LEGAL NOTICE
REQUEST FOR PROPOSALS FOR ACCOUNTANT, PROJECT ATTORNEY,
APPRAISER, REVIEW APPRAISER, RIGHT-OF-WAY NEGOTIATOR

The New River Gorge Regional Development Authority (NRGRDA) is in the process of obtaining professional services necessary to complete the Appalachian Heights Water Extension Project. These services include appraiser, review appraiser, right-of-way negotiator, accountant, and project attorney. The selected professional(s) will work closely with the Raleigh County PSD, NRGRDA, Region I Planning & Development Council, and other project team members.

The selected accountant will provide accounting services to prepare necessary documentation to accompany the IJDC application as well as the application for Certificate of Convenience and Necessity to the West Virginia Public Service Commission, in addition to any other services needed in relation to the project.

The project attorney is an integral part of the project team and will provide general legal services as necessary during the development and construction of the project. Areas of practice include obtaining a Certificate of Convenience from the West Virginia Public Service Commission, title work as necessary to obtain construction rights-of-way and parcels, and review of all contracts and related documents as necessary.

The selected appraiser, review appraiser, and right-of-way negotiator will work closely with the project attorney and engineer to obtain all necessary rights-of-way and parcels.

Procurement of the said services shall be in accordance with 2 CFR 200.320 (b)(2). Contracts are to be awarded on familiarity with and expertise on this type of project, as well as on a fixed basis for services. All those interested in being considered for this must submit a proposal detailing qualifications and staffing capabilities, related prior work experience, fee schedule, and ability to complete work as needed on this project in a timely manner.

Contracts will be awarded to the responsible offeror whose proposal is within the competitive range and determined to be the most advantageous to the project; price and other factors considered including familiarity and expertise with this type of project. The consultant’s eligibility to receive federal funds will be verified at http://www.sam.gov prior to the contract award.

Proposals will be accepted until 12:00 p.m. on December 8, 2023. It is the responsibility of the respondent to ensure receipt of the proposal by the date and time specified.

Attention is directed to the fact that the proposed project may be undertaken through funding sources including but not limited to WV Development Authority Economic Enhancement Grant Fund, HUD/Community Development Block Grant, Appalachian Regional Commission (ARC), Economic Development Administration (EDA), West Virginia Department of Environmental Protection (WV DEP), USDA-Rural Development, West Virginia Infrastructure and Jobs Development Council, State Revolving Loan Fund, and Local Funds.
All work will be performed in accordance with the regulations issued by the State of West Virginia appertaining thereto. The selected firm(s) will be required to comply with Executive Order 11246, Section 3 of the Housing and Urban Development Act of 1974, Conflict of Interest Statement and Access of Records, Title VI and Section 109.

The NRGRDA will afford full opportunity for minority business enterprises to submit a show of interest in response to this invitation and will not discriminate against any interested firm or individual on the grounds of race, color, creed, sex, age, handicap, or national origin in the contract award.

The NRGRDA reserves the right to accept or reject any and/or all proposals. The NRGRDA also reserves the right to negotiate the fee for services.
