NOTICE OF SUCCESSOR TRUSTEE’S SALE

NOTICE is hereby given that Jessica R. Lowden, Successor Trustee, appointed by Appointment Of Successor Trustee recorded on August 10, 2022, and of record in the Office of the Clerk of the County Commission of Wood County, West Virginia in General Lien Book 2254, at Page 32, will sell the following described real property by virtue of the authority vested in the Successor Trustee by that certain Deed of Trust dated June 15, 2015, executed by ACE Homebuyers, LLC to Matthew F. Graves, Trustee, of record in the Office of the Clerk of the County Commission of Wood County, West Virginia, in General Lien Book 1877, at Page 669. The Lender under said Deed of Trust is The Citizens Bank Company with its principal place of business at 501 Fifth Street, Beverly, Ohio, 45715.

Jessica R. Lowden, Successor Trustee, having been requested to do so by the Lender, and default having been made under the terms and conditions of said Deed of Trust, and the provisions in said Deed of Trust concerning acceleration having been complied with by the Lender and present holder of the Note, said Successor Trustee will sell at public auction at 11:00 o clock a.m. on the

at the front doors of the Wood County Courthouse in Parkersburg, West Virginia, the following described real estate located and being situated in the City of Parkersburg, County of Wood and State of West Virginia, described as follows, to-wit:

All that certain lot, tract or parcel of real estate lying and being situate in City of Parkersburg, Wood County, West Virginia, more particularly bounded and described as follows, to-wit:

Beginning at an iron pipe found in the eastern line of a 20 foot wide alley said iron pipe being at the northwesterly corner of that certain tract was conveyed unto Richard W. Riel and Wendy D. McConaha recorded in Deed Book 945 on Page 678 and in the westerly line of Lot 1 of the hereinafter mentioned subdivision, thence with said alley N. 15 deg. 21′ 49″ E. 16.21 feet to a point, thence continuing with said alley N. 65 deg. 41′ 13″ E. 88.05 feet to the corner to Lot 3; thence with line of Rockhold and Lot 3 S. 24 deg. 25′ 20″ E. 55.03 feet to a capped 5/8 inch by 30 inch rebar set; thence with a new line through the parent tract S. 39 deg. 32′ 30″ W. 60.09 feet to an iron pipe found corner to the aforementioned Riel-McConaha tract, thence with the easterly line of same S. 18 deg. 39′ 31″ W. 54.85 feet to an iron pipe found on Cliffside Avenue, thence with the northerly line of Cliffside Avenue and the aforementioned 20 foot wide alley, thence with said alley N. 15 deg. 51′ 49″ E. 74.98 feet to the point of beginning, containing 0.247 acres, more or less, being part of Lot 1 and 2 of Fairplains Addition No. 1 a plat of said addition is recorded in Plat Book 3 on Page 96 and shown on a plat of survey by Scott F. Stewart, Professional Surveyor of record in the Office of the Clerk of the County Commission of Wood County, West Virginia in Deed Book 1130 at Page 685.

This conveyance is made subject to any and all exceptions, restrictions, conditions, covenants, easements and rights of way as the same are found in the subject parcel s chain of title.

NOTE: The property is currently owned by Jeffrey E. Casto by a deed from ACE Homebuyers LLC recorded in Deed Book 1314 at Page 393.

City of Parkersburg, Map 107, Parcel 118, which currently has the address of 3807 Cliffside Avenue, Parkersburg, WV, 26101.

It is the intention of this Notice to sell the secured property by proper description as was intended to be transferred and conveyed in the aforesaid Deed of Trust.

The above described real estate is reported to have a mailing address of 3807 Cliffside Avenue, Parkersburg, West Virginia, 26101.

Notice is also given that any personal property and/or belongings remaining at the property after the foreclosure sale will be deemed to constitute ABANDONED PROPERTY AND WILL BE DISPOSED OF ACCORDINGLY. The Substitute Trustee and/or the Lender shall be under no duty to cause any existing tenant or person occupying the subject property to vacate said property.

TERMS OF SALE: Cashier’s check within 30 days of date of sale upon terms to be agreed upon between the Successor Trustee and the successful bidder; payment for unpaid real estate taxes to be assumed by the purchaser. The Successor Trustee does not warrant title or fitness to this property; it is being purchased “AS IS”. The property will be conveyed by Deed containing no warranty, express or implied, subject to any and all reservations, exceptions, conditions, grants of rights of way and easements made by the grantors and his or her predecessors in title and recorded prior to the granting of the Deed of Trust being foreclosed upon and subject to unpaid ad valorem taxes and special assessments, if any. The Lender, Beneficiary and/or the Servicer of the Deed of Trust and Note reserve the right to submit a bid for the property at sale. Any purchaser at sale is further advised that the transaction is not complete until the Successor Trustee Deed is delivered and recorded. This is a buyer beware sale and any buyer is advised to retain counsel before the sale. If there is any part of the process of sale which is found to be objectionable, the Trustee reserves the right to cancel sale. No purchaser should take possession or make improvements in the premises until the Trustee deed is delivered or recorded. A third party purchaser at sale will be required to pay the purchase price plus all recording and transfer fees.

Neither the Successor Trustee nor the Lender is under any duty to cause any existing tenant or person occupying the subject property to vacate property. If the Buyer at sale is unable to complete the terms of purchase within 30 days, the Trustee reserves the right to transfer the property to the next highest bidder, or to reject any and all bids. Any sale hereunder may be adjourned from time to time without any notice other than oral proclamation at the time and place appointed for this sale or by posting of a written notice of same. Should the Successor Trustee not appear at the time appointed for the sale and there is no notice posted of a continuance please contact the office of the Successor Trustee to make further inquiry. Any sale may be conducted or adjourned by the designated agent or attorney of the Successor Trustee. The undersigned is fully vested with the authority to sell said property as Successor Trustee.
