TRUSTEE’S SALE OF VALUABLE REAL ESTATE

The undersigned Substitute Trustee, by virtue of the authority vested in him by that certain Deed of Trust, dated December 19, 2003, and duly recorded in the Office of the Clerk of the County Commission of Raleigh County, West Virginia, in Document No. 50115127, in Book No. 5011, at Page 5127 and modified in Document No. MOD 50654746, in Book No. 5065, at Page 4746 and modified in Document No. MOD 50756342, in Book No. 5075, at Page 6342, Susan Akers did convey unto Richard A. Pill, Esq., Trustee(s), certain real property described in said Deed of Trust; and the beneficiary has elected to appoint Seneca Trustees, Inc., as Substitute Trustee; and default having been made under the aforementioned Deed of Trust, and the undersigned Substitute Trustee having been instructed by Wells Fargo Bank, NA to foreclose thereunder, will offer for sale at public auction at the front door of the Raleigh County Courthouse in Beckley, West Virginia, on

the following described real estate, together with its improvements, easements and appurtenances thereunto belonging, situate in 11 – Town District, Raleigh County, West Virginia, and more particularly described as follows:

The following described tracts or parcels of surface land situate in Town District, Raleigh County, West Virginia, more particularly bounded and described as follows:
TRACT ONE: Beginning at a stake 140 feet distant from a stake in the line of Lot No. 48 of the Oakley Htgs. Addition to the City of Beckley, Town District, Raleigh County, West Virginia, and which said latter stake is N 69º 05’ W 10 feet distance from the common corner of Lots No. 47 and 48 of said Addition which fronts on a 30 foot street as shown on a map of said Addition of record in the Office of the Clerk of the County Commission of Raleigh County, West Virginia, in Map Book No. 3 at page 38F; thence S 20º 55’ W parallel to and 10 feet distant from the common line between Los No. 47 and 48 of said Addition 75 feet to a stake; thence running a northwest direction approximately 90 feet or less to a stake in the common line of Lots 48 and 49 of said Addition and which said stake is 215 feet from the common corner of said lots which fronts on the 30 foot road as shown on the map aforesaid; thence running along and with the common line between Lots Nos. 48 and 49 of said Addition N 18º 30’ E 75 feet to a stake in said line, which said stake is 140 feet from the common corner between Lots 48 and 49 of said Addition which fronts on a 30 foot road as shown on a map of said Addition aforesaid; thence leaving the common line between Lots 48 and 49 and running through Lot No. 48 of said Addition in a southeast direction to the point and place of beginning and being a part of Lot No. 48 of said Addition.
There is EXCEPTED and RESERVED from this conveyance that tract or parcel of land heretofore out-conveyed by Mabel Feazelle, being more particularly described as follows:
Beginning at a point on Lively Street, the same being S 20º 55’ W 140 feet from the intersection of Lively Street and Oakley Road; thence with Lively Street S 20º 55’ W 20.0 feet ; thence leaving Lively Street N 69º 05’ W 83.0 feet; thence N 18º 30’ E 20 feet, more or less; thence S 69º 05’ E 83.5 feet to the point and place of beginning.
There is also GRANTED and CONVEYED unto the Grantees herein, a right of way over a 20 foot street, more particularly bounded and described as follows:
Beginning at a stake in a 30 foot road on the line of Lot No. 48 of the Oakley Heights Addition to the City of Beckley, in Town District, Raleigh County, West Virginia, which said stake is N 69º 05’ W 10 feet distant from the common corners of Lots Nos. 47 and 48 of said Addition; thence S 20º 55’ W parallel to and 10 feet distant from the common line between Lots Nos. 47 and 48 of said Addition 360 feet to a stake; thence N 20º 55’ E parallel to and 10 feet distant from the common line between Lots 47 and 48 of said Addition, 360 feet to a stake in a 30 foot road; thence N 69º 05’ W along and with said road 20 feet to the point and place of beginning.
TRACT TWO: Beginning at a point on Lively Street, the same being S 20º 55’ W 215 feet from the intersection of Lively Street and Oakley Road; thence with Lively Street S 20º 55’ W 20.0 feet; thence leaving Lively Street N 69º 05’ W 80.0 feet; thence N 18º 30’ E 20 feet, more or less; thence S 69º 05’ E 80.5 feet to the point and place of beginning.
And being the same property acquired by Susan Elizabeth Akers, by deed dated August 19, 2003, from Evelyn Hoskins, Ethel Mae Pennington, Robert K. Feazelle, Betty Lou Wilson, Donna Duncan, Trela Akers, Vesta Feazelle, William Feazelle, Jr. and Timothy Feazelle, to be recorded in the Office of the Clerk of the County Commission of Raleigh County, West Virginia, prior to or simultaneously herewith.
A copy of any notice of foreclosure sale shall be served on Grantors by certified mail, return receipt requested at the following address: 114 Lively St., Beckley, WV 25801, or at such other address as may be given to Lender in writing by Grantors subsequent to the execution and delivery of this deed of trust.

At the time of the execution of the Deed of Trust, this property was reported to have an address of: 114 Lively Street, Beckley, WV 25801-2126.

The referenced real estate will be conveyed with no covenants of warranty, and subject to all covenants, restrictions, easements, rights of way and reservations which may be a matter of record in the aforesaid Clerk’s Office or visible upon the ground, all prior liens and encumbrances, including, without limitation, liens for real estate taxes, incinerator, sanitary and sewer charges. The purchasers at the sale shall be responsible for paying the recording costs and also the tax on the privilege of transferring real property (the cost of the tax stamp to be affixed to the deed). The purchasers shall be responsible for payment of all real estate taxes.

The subject property will be sold in “AS IS” condition. The Substitute Trustee shall be under no duty to cause any existing tenant or person occupying the subject property to vacate said property.

TERMS: $3500.00 in cash and/or certified funds as deposit at the time of sale with the balance due and payable within 30 days of the day of sale.

FEDERAL TAX LIEN: In the event that there are Federal Tax Liens against the property, the United States would have the right to redeem the property within a period of 120 days from the date of such sale or the period allowable for redemption under local law, whichever is longer.

Pursuant to the Deed of Trust, the Trustee may postpone the sale by public announcement at the time and place designated or by posting a notice of the same, and act by agent in the execution of the sale. The parties secured by the Deed of Trust reserve the right to purchase the property at such sale.
