NEWARK AREA WASTEWATER FACILITIES PHASE II

ADVERTISEMENT FOR BIDS

Sealed Bids for the construction of the Newark Area Wastewater Facilities Phase II project will be received by the Claywood Park Public Service District at their office located at 594 Davisville Road, Davisville 26142 (mailing address: PO Box 127 Parkersburg, WV 26102-0127) until 11:00 AM. local time on December 1, 2023, at which time the Bids received will be publicly opened and read. Bids will be received for each contract until the scheduled opening time for that contract.
Any contract or contracts awarded under this invitation for bids are expected to be funded in part by grants and loans from: the West Virginia Department of Environmental Protection State Revolving Fund; US Department of Housing and Urban Development Small Cities Block Grant; West Virginia Infrastructure and Jobs Development Council. Neither the United States, the State of West Virginia nor any of their departments, agencies or employees are or will be a party to this invitation to bid or any resulting contract.
This construction of this project will also be funded in part with funds made available from the Federal Government through the US Army Corps of Engineers Section 571 program. Bidders must comply with all applicable laws and regulations for construction projects receiving Federal aid including, but not limited to, the Civil Rights Act of 1964, the Contract Work Hours and Safety Standards Act, and the Davis-Bacon Act as amended.

The method of bidding will be as follows:
CONTRACT #1 SPRING VALLEY NORTHWEST SEWER SYSTEM : Unit price contract to install 6,353 LF of 8 inch PVC gravity sewer, 2,625 LF of 4 inch and 6 inch PVC service lines, 1,310 LF of 2 inch PVC pressure sewer, 1,800 LF of 1-1/4″ PE pressure sewer service, 45 new manholes, 55 VF of 48 inch riser pipe, 26 grinder pumps, 9 clean outs, 1 sewage combination air release valves, 59 LF of highway borings, 476 LF of open cut with steel casing, 14 VF of internal manhole sealing, 563 LF of pressure cleaning and video, 563 LF of gravity sewer internal lining, 69 service reconnections, surface restoration, video taping of surface features and other appurtenances required to build a complete sewer system.
CONTRACT #2 SPRING VALLEY SOUTHEAST SEWER SYSTEM : Unit price contract to install 4,174 LF of 8 inch PVC gravity sewer, 1,320 LF of 4 inch and 6 inch PVC service lines, 820 LF of 2 inch & 3 inch PVC pressure sewer, 660 LF of 1-1/4″ PE pressure sewer service, 34 new manholes, 64 VF of 48 inch riser pipe, 8 grinder pumps, 3 clean outs, 1 sewage combination air release valves, 59 LF of highway borings, 234 LF of open cut with steel casing, 1 submersible lift station, 29 service reconnections, surface restoration, video taping of surface features and other appurtenances required to build a complete sewer system.
CONTRACT #3 SPRING VALLEY LAGOON DECOMMISSIONING : Lump sum contract to perform all work required to decommission and demolish one wastewater treatment lagoon. Work includes pumping lagoon supernatant to lift station, remove and dispose of sludge at local landfill, remove and dispose of piping and equipment, demolition of select structures, breaching pond walls, adding fill to cover any sludge remaining in the lagoon, grading lagoon to provide positive drainage and other incidental work.

Prospective Bidders may examine the Bidding Documents at the Issuing Office on Mondays through Fridays between the hours of 8:00AM – 5:00PM and may obtain copies of the Bidding Documents from the Issuing Office as described below.

Printed copies of the Bidding Documents may be obtained from the Issuing Office, during the hours indicated above, upon payment of a deposit of $ 250.00 for each contract set. Bidders may also purchase a digital copy on compact disc (as portable document format (PDF files) or via email upon payment of $50.00 . Checks for Bidding Documents shall be payable to Cerrone Associates, Inc. or payment can be made at www.cerrone1.com via PayPal. Upon request and receipt of the document deposit indicated above plus a non-refundable shipping charge, the Issuing Office will transmit the Bidding Documents via delivery service. The date that the Bidding Documents are transmitted by the Issuing Office will be considered the Bidder’s date of receipt of the Bidding Documents. Partial sets of Bidding Documents will not be available from the Issuing Office. Neither Owner nor Engineer will be responsible for full or partial sets of Bidding Documents, including Addenda if any, obtained from sources other than the Issuing Office.
A five percent (5%) Bid Bond or certified cashier’s check must accompany all bids.

Contractors are required to comply with all laws pertaining to the federal wage rates issued in accordance with the Davis Bacon Act.
Each bid must be submitted at the time and place indicated above and must be submitted using a two-envelope system. Two separate and distinct envelopes each with proper identification must be enclosed in a large opaque sealed bidding envelope, marked with the Project Title, and name and address of the Bidder. These envelopes shall be identified as “Bid Opening Requirements” and “Bid Proposal”.

The “Bid Opening Requirements” envelope shall contain the completed required documents listed above. The “Bid Proposal” envelope shall contain solely the Completed Bid Form. If the Bid is sent through the mail or other delivery system, the entire bidding package must be enclosed in a separate envelope addressed to the Owner with the notation “Bid Enclosed” on the face thereof.

At the scheduled time, Bids will be opened publicly. The “Bid Opening Requirements” envelope and the “Bid Proposal” envelope will be removed from the bidding envelope of each Bidder. The “Bid Opening Requirements” envelope and “Bid opening Requirements Checklist” will first be opened and the contents will be checked for completeness. In the event that all of the items are not complete from the first envelope, the “Bid Proposal” envelope shall be returned to the Bidder unopened, and the Bid will be considered non-responsive. This requirement will not be waived for any reason. After determination that all items in the Bid Opening Requirements envelope are complete, the “Bid
Proposal” envelope will be opened publicly and read aloud.

The Contracts have the following completion times from the date the work will commence in accordance with the Notice to Proceed, and daily liquidated damage amounts for each calendar day that expires that a Contract is not completed after the scheduled completion dates:

Contract 1:
Substantial Completion: 210 days after the date of commencement Final Completion: 240 days after the date of commencement Liquidated Damage: $800 per calendar day

Contract 2:
Substantial Completion: 150 days after the date of commencement Final Completion: 180 days after the date of commencement Liquidated Damage: $800 per calendar day

Contract 3:
Substantial Completion: 120 days after the date of commencement Final Completion: 150 days after the date of commencement Liquidated Damage: $750 per calendar day

DBE REQUIREMENTS

Each bidder must fully comply with the Disadvantaged Business Enterprises, and Affirmative Action requirements, as identified in the contract documents. The Bidder agrees to make “positive efforts” to subcontract a portion of the total value of the contract to Disadvantaged Business Enterprises. This shall be done in compliance with the six (6) affirmative steps as outlined in 40 CFR 33.240. Failure to demonstrate positive efforts to do so may lead to rejection of bids. For this program, the term “subcontract” includes all construction, modification and service work contracted for by the bidder in the execution of the work under this contract.

BUILD AMERICA, BUY AMERICA REQUIREMENT

P.L. 117-58, Infrastructure Investment and Jobs (IIJA) Act, 2021 (Act), includes a “Build America, Buy America (BABA)” requirement in Sections 70911 through 70917 that requires Clean Water State Revolving Loan Fund (CWSRF) and Drinking Water State Revolving Loan Fund (DWSRF) assistance recipients to use iron, steel, manufactured products, and construction materials that are produced in
the United States for projects for the construction, alteration, maintenance, or repair of a public water system or treatment works.

NONDISCRIMINATION IN EMPLOYMENT
Bidders on this work will be required to comply with the President’s Executive Order No. 11246. The requirements for bidders and contractors under this order are explained in the specifications.

SUSPENSION AND DEBARMENT
Recipient shall not entertain the use of businesses that are listed on the “System for Award
Management (SAM)” at www.sam.gov in accordance with 2 CFR Part 1532 and Subpart B and C of 2 CFR Part 180.

WV ALCOHOL AND DRUG FREE WORKPLACE ACT
WEST VIRGINIA CODE 21-1D-5 PROVIDES THAT ANY SOLICITATION FOR A PUBLIC IMPROVEMENT CONSTRUCTION CONTRACT REQUIRES EACH VENDOR THAT SUBMITS A BID FOR THE WORK TO SUBMIT AT THE SAME TIME AN AFFIDAVIT OF COMPLIANCE WITH THE BID. THE ENCLOSED DRUG-FREE WORKPLACE AFFIDAVIT MUST BE SIGNED AND SUBMITTED IN THE FIRST ENVELOPE AS EVIDENCE OF THE VENDOR’S COMPLIANCE WITH THE PROVISIONS OF ARTICLE 1D, CHAPTER 21 OF THE WEST VIRGINIA CODE. FAILURE TO SUBMIT THE SIGNED DRUG-FREE WORKPLACE AFFIDAVIT IN THE FIRST ENVELOPE SHALL RESULT IN DISQUALIFICATION OF SUCH BID.

NOTICE OF FEDERAL AND STATE WAGE REQUIREMENTS
Contractors are required to comply with all lows pertaining to prevailing wage rates for the State of West Virginia as issued by the Division of Labor and the federal wage rates issued in accordance with the Davis Bacon Act. The contractor will be required to pay the higher of the state or federal wage rates appropriate for each worker classification.
HUD REQUIREMENTS

Bidders on this work will be required to comply with the President’s Executive Order No.
11246 and “HUD Section 109,” which prohibits discrimination in employment regarding race, creed, color, sex or national origin.

This Community Development Block Grant project is to be financed in part by a grant from the United States Department of Housing and Urban Development (HUD) and the West Virginia Development Office and will be referred to as the Claywood Park PSD Newark Area Wastewater Facilities Phase II project.

The work to be performed under this contract is subject to the requirements of Section 3 of the Housing and Urban Development Act of 1968, as amended, 12 U.S.C. 170l u (Section 3). The purpose of Section 3 is to ensure that employment and other economic opportunities generated by HUD assistance or HUD-assisted projects covered by Section 3, shall, to the greatest extent feasible, be directed to low- and very low-income persons, particularly persons who are recipients of HUD assistance for housing.

The parties of this contract agree to comply with HUD’s regulations in 24 CFR Part 75, which implement Section 3. Bidders’ attention is directed to the Section 3 “Clause” set forth in the contract documents.

Bidders must comply with the requirements for Affirmative Action and Minority Business Enterprises participation as described in the Federal Specifications insert to the Contract Documents. Bidders must comply with Title VI of the Civil Rights Act of 1964, the Davis-Bacon Act, the Copeland Act, the Contract Work Hours and Safety Act, and the West Virginia Division of Labor Wages for Construction of Public Improvements pursuant to West Virginia Code §21-5A-3.

The contractor will ensure that to the greatest extent feasible opportunities for training and employment arising in connection with this CDBG-assisted project will be extended to lower income project area residents. Further, the contractor will, to the greatest extent feasible, utilize business concerns located in or substantially owned by residents of the project area, in the award of contracts and purchase of services and supplies.

There will be a MANDATORY pre-bid conference on November 15, 2023, at 11:00 AM for all bidders located at: Claywood Park Public Service District – office located at 594 Davisville Road, Davisville, 26142.
The Owner reserves the right to reject any or all bids.
No Bidder may withdraw his bid within 90 days after the actual date of the opening thereof.
