CODE 35-1-1 et seq.

in THE MORGAN MESSENGER
Notice is hereby given that on or following the 30th of June, 2024, the Trustees of the Baltimore-Washington Conference of the United Methodist Church as Successors in Interest of Cherry Run United Methodist Church (hereinafter the “Trustees”) will sell and convey the following described real estate:
All that certain lot, tract, or parcel of land, together with the improvements thereon and the easements and appurtenances thereunto belonging, situate in Morgan County, West Virginia, described as follows:
PARCEL NUMBER ONE:
Lots Nos. 9, 10 and 11 in File’s second addition to Cherry Run, bounded on the North-east by McCullough; on the Southeast by the Cherry Run and Sleepy Creek and; on the North by Kerns Street, and on the Southwest by Poole; the plat of said lots being of record in the office of the Clerk of the County Court of said County in Deed Book No. 25, at page 319.
AND BEING the same real estate granted and conveyed from R.T. Files, Executor of the Last Will and Testament of Jacob Files, deceased, unto M.W. Fulton, Charles T. Strouse and Hiner T. Speelman, Trustees of the United Brethren Church at Cherry Run, and their successors, by deed bearing date the 28th day of November, 1914, of record in the office of the Clerk of the County Commission of Morgan County, West Virginia, in Deed Book No. 34, at page 293.
PARCEL NUMBER TWO:
Lots Seven (7) and Eight (8) of Jacob Files Second Addition to Cherry Run, West Virginia, situate in the Village of Cherry Run as described on that certain plat of record in the Office of the Clerk of the County Commission of Morgan County, West Virginia, in Deed Book No. 25, Page No. 319, said Lot Number Seven fronting 50 feet on Broad Street and 50 feet on Kern Street and containing one-fifth (1/5) of an acre, and said Lot Number Eight being and lying on the North side of the Berkeley Springs Road and on the South side of Kern Street.
AND BEING the same real estate granted and conveyed from Robert L. Coakley and Dolores F. Coakley, husband and wife, unto Emily Marple, Tim French, Jerry Starliper, Eleanor Pulse, Robert White and Warren French, Trustees for the Cherry Run United Methodist Church of Cherry Run, West Virginia, their successors in office and assigns, by deed bearing date the 10th day of September, 1999, of record in said Clerk’s office in Deed Book No. 188, at page 170 (hereinafter the “Real Property”).
Specifically, the Trustees will sell the Real Property upon the following terms and conditions:
The Purchaser shall be Iglesia de Dios (Israelita) MD 001, INC., a.k.a. Church of God Israelite (the “Purchaser”);
The Sales Price of the Real Property shall be One Hundred and Fifty-Eight Thousand Dollars and No Cents ($158,000.00) (the “Purchase Price”), which shall be paid in cash or certified funds by the Purchaser at the closing on the sale of the Real Property;
From the proceeds of the sale of the Real Property, the Trustees shall pay the seller’s reasonable closing costs, which shall include but not be limited to reasonable attorney’s fees not to exceed $2000.00, recording fees (if any), publication fees, unpaid real estate taxes and assessments, and a real estate agent commission of not more than Nine Thousand Four Hundred and Eighty Dollars ($9,480.00), shared between PraiseBuildings Religious Property Brokerage, LLC and Pearson Smith Realty.
The closing on the sale of the Real Property is scheduled to occur on or after June 30, 2024 at Conrad Luttrell, LLP, 127 Crimson Circle, Martinsburg, WV, 25403, at which time the Trustees will execute all necessary documents to complete the sale of the Real Property as described above, including a deed conveying the Real Property and any and all affidavits on behalf of Cherry Run United Methodist Church.
