Virginia, in Deed Book 73, at page 100. EXCEPTED and RESERVED, HOWEVER, out of and from the operation and effect of this conveyance, all the land which is included is parallel strips or parcels of land 60 feet wide, 30 feet on either side of the center line, with additional strips where shown on the plans or staked out on the ground, or both, for slopes to a road built on said center line, which was acquired by the County Court of Wyoming County, West Virginia, a corporation, for right of way purposes, in a condemnation proceeding hereto pending in the Circuit Court of said Wyoming County, West Virginia, a corporation, against Minnie Roles and S. G. Roles. TRACT TWO: A lot or parcel of land bounded and described as follows to-wit: Beginning on a planted stone a corner of Garner Roses lot thence Ninety six feet (96) to a Locus tree thence across the bottom one hundred and Ninety feet (190) to the center of the half mile branch with a apple tree. A line tree on the bank of half mile branch, thence up and with the meanders of the half mile branch to the comer of Garner Roses lot, thence with the line of Garner Roses lot to the corner of beginning, containing one-half acre more or less. And being the same property acquired by Lewis W. Lester and Clara J. Lester, his wife by deed dated November 13, 2008 from Douglas Lee England, Boyd Rufus England, Frank Merl England, and Wanda Jean Walls, said deed to be recorded in the Office of the Clerk of the County commission of Wyoming County, West Virginia, prior to or simultaneously herewith.
TERMS OF SALE:
1) The property will be conveyed in an “AS IS” physical condition by Deed containing no warranty, express or implied, subject to the Internal Revenue Service right of redemption, all property taxes, prior Deeds, liens, reservations, encumbrances, restrictions, rights-of-ways, easements, covenants, conveyances and conditions of record in the Clerk’s office or affecting the subject property.
2) The Purchaser shall be responsible for the payment of the transfer taxes imposed by the West Virginia Code § 11-22-1.
3) The Beneficiary and/or the Servicer of the Deed of Trust and Note reserve the right to submit a bid for the property at sale.
4) The Trustee reserves the right to continue sale of the subject property from time to time by written or oral proclamation, which continuance shall be in the sole discretion of the Trustee.
5) The Trustee shall be under no duty to cause any existing tenant or person occupying the property to vacate said property, and any personal property and/or belongings remaining at the property after the foreclosure sale will be deemed to constitute ABANDONED PROPERTY AND WILL BE DISPOSED OF ACCORDINGLY.
6) The total purchase price is payable to the Trustee within thirty (30) days of the date of sale, with ten (10%) of the total purchase price payable to the Trustee at sale.
