Separate sealed Bids for the construction of approximately 42,350 LF of 6”, 4” and 2” replacement waterlines, valves, meter settings, service tubing, fire hydrants, steel casing, and related appurtenances to serve approximately 130 existing customers in Marion County, WV will be received by the Monumental Public Service District at the Barrackville Lions Club Community Building at 716 ½ Pike Street, Barrackville, WV until 2:00 p.m. Friday, August 30, 2024, for furnishing labor and materials and performing all work set forth in the Advertisement for Bids, Form of Proposal, Instructions to Bidders, General Conditions, Supplemental General Conditions, Detailed Specifications with Appendices, and Plans prepared by Hornor Brothers Engineers.
Immediately following the scheduled closing time for the reception of bids, all proposals which have been submitted in accordance with the conditions of this project will be publicly opened and read aloud. A Pre-bid Conference will also be held at the above location at 10:00 a.m. on Tuesday, August 13, 2024. In-person attendance at the pre-bid conference is mandatory for all bidders.
A summary of the work to be bid upon is described as follows:
CONTRACT 1: Installation of approximately 42,350 LF of 6”, 4” and 2” replacement waterlines, approximately 130 radio-read meter settings, service tubing, steel casing, water valves, fire hydrants, and other related appurtenances necessary to construct a complete and functional water distribution system.

All Bidders are required to have a West Virginia Contractor’s License per Section §30-42-12 of the West Virginia Code.
FUNDING: Any contract or contracts awarded under this invitation for bids are expected to be funded in part by grants and loans from: the West Virginia Department of Environmental Protection State Revolving Fund. Neither the United States, the State of West Virginia nor any of their departments, agencies or employees are or will be a party to this invitation to bid or any resulting contract.
DBE REQUIREMENTS: Each Bidder must fully Comply with the Disadvantaged Business Enterprises, and Affirmative Action Requirements, as identified in the contract documents.
The Bidder agrees to make “positive efforts” to subcontract a portion of the total value of the contract to Disadvantaged Business Enterprises. This shall be done in compliance with the six (6) affirmative steps as outlined in 40 CFR 33.240. Failure to demonstrate positive efforts to do so may lead to rejection of bids. For this program, the term “subcontract” includes all construction, modification, and service work contracted for by the bidder in the execution of the work under this contract.
BUILD AMERICA, BUY AMERICA REQUIREMENT: P.L. 117-58, Infrastructure Investment and Jobs (IIJA) Act, 2021 (Act), includes a “Build America, Buy America (BABA)” requirement in Sections 70911 through 70917 that requires Clean Water State Revolving Loan Fund (CWSRF) and Drinking Water State Revolving Loan Fund (DWSRF) assistance recipients to use iron, steel, manufactured products, and construction materials that are produced in the United States for projects for the construction, alteration, maintenance, or repair of a public water system or treatment works.
CONTRACTOR’S SALES TAX EXEMPTION: The Monumental Public Service District is exempt from West Virginia Sales Taxes and, by West Virginia Code §11-15-8d, can now extend this tax exemption to Contractors supplying goods on their behalf. The Contractor shall coordinate with the Monumental Public Service District the filing of any and all applications to the State of West Virginia, exempting the purchase of the specified Goods from West Virginia Sales Tax and hereby agrees to include the savings from such sales tax exemption in its total base bid.
NOTICE OF FEDERAL WAGE REQUIREMENTS: Contractors are required to comply with all laws pertaining to federal wage rates as issued in accordance with the Davis Bacon Act. The contractor will be required to pay the federal wage rates appropriate for each worker classification.
NONDISCRIMINATION IN EMPLOYMENT: Bidders on this work will be required to comply with the President’s Executive Order No. 11246. The requirements for bidders and contractors under this order are explained in the specifications.
SUSPENSION AND DEBARMENT: Recipient shall not entertain the use of businesses that are listed on the “System for Award Management (SAM)” at www.sam.gov in accordance with 2 CFR Part 1532 and Subpart B and C of 2 CFR Part 180.
WV ALCOHOL AND DRUG FREE WORKPLACE ACT: West Virginia code 21-1d-5 provides that any solicitation for a public improvement construction contract requires each vendor that submits a bid for the work to submit at the same time an affidavit of compliance with the bid. The enclosed Drug-Free Workplace Affidavit must be signed and submitted in the first envelope as evidence of the vendor’s compliance with the provisions of Article 1d, Chapter 21 of the West Virginia code. Failure to submit the signed Drug-Free Workplace Affidavit in the first envelope shall result in disqualification of such bid.
CONTRACT TIMES: The work will be substantially complete within 240 days after the date when the Contract Times commence to run, and completed and ready for final payment within 270 days after the date when the Contract Times commence to run. Liquidated damages are $1,000.00 per day.
BID OPENING PROCEDURE: The bid opening procedure shall be a two envelope system. The system shall consist of two separate and distinct envelopes each with proper identification. The first envelope shall be identified as “Bid Opening Requirements” and the second as “Bid Proposal”. Both shall be submitted in a single, large envelope, labeled with the contractor’s name, address, and name of the project with the contract number. The first envelope shall contain various items which are identified in detail in the contract documents.
The second envelope (“Bid Proposal”) shall consist solely of the bid forms.
In the event that all of the items are not complete on the Checklist from the first envelope, the second envelope shall not be opened. The bidder will be declared non-responsive. The lowest responsive bidder shall be the bidder who has completed all of the requirements for the first envelope and has the lowest total on the bid form.
Copies of the Contract Documents may be obtained from the office of Hornor Brothers Engineers located at 140 South Third Street or at the above mailing address upon payment of the following:

This payment is non-refundable.
Each Bidder must submit with his bid, security in the amount, form, and subject to the conditions provided for in the Information for Bidders. A certified check or bank draft payable to the Monumental Public Service District, or a Bid Bond executed by the Bidder with a surety company approved by the Monumental PSD in the amount equal to five percent (5%) of the bid, shall be submitted with each Bid, to guarantee the Bidder’s entrance into a Contract, if given the award. No Bid shall be waived or returned because the Bidder failed to or cannot comply with any requirements as set forth in the Plans, Specifications, or any applicable statutes of the United States, the State of West Virginia and/or local ordinances.
No Bid may be withdrawn for a period of ninety (90) days after the time of the opening of the Bids.
Any Contractor submitting a Bid on this project hereby certifies, indicates, and acknowledges that he/she has a license and meets all the qualifications required by the statutes of the state and subdivision in which the work is to be performed.
To guarantee the faithful performance of the Contract, the successful Bidder will be required to furnish the Owner a Performance Bond and Payment Bond for 100% of the Contract price. These Bonds are the ones that are executed in connection with a Contract to secure fulfillment of all the Contractor’s obligations under such Contract.
Bids received after the scheduled closing time will be returned unopened to the bidders.
The Monumental Public Service District reserves the right to reject any or all Bids.
